UPDATE — We Are Now Representing Marcus T. Bailey… A Victim Of A Particularly Odious Identity Theft…

whopperline-david-wolf-marcus-t-bailey-2016Here is the next chapter on this (see the immediately previous post for background).

I’ve now been formally retained by Mr. Bailey to pursue the momentarily-anonymous racist at PowerLine blog who has purloined his likeness, and made truly awful racial comments, using my client’s face and likeness.

FaceBook is getting me the perp’s real-world details, for service of process purposes.

Here’s what else has transpired, minus all his odious, invective-laced replies. Here are mine:

“…[Yesterday afternoon] David Wolf — Y A W N.

Last chance: Remove the image of Mr. Bailey from your FaceBook page, and the little one you are using as your avatar, here. I am now in direct contact with Mr. Bailey.

After 5 pm today, your theft of the REAL Mr. Bailey’s identity becomes presumptively willful, under the applicable statutes. [You should ask a lawyer what that means.]

The applicable statutes presume damages when you attribute false views and positions to a private person — views repugnant to him, personally — that is, views which that person manifestly does NOT hold.

This is the essence of one facet of identity theft.

Alternatively, I can just forward this entire thread to Mr. Hinderaker, and let him decide whether he wants the headache of discovery motions, about your real identity, your real head-shot, and your real world contact details. As well as his having to review the incoming correspondence from the real Mr. Bailey, about PowerLine allowing a clear imposter to post here under Mr. Bailey’s identity.

I suspect that is not a headache Mr. Hinderaker wants.

Either way, good luck — you are going to need it.

नमस्ते…

[This evening…] David Wolf — keep your shirt on, there sister.

Your silly-arsed-sorry side-show is not even remotely my tenth priority, in life.

And Mr. Bailey is incarcerated, so it will take a moment to get the actual retainer processed, signed and returned. It has to clear the guards’ desk — and the floor watch post, yet. And I won’t act in the courts until I have that from him, in my hands. I am a clever, and yet careful lawyer, you see.

[And it all works nicely anyway… as “revenge is a dish best served… cold,” as Sweet Will taught us.]

But do be sure — we are fixin’ your lil’ red wagon, in due course — in a completely lawful, court-sanctioned way.

So do buckle up, buttercup.

whopperline-hinderaker-race-trope-2016I should also make clear that I have declined your friend request on FaceBook — and now that the FaceBook folks know of your identity theft (courtesy of… me! — you’re welcome!)… you should see your FaceBook account suspended… in the next few days.

But don’t fret — I’ve imaged your profile and details there — for future court pleadings.

I still haven’t bothered to alert Mr. Hinderaker. I’ve decided that is largely pointless, now that FaceBook will handle your deletion directly.

See ya’ in the funny papers, junior.

नमस्ते…

[Late night…] UPDATE: Who knew?! The facility housing Mr. Bailey supports signed and emailed PDFs, and it came in whilst I was out on business, today.

I am now retained, of record, by Mr. Bailey.

You will next hear from FaceBook — where I’ve blocked you. After that, you are likely to hear from the owners of PowerLine. This conduct violates their membership charter, as well. Once either or both of these hand me your contact details (I don’t trust you to give me real details yourself, you small-time fraudster), we will see you in court.

A warning: Mr. Bailey is now represented by counsel. You should not try to contact him. All future communication will be routed through my office exclusively, under his retention agreement. This applies to members of his family as well.

It would have been easier on you, if you had just stopped stealing an incarcerated man’s likeness. I get that you thought it was “cute,” but you’ve blown your chance (a chance I gave you yesterday) to back out semi-politely, now.

He’s on lock-down at most of the times you are posting here — so the proof of your theft of his likeness is right here on PowerLine, time-stamped for the whole world to see.

But whatever. You’ve made your choice.…”

I’ll keep you all posted, right here, in the coming days and weeks.

His Real Name Is Marcus T. Bailey…

whopperline-david-wolf-marcus-t-bailey-2016And at least during 2009, he really lived in Evansville, Indiana.

A white racist with an alias of “David Wolf” — a member at/on PowerLineblog.com — is using this photo, without permission (from Mr. Bailey), to promote radical right, anti-immigrant, pro-Trump, anti-BLM rhetoric. Whoever this white guy is, he is a particularly odious little skunk.

So tonight, I have a new science project: Let’s see if the real Mr. Bailey would like to recover damages from “David Wolf” — shall we?

I’ve got a good lead on him now. Can’t say how.

Yes. Let’s see.

Geo. H. W. Bush Will Vote Clinton 2016. PowerLine? Crickets.

whopperline-bush-41-votes-hrc-2016I want to just briefly note for the record here that while it seems Bush 41 always thought pretty highly of Hillary R. Clinton, it took the likes of a petulant man-child at the GOP for that former Republican President to come out and vote for her. To switch parties, that is.

While PowerLiners will never mention it, this is a big deal. Why?

Because Bush 41 is voting on principles. True, he is only one man — but when a former commander in chief from one’s own party disavows the chosen candidate so openly, one ought to take heed.

Certainly, he would have rather voted for Jeb, had that been an option, but he is now confirming that he will — like George Will — vote for HRC. And that is in no way dismissable as “sour grapes” — about Jeb’s loss.

No — it is about principles of pluralism. An American virtue that Donald Trump clearly sees as a… vice.

I strongly suspect that Donald Trump has effectively killed whatever the GOP once was.

I don’t think it matters whether this party keeps that name. The party of Bush 41 and Ronald Reagan is… now gone.

It has left the building. Those two former Presidents were never going to be my chocie in any head to head election, and I almost never split ticket vote — as I almost never see a Republican that shares my core values. SO I suppose I shouldn’t care too much that Trump has killed the GOP.

But I do think whatever replaces it is likely to be meaner, more small-minded and less principled than either of those two former Presidents were.

And so, purported real conservatives like those who write at PowerLine ought to be discussing it.

And all we hear are… Late Indian Summer crickets. Now you know.

Mr. Trump Runs A Charity… That Is NOT, Apparently.

whpopperline-trump-charity-wa-po-09-20-16The Washington Post has been regularly doing an excellent job of dissecting what is public about Mr. Trump’s foundation. Since we cannot see his 1040, we are taking his 990 apart, bit by bit, it seems. Smile. [And all of this ignores the fact that most of the charitable donations he claims to have made — by dollar amount — were, in fact, never made.]

What is known is highly troubling. First, since at least 2009, Mr. Trump hasn’t used any of his own money to fund the foundation — he simply repackages donations of others. That is unprecedented, for a major foundation — and an exceeedingly dangerous (i.e., bad) practice.

Second, it is thread-bare, and keeps nearly no reserves.

Third, as of today, the Wa Po is reporting that in at least four instances, Mr. Trump had his “charity” pay off his personal business obligations — usually coming in the form of settlement(s) of lawsuits.

A partner at the highly regarded Venable firm, in DC — as well as several other experts in tax exempt organization law — have weighed in on the record for the piece, calling his pattern of behaviour “shocking“.

Having represented a few 501(c)(3)s myself, I can attest that what the Wa Po describes is classic self-dealing — and is (in my opinion) a very clear violation of the US Tax Code.

It is just so immensely ironic that he was faulting the Clinton Foundation, as recently as last week. It looks for all the world as though he runs his as a… criminal enterprise. That is my opinion. And he is a public figure — but all of this nonsense is way over the line of lawful practice, again in my opinion.

Now you know.

John Hinderaker: Racist — And Chuckle-Headed Apologist — For A Racist GOP Candidate

whopperline-hinderaker-racist-applause-trump-2016Mr. Hinderaker needs to get out of the sun.

His mind is… shot. He used to be smart enough not to say such things… aloud, and in public.

The set up here: earlier today, Mr. Trump played coy, bobbing and weaving — about whether he would FINALLY admit to promoting a manifestly racist and unfounded five year lie about our 44th President’s place of birth.

There is no doubt that lie is a racists’ appeal to invidious animus. How does Mr. Hinderaker react? He praises Mr. Trump, as a genius — for “playing” the press.

If you ever needed clearer proof that John himself is a racist, this would be it: in his warped mind, continuing a racist lie — for a few more days — or hours, even — if it gets you some free press coverage… is a good thing for the GOP. And for John’s chosen candidate.

Praising someone (in anonymous, ordinary day to day conversations) who makes even a racial “joke” is a sign of a latent… racist.

Praising a GOP candidate for telling a five year lie — a lie John has openly admitted is irrefutably false — is… proof of overt racism. It is all anyone need know about whether Mr. Hinderaker is himself a racist.

He is. And the proof of it is that he thinks this racist’s joke/lie is worthy of praise.

John — you’ve lost your soul.

It is sad, really. Mr. Trump has taken your soul. More precisely, you’ve sold it to him — and cheap. Ugh.

And Donald Trump Gets “Curved” — In A Flint, MI AME Church.

whopperline-trump-timmons-curved-2016I know this won’t even remotely affect any outcome of any electoral demographic, as Mr. Trump will lose the “black churched American vote” by overwhelming margins anyway — but I just wanted to note that (in direct contrast to his pre-recorded infomercial from a black televangelist’s pulpit in Detriot two weekends ago), Mr. Trump learned yesterday that unscripted black America sees right through him.

That is — even though the pastor strongly disagreed with his political views, that same pastor welcomed him there with respect, and open arms — solely to thank him for bringing more attention to the Flint water crisis. That was a show of Christian charity.

Then… Trump went all orange pumpkin Donald, after being warned not to, by the very same pastor. And so, the pastor took the mic from him, telling him he was not welcome to disrespect HRC in her church.

Later yesterday, Trump seemed to attack the pastor for enforcing her pre-announced rules — in her own church (on Fox):

Trump (referring to the pastor): “…it doesn’t bother me. Everyone plays their games. It doesn’t bother me….”

Well. Plays their games?! What an unsurpassing dolt.

Cutting back to Bethel church then (earlier in the day), when real people — real Americans — started to ask real questions, like about his record on renting to African Americans (or more precisely, his history of NOT renting to them — and fighting dozens of discrimination suits, in his rental property empire)…

The Donald simply left. He said he was out of time, after only 16 elapsed minutes.

That’s the Donald for you.

He loses in November, for certain.

YAWN. John Returns To His Race Trope, Now That The Economy Clearly Favors HRC…

Whopper-Stars-Bars-Hind-2015Five or more years ago, I would have spent some time dissecting his non-sequiturs on race, for what they were. Line by line.

No longer. It is all so… unneccessary. John’s entire (15-plus-year) thesis on race boils down to this: “my white entitlement is not racism….”  Yes, he repeated it again last night.

And as he often does — he quotes a member of the black community, describing problems black people face, even from within their community. [This time it was Charles Barkley — “Sir Charles” is right about what he says, but that doesn’t let John and Donald off the hook. John simply conflates the two.]

So — as he always does, then — John leaps to his standard canard: here’s the non-sequitur, folks — he states that “since SOME black people (admittedly) pull their own brothers and sisters down, I am NOT a racist, when I treat ALL black people with suspicion, assuming they are dangerous criminals in training…”

Whopperline-Trump-Race-Rental-2016This has always been his logical fallacy: he conflates the fact that some black people treat each other poorly, with the notion that he (and by inference most Trump supporters, and Trump himself) CANNOT be racist.

The second simply does not follow from the first. And he knows it. He is one dishonest (thankfully retired) lawyer.

Now — with the economy most recently doing better on job creation, and growth — than it has since before Bush 43 took office — this race is HRC’s to win.

And win it she will. Even with the latest (normal) tightening of the national polls, as we come into the home stretch, here — Trump will STILL (as has been true since at least April of 2016) have to run a five ball table, in one shot — he must win ALL (and each) of Florida, Ohio, Iowa, North Carolina and New Hampshire (or Virginia), in order to have any chance at reaching the needed 270 electoral college votes.

whopperline-hinderaker-race-trope-2016If HRC takes any one of those — or most likely — squeaks out an outright win in Iowa — and less likely, in any ONE of Maine, Nevada or Arizona, Trump cannot win. [To be clearer on Maine — if HRC gets even just the Second District of Maine (which usually turns red) — since she already has the statewide lead in Maine overall, it is over, nationwide — for Trump.] That’s the math. Don’t trust me — but do trust Nate Silver.

And HRC is back campaigning, starting today. Bub-bye John — and bub-bye Donald. You both are… fired.

Mr. Hinderaker: Shameless Non-MD Quackery.

whopperlie-sept-11-2016Once again, Mr. Hinderaker, without the benefit of a medical degree, or access to Mrs. Clinton, to examine her “condition” — was simply salivating to capitalize on any misfortune — real or largely imagined — he might perceive on this somber memorial day. Classy, John… really classy.

He is the most odious of falsehood spreaders. Forget his lies. Here is the actual truth.

Here is The New York Times –i.e., the truth of it:

…“Secretary Clinton has been experiencing a cough related to allergies. On Friday, during follow up evaluation of her prolonged cough, she was diagnosed with pneumonia,” said Dr. Lisa R. Bardack, who examined Mrs. Clinton at her house in Chappaqua on Sunday. “She was put on antibiotics, and advised to rest and modify her schedule. While at this morning’s event, she became overheated and dehydrated. I have just examined her and she is now re-hydrated and recovering nicely.”

Mrs. Clinton was taken from the morning event at ground zero to the Manhattan apartment of her daughter, Chelsea. About 90 minutes after arriving there, Mrs. Clinton emerged from the apartment in New York’s Flatiron district and waved to onlookers, posing for pictures with a little girl on the sidewalk.

“I’m feeling great,” Mrs. Clinton said. “It’s a beautiful day in New York….”

Now you know. She will be just fine — and Mr. Trump still hasn’t released any tax information (even though his own Veep pick has), or his own health records. Sheesh. Please salivate over that, just a bit, John.

Mr. Trump: Violated Logan Act (Again!) — But That’s Not The News — “Hail Maria” Is THE NEWS…

WhopperLine-Trump-Wall-Fail-2016I don’t even care any longer that Mr. Trump’s meeting with the sitting President of Mexico did in fact discuss international border issues — including “the wall”, and the fact that the President of Mexico flatly refused to help pay for it. [In this matter, we will be taking the word of the sitting President of Mexico, over that of the serial fabulist Donald Trump.]

I don’t care that such discussions, at the meeting yesterday, by a private US citizen (in undeniable opposition to current US Administration positions), about matters of foreign border enforcement affairs (a power reserved by the Constitution to the sitting US President), almost certainly (again!) violated the Logan Act (three year prison sentence upon conviction).

No… I don’t care… because by last night, in Phoenix, Mr. Trump effectively buried his only chance to win the Presidency. He once again reversed course (3 times in three weeks!), and re-hardened his stance on all forms of immigration — and immigration policies.

As a result, this morning, several of his surrogates — in the Latino community — have openly and justifiably bitterly resigned:

…”I gave Donald Trump a plan that would improve border security, remove hardened criminal aliens and most importantly give work authority to the millions of honest, hardworking immigrants in the US,” Monty wrote. “He rejected that (on Wednesday) and so I must reject him. He was moving toward a reasonable, pro business and compasisonate immigration plan. (Last night) he was not a Republican but a populist, modern day Father Coughlin who demonized immigrants….”

Whopperline-538-08-04-16Mr. Trump now definitively has no path to 270 — without a much better showing in Latin communities than Mr. Romney made, in 2012. He was well-behind Mr. Romney’s 2012 low water mark, going into last night. Now he is certain to post the worst support from the Latin community, in the modern era (since 1980). He is all but certainly a loser.

The bottom line is that I am saddened (for our republic) that this lunatic is a major party nominee — but thrilled that it means we will elect a wise, strong, seasoned and level headed President, come November. And as it happens, she will be the first woman to ever hold that office.

[As a footnote, I should mention that Mr. Hinderaker is out overnight, doing a “puppy lick” all over Mr. Trump’s trip south of the border — and he’ll soon post how much he liked the Phoenix speech.  Who cares, really — John? It is just precious — and what an easy mark for the opposition he has devolved into. Hilarious.]

Congrats, Mr. Hinderaker — and Mr. Trump — you’ve (been) played flawlessly, to form — and right into our hands: the Center Left of America.

Word.

Well — This Is Precious.

Whopperline-John-Cole-Cartoon-Trump-2016About 20 minutes ago — in broken English, and poor grammar [which his handlers will no doubt eventually edit, and recast (just as they did with his original “D-Wade” tweet from Saturday morning!)] — Mr. Trump had this to say — via tweet:

“…Now that African-Americans are seeing what a bad job [sic] Hillary type policy and management has done [sic] to the inner-cities, they want TRUMP!…”

I will give Mr. Trump this much: he sure can pack a LOT of ignorance into just a few words.

Let’s unpack this: (1) he assumes, in error, that almost all black people live in the inner cities. (2) He assumes we (or he!) must know what a “Hillary type policy” is — whatever that might mean — insofar as it applies to his chosen topic (which I am guessing is broadly urban decay). (3) I do not think HRC has served in any governmental capacity where her views on inner city crime were ever part of her policy portfolio/set assignments. As we all know, but Mr. Trump does not, apparently, Secretary of State handles matters outside the US, not inside it. (4)  I suppose he might be referring to HRC’s time in the US Senate. But let us be clear — only insofar as she was one of two US Senators representing the entire state of New York (which would include NYC) — I don’t think Mr. Trump has any data for what he calls a “Hillary type policy” to critique.

(5) Of course, none of it matters to Mr. Trump. He cannot keep his own positions — let alone other peoples’ — straight from minute to minute. The same is true, as to any actual facts on “inner city” crime.

(6) So once again, Mr. Trump’s “appeal” to black voters, such as it is (which I am told, he is going to take to a black church in Detroit on Saturday — a televangelists’ pulpit actually, but why quibble?)… amounts (and may fairly be reduced) to “Gosh — everything about you, and your life, sucks — so vote for me.”

No matter that he has it all wrong — about almost any/every -ones’ actual life — black, brown or white. As I’ve said — he loses in November — and badly.

Onward.
