[U] In Which We Learn That Mr. Hinderaker… Cannot Read. Not For Comprehension, At Least.

UNTITLEDUPDATED 05.26.2017 PM — Mr. Hinderaker has once again doubled down on a dishonest pretense — pretending that he doesn’t understand what all other serious lawyers do understand: First Amendment “time, place and manner” restrictions, are a bedrock line of cases. Supreme Court cases. And, that the argument that a “different” President would get a different result is true because this President essentially yelled “FIRE!” — in a crowded theater. A President who sits quietly — and watches the show Hamilton, will not be ejected from the theater, precisely because that other President didn’t violate First Amendment law. Facts matter John… But no, Mr. Hinderaker pretends he never read those cases. Shameful — and with this, he undermines respect for the law with his dishonest and illogical “arguments”.  [End — updated portion.]

YAWN. Just as I said, months ago — and repeated under that link, supra. John’s “bullet proof” is in fact, to any capable Constitutional lawyer — so much swiss cheese.

The Fourth Circuit — 10-3 just declared Muslim Ban 2.0 a dead letter. On to the Supremes where it will fail, at least 6-3 — and maybe 9-0. Even with the much Hinderaker- vaunted Gorsuch in his robes, and listening.

whopperline-trump-immiration-2017[Silly me. I thought the Ninth’s three judge opinion would appear, and be published,  first.] The line-up is 10-3 AGAINST Mr. Trump’s Muslim Ban 2.0. It would not surprise me to see the 3-0 opinion AGAINST it, tomorrow, out of the Ninth Circuit.

I had guessed a minimum of seven were going to lean that way — in the Fourth — and eight did, in full. The language Chief Judge Gregory (writing for the majority in the Fourth Circuit) uses is. . . towering, as the threats presented — by the 45th President himself, were. . . unprecedented, in their audacity — in at least the last three-quarters of a century:

. . . .The  question  for  this  Court,  distilled  to  its  essential  form,  is  whether  the Constitution,  as  the  Supreme  Court  declared  in Ex  parte  Milligan, 71  U.S.  (4  Wall.) 2, 120 (1866), remains “a law for rulers and people, equally in war and in peace.”  And if so, whether it protects Plaintiffs’ right to challenge an Executive Order that in text speaks with  vague  words  of  national  security,  but  in  context  drips  with  religious  intolerance, animus, and discrimination.  Surely the Establishment Clause of the First Amendment yet stands  as  an  untiring  sentinel  for  the  protection  of  one  of  our  most  cherished  founding principles — that  government  shall  not  establish  any  religious  orthodoxy,  or  favor  or  disfavor one religion over another. . . .

President  Trump,  in  a  speech  at  a  rally  [on March 15, 2017] in  Nashville,  Tennessee, described  EO-2  as  “a  watered down  version  of  the  first  order. . . .”

To the extent that our review chills campaign promises to condemn and exclude entire religious groups, we think that a welcome restraint. . . .

THACKER, Circuit Judge, concurring: I  concur  in  the  majority’s opinion  but write  separately  for  three  reasons:  (1)  I would  not  consider  remarks  made  by  candidate  Trump  before  he  took  his  presidential  oath of office; (2) I would nonetheless find that Appellees have demonstrated a likelihood of  success  on  the  merits  of  their  argument  that  Section  2(c)  of  the  Second  Executive Order  (“EO-2”)  violates  the  Establishment  Clause,  based  solely  on  remarks  made  or sentiments  expressed  after  January  20,  2017;  and  (3)  I  would  conclude  Appellees  have demonstrated a likelihood of success on the merits of their argument that Section 2(c), as it  applies  to  immigrant  visas,  violates  8  U.S.C.  §  1152(a)(1)(A)  of  the  Immigration  and Nationality Act (“INA”) [Ed. Note: that is the LBJ-era amendment I’ve written about at length here]. . . .

whopperlie-hinderaker-2017On to the Supremes. I read an advance sheet of this at [redacted] PM CDT today — and wasn’t taking or making any work calls, since I was on one of the briefs (on the prevailing side, of course). Now it will be a GREAT Memorial Day Weekend, for those of us who still believe in ordered liberty, under the law. . . . Woot! Yep — onward, to the Supremes — where (“Condor predicts”) 45 loses 6-3. As it is, he is 0-for-6, in the courts, if memory serves thus far.

When Vladimir Putin Offers To Vouch For Mr. Trump’s Veracity… Before Congress…

whopper-3trump-not-serious-2017I write this evening primarily to laugh at John Hinderaker… and his endless historical self-revision.

Even so, there is a bit of a serious undertone here: I suspect — but cannot verify — that Mr. Hinderaker, too (albeit privately) found this morning’s Russian/Putin “agitprop” salvo the last straw. In the morning’s story, Mr. Putin offered to produce Russian-sourced transcripts — ostensibly to exonerate Mr. Trump, in the Russian investigation.

To be sure — that is masterful Russian propaganda: offering the US Congress Russian government resources, to help Mr. Trump hold on to his office — for at least a little while.

Whopperline-ALT--Nix-45-RawGenius, in the sheer audacity of it! But now, setting aside Mr. Putin’s nonsense — let us consider what this says about the state of our fine, old and venerated Republic: the US Congress may at present be (at least marginally effectively)… trolled, by the Russian monarch (falsely styled as a President, himself).

Why? Because the 45th President has gone out of his way to sidle up, and play kissy-face with him. [And that is the most charitable spin any one can put upon Mr. Trump’s actions, taken as a whole.]

Our vulnerability to being trolled, or “agit-propped“, is a direct result of the amateurish positions our rank amateur President has taken, and continues to take. [Again, that is with a rosy lens of charitability on his on the record remarks.]

And tonight, like many Republicans in private, I suspect, Mr. Hinderaker is admitting what the rest of us long knew. This man — 45 — is unfit. John writes (significantly revising his own more recent prior history, but who really cares? At least he’s right, for the moment!):

Life-45-Arguable-Felony-Admission-05-12-2017“...During the campaign, I warned against nominating an amateur for president. The presidency, I wrote, is not an entry-level position. What we are seeing is partly the result of Trump’s unique personality, but I think it is more the consequence of his inexperience in politics…. [Editor’s comment: Uh-huh. ya’ think?!]

…The Democrats would love to drive Trump from office, but they can’t do it without the collaboration of Republicans. [Editor’s note: that came tonight, with Independent/Special Counsel Mueller’s appointment by the Deputy US AG.] If Republicans focus on legislating rather than wringing their hands over the latest… White House scandal, they can start making progress again….”

Remind me — what have they actually done? Right. Nuthin’. Zip. Nada. AHCA is DOA. All “non-advisory” Executive Orders are — steadily foundering, on constitutional grounds.

UNTITLEDJust the same, it is probably some good proof that the GOP ship is starting to right itself, and sail away from the Pumpkin-hued hurricane — if the barnacle-encrusted dingy being pulled behind it, by about a half mile of frayed, rotting  hemp rope… called “HMS Hinderaker,” is finally expressing concern — about Mr. Trump’s continued grip on power.

And even he is FINALLY beginning to row away from 45’s lunacy.

I love it. Thanks John — welcome back to the land of the living.

Mr. Hinderaker Loses Any Grip — On Reality… Comey Edition

Whopperline-ALT--Nix-45-RawIt was a truly-unprecedented week, in the thankfully very narrow history of our republic’s Presidential excesses.

Some argue that Mr. Trump’s actions are no more than Nixsonian — as to firing independent investigators — and taping private conversations. I’d argue that we are well-past that very sad 1970s mile marker. Mr. Trump is in an entirely repugnant “class of one”, now — in debauched Presidential history.

To wit: Mr. Hinderaker went so far late this week — as to suggest that Mr. Trump’s breath-taking fiat this week was “no different” than one he openly and brazenly lies about — as to Mr. Obama. [Mr. Obama had, at one time, provided audio of a press interview conducted in the Oval Office, to a reporter — when that reporter’s device lost battery power. The reporter knew in real time that the White House was making public record copies — for the Presidential Archives.]

Life-45-Arguable-Felony-Admission-05-12-2017By way of stark (and obvious) contrast, Mr. Trump has now by tweet intimated that he secretly taped a law enforcement official — actually, the nation’s highest law enforcement officer — who was at the time conducting official business, in an investigation into the President’s own potentially treasonous behavior. And Mr. Trump then fired that man, in the middle of this investigation.

This is undoubtedly uncharted territory. 45 threatened, in public, a man who might exercise his first amendment rights to speak about matters of substantial public concern — arguably criminal, and perhaps treasonous activity — by that same President. Mr. Nixon may have threatened many in private, similarly — but even he wasn’t stupid enough to do so, in public. To admit openly, to a feeble attempt to obstruct justice. That’s 45, for you — and Mr. Hinderaker, too — it would seem.

whopper-3trump-not-serious-2017Sad territory — and Mr. Hinderaker is clearly no patriot. He is a sycophant — of the worst kind.

He knows better, too. Disgusting.

56 Years On… Newton N. Minnow — And “The Vast Wasteland…” Speech

Life-ALT-Minnow-Wasteland-1961 As I listened to the Fourth Circuit oral arguments yesterday, via an IP connection, I found myself wondering whether the now 91 year old Mr. Minnow might see the content rich media delivered by internet as at least one additional reclamation project — in his five and a half decade push to alleviate the “wasteland“. [As garbage goes, Mr. Hinderaker is a contributor of epic proportions — to tie it to the subject matter of this outlet.]

Where was I? Oh. Right. Fittingly, Mr. Minnow was awarded a Presidential Medal of Freedom in 2016 (by President Obama) for his life-long work, advocating for television “in the public interest“.

Here is the bit, from exactly 56 years ago this morning — during his first major speech as chairman of the FCC, under then-President John F. Kennedy — an electrifying speech that won him a leading role in the history of media in the late 20th Century:

. . . .When television is good, nothing — not the theater, not the magazines or newspapers — nothing is better. . . .

But when television is bad, nothing is worse. I invite each of you to sit down in front of your television set when your station goes on the air and stay there for a day without a book, without a magazine, without a newspaper, without a profit and loss sheet or a rating book to distract you. Keep your eyes glued to that set until the station signs off. . . .

I can assure you that what you will observe is a vast wasteland. . . .

I do think he would say, if one is willing to scout about a bit — the internet will offer much of the higher-functioning content he so craved in 1961. Of course, there is a lot of garbage out there, too — and of course, cable has given television both its share of sublimely shining moments, and all-time new lows.

So — onward, in silence, into the start of year 57, plus about seven hours — in reclaiming the wasteland (that duty falls to all of us, near and far), on this chilly gray morning here. Smiling just the same, though. . . .

[U] Mr. Hinderaker Is Knowingly Deceptive, On Fourth [And Ninth] Circuit Today…

Whopper-Hinderaker-Loss-05-2017 UPDATED: May 16, 2017: Mr. Hinderaker has this morning reiterated (in reaction to the Ninth Circuit arguments of yesterday, in which Mr. Wall was also soundly routed) his plainly-errant view that “time, place and manner(s)” don’t matter in First Amendment cases.

He also claims that the Supremes will agree with him — that Mr. Trump is actually some goofy version of a wanna-be Putin. [See the elaboration on that notion, below.] But whatever. They won’t. You may now stop reading, unless you are morbidly curious about how dishonest the rhetoric needs to be — in order to save Mr. Trump’s order.

Ready to read on? Very well. I should also note that in the Ninth Circuit, yesterday, the panel paid quite exacting attention (and properly so!) to the notion that Congress knows how to repeal a law — and plainly did not do so, at any time, after the 1965 amendments to the NIA — signed in the shadow of the Statue of Liberty — by then President Johnson. Those amendments are still enforceable law, as enacted by Congress.

In a fit of Mad-Hatterdom, Mr. Wall yesterday told the Ninth Circuit that the courts (even the US District courts!) have the power to read that long-standing prohibition on “religious or nationality discrimination” right out of the law, on the court’s own volition. He said there was no duty to harmonize the law, as a whole. Preposterous.

Mr. Wall also implied that the President on his own, may overturn existing federal law, passed by Congress — by simple Executive Order. [Of course, he doesn’t really believe any of that, but that is the only way Mr. Trump may save his order, here.] We all know there is a line of cases going back over a century that directly refutes this appallingly stupid argument — it does not pass any “straight face” test.  Mr. Trump loses, at least 5-4, and maybe 6-3 at the Supremes. That’s how this one ends. [End, updated portion.]

Let us start at the beginning: the question the able jurist actually asked was whether — on completely different facts — a facially neutral order like Muslim Ban 2.0 could ever be found constitutional. The jurist asked what if another candidate/President (one who had said none of the things 45 said) adopted this order.

And the answer given was — if that mythical President complied with the APA — and the NIA, as amended — when he/she implemented it — it could be constitutional, depending on other facts. [To be clear, Mr. Trump did not so comply. And Mr. Trump created an orgy of evidence that his intent was — and is — to violate the Supremes’ holding in Lemon.]

Tonight, John Hinderaker knowingly distorts this dialogue — to suggest something preposterous:

In John’s flat-Earth world, if it is perfectly lawful to yell “Fire!” on a deserted street corner, at 7 AM on a Saturday morning (and it is!), but it is unlawful to yell “Fire!” — inside the sold-out Ford Theater, on Friday night, while “Hamilton” is playing (and it is!)… then the law must be… seeking an “absurd result“. Uh-huh.

whopperlie-hinderaker-2017No, John — as you well-know — time, place and manner matters, in First Amendment free speech cases — so to, in religious First Amendment cases. Like this one.

Facts matter. Shooting someone in self defense is not murder, but shooting them in the back without provocation… is murder.

Sheesh. Here endeth the entirely-remedial logic lesson for Mr. Hinderaker’s more pointy headed acolytes. Of course, he well knows he’s making a specious analogy. But he doesn’t care.

Onward. and Namaste.

Of Mr. Hinderaker’s Inability To Read The Congressional Record…

UNTITLEDI’ve long held that reading… is a skill. And I’ve long hoped that as a trained lawyer, Mr. Hinderaker would read the Congressional Record, before opening his yawning yap. That hope has mostly been in vain, ‘lo these last 15 plus years — and today is more of the same.

Mr. Hinderaker is right, insofar as he mentions that TrumpCare 2.0 contains a stealthy provision to cut taxes for the wealthiest two per centers in the nation. It is a repeal of the taxes on investment income — a Christmas tree ornament amendment dropped in to push the last couple of holdouts to support the bill in the House.

Of course, none of this will ultimately matter — because the ill-starred bill will now founder in the Senate.

Thus it is all Kabuki theatre of the most prosaic sort — as I’ve written at my other properties this week. So, yesterday when Mr. Hinderaker declared that its passage by two votes in the House means Democrats “lose big” and spin wildly — I simply chuckled, and kept my own counsel. [Do see below — for how 45 will be the ultimate loser, here.]

untitled10Today, though — instead of admitting that the bill contained pork for the richest people in the nation, he goes on a rant about all the old “taxes” previously embedded in the original ACA of 2010. Many of them have been amended or have expired, outright — but John quite tellingly fails to mention — as Minority leader Pelosi just did — the sop for the ultra-wealthy in the bill.

So I write this evening solely to record that either (i) Mr. Hinderaker hasn’t read the bill — but is opining on its illusory virtues (as he is often wont to do — i.e., clue-free), or (ii) more darkly — he is simply… a liar. Again.

As he’s been — pretty uniformly — for 15 plus years.

Now you know. And as I’ve long said, this goofy bill is D.O.A. in the Senate, after the non-partisan CBO scores it — that will appear next week. And OrangeCare 2.0 will be more deficit inflating, and more cruel, upon the neediest five per cent of the nation than TrumpCare 1.0 was. It is a… dead letter.

Try to read, John — that sh!t is… “fundamental, and sh!t” — ref. “Out of Sight“… and the great Don Cheadle Maurice “Snoop” Miller character, all while in a Lompoc library.

45’s Latest Depravity — A Sign Of Desperation — On Domestic Policy?

untitled10I have resisted for almost three weeks — resisted even mentioning the near daily lunacy 45 utters about his now plainly unraveling lies — on health care. But with Christ now lain in the Samaritan’s tomb (according to my former covenants) — I will arise, and venture forth, to tell Mr. Trump — of his ultimately impotent and banal depravity.

To speak the truth — to that vain, and small handed power. And tell the readership — though I suspect most of you saw it in the New York Times, this very morning (Paul Krugman’s opinion piece is spot on, as well). [He is threatening a wide array of the support payments (some of which he lacks the power to change, without an Act of Congress), now embedded in the US health care delivery system — well beyond de-funding Planned Parenthood, overnight.]

Although I continue to firmly believe 45 will be unable to broker any deal on his broad promises about health care delivery, it is enlightening to see his latest tactics. They smell of. . . desperation. The desperation his Congress-critters now convey to him — fresh from the town halls as they (and he) are confronted with the lies they told. And told — and told.

His latest gambit is the classic New York con-artist/thug’s gambit: “that’s a very nice safety net (basic health care for the poor) you worked so hard to build, there (Mr. Obama and the Democrats). . .” then he snarls — “it would be a shame if it imploded” (because I cut the existing funding streams). . . .

This is a form of brazenly immoral posturing — and it must be resisted. Let him own the implosion, if he dares go through with it.

He won’t. Just like a few weeks ago, with his empty threats — this is. . . just that. He will have to step away from the threat, because even the GOP Congress will not back him, in adequate numbers. It is a disgusting, odiously pungent and vain little threat, just the same. “We, the People” must tell him so. Over and over and over again.

“We, the People” are not one of the many, many subcontractors on his former building projects — the ones he didn’t pay, or bullied into taking a fraction of what he owed them. We need to stand as one, and put the lie to his cheap, charlatan theatrics, on health care. No Act of Congress, until later in 2018, is my abiding bet. Even if he tries to put it ahead of the tax legislation debates — and perhaps especially so, if he is foolish enough to do so.

I’m off the grid for the weekend. Be well one and all; enjoy dying eggs if the spirit moves you! Whoosh!

Yes — Mr. Trump Is Quite Ignorant — Of Even His Own… Ignorance.

whopperline-trump-suit-libel-loss-nyt-2016To be sure, he had said it before, on the campaign trail, during the Summer and Fall of 2016. I kept my own counsel, and stayed silent, as it wasn’t worth wasting the electrons refuting the monumental ignorance embedded in his suggestion. But now, as President, he is saying it again. See below — so I guess I’ll need to respond.

[I would have assumed that by now one of his lawyers would have taken him aside, and walked him through how completely impossible — as a matter of political practicalities, to say nothing of irresponsible — his idea is.]

Licking his wounds (on his health care non-start, from last Friday — a self inflicted wound if ever there one was) — this morning, by tweet, he turns to cannibalize the Freedom Caucus, and urges the proper GOP to “eat” their own. Charming. That was five hours ago. Full-on self-destruct mode, in under 90 days in office. [But I digress, from the main narrative here.]

Four hours ago, and clearly still raging impotently, he once again suggested he’d “rewrite” libel laws. Also by insipid tweet:

“…The failing has disgraced the media world. Gotten me wrong for two solid years. Change libel laws?…”

Uh-huh. So, Mr. President… funny thing — it turns out that you’d need a new constitutional amendment to do that. “Changing” the US libel laws almost always immediately runs afoul of… whopper-3trump-not-serious-2017yep — the First Amendment. [Especially in the way he would like — to penalize political speech and writing, even if false — so long as there is a good faith basis to believe it is true]. Though none of the complained-about reporting has been untrue, in any material way — just to be clear.

So… I guess he thinks he can push through this change at three-quarters of the state houses, and both US Congressional chambers with the requisite super majority there as well, all in order to assuage his delicate and bruised feelings.

Hmmm. I think he’s getting decidedly tired… of “winning“, don’t you?

[U] Is He Tired Of LOSING, Yet?

UPDATED: 03.24.2017 @ 3 PM EDT — just as I repeatedly said, OrangeCare is DOA. Even though the GOP clearly controls both chambers, and the Oval Office, they couldn’t even get it to the starting line — let alone finish it. And whether I disagree with its goals or not is of no moment, at the moment. What it points up, clearly, is that Mr. Trump has no ability to parse details, in anyone’s positions.

In short, 45 is manifestly unfit to govern, since he doesn’t even understand (or care to discern) which ones might be the right questions to ask. Mr. Ryan bears responsibility here too — but it is hilarious that Mr. Trump is trying to blame Democrats for the defeat of his ill-starred OrangeCare lunacy.

He won in a sweep, in November — and as the ides of March arrive — he cannot even get his own party to agree… on what they ran on. Hilarious — but this has nothing to do with Democrats, or even to do with ObamaCare. . . it is an epic internal failure of the GOP. Moving on, then — getting out, for a long garden lunch, on a flawless 80 degree Friday. . . . yep. I’m out. Be excellent to someone who may not. . . deserve it.

[I might look for a renewed effort in 2018, after the mid-terms. End, updated portion.]

Whopperline-White-House-Truth-2016This is what happens when we choose to elect an egotistical, blithering idiot — as President. One with zero ability or experience in governing, rather than dictating — that is… in compromise.

It doesn’t help that most of the Congressional GOP-ers ran on a series of central promises about which they told… lies. [Graphic at right obviously… refers… to a prior administration.

LATER UPDATE: Nate Silver concurs with me, adopting my surmise.]  Between 45, Speaker Ryan, and Cruz, Lee and Rubio — not to mention several dozen others, none of them even bothered to tell remotely similar lies.

So now each faction has made solid but conflicting campaign promises — and will be dumped at the mid-terms in 2018 — if they fail to deliver. But what one promised would be done, the other promised would NOT be done. Charming.

So, Tuesday’s initial House vote slipped to Wednesday. Then the vote slipped to Thursday. Now it is unlikely before next week Tuesday, at the earliest. And Mr. Trump is at least 12 and maybe 33 votes short of the needed number in the House alone.

Whopperine-Trump-Loser-2016And each time he picks up one House vote, by “bargaining” — he loses a few more, who made the opposite promise.

And none of it will be “centrist” enough to clear the Senate. You heard it here first, weeks ago. This whole package is DOA.

DOA because Mr. Trump is manifestly not interested in governing — by compromise. So — a prediction — nothing will happen on health care — until after the 2018 mid-terms — nothing that will become enforceable law.

Word. And central promises… BROKEN. On the GOP side.

[U] It Would Seem That Mr. Hinderaker Did NOT Take First Amendment Law, In Law School…

UntitledUPDATE: 03.16.17 @ 8 AM EDT: The able federal District Court Judge Theodore Chuang, in Maryland, has also enjoined Muslim Ban 2.0 overnight (a 43 page opinion PDF).

From another outlet of mine — here is what happened to Mr. Hinderaker’s supposedly “bullet-proof” Muslim Ban 2.0: Today, I live blogged it being… enjoined, nationwide.

This happened in Hawaii, throughout the latter part of the day.  Not so bullet-proof, eh, John? Just as we said, a week ago…

UPDATED: 6:30 PM EDT — Judge Watson just enjoined Muslim Ban 2.0, nationwide. Let the DoJ appeal — I don’t care. WILL issue a ruling, before 6 PM Hawaii time — or about four hours from now.

I will go out on a smallish limb, and indicate (guess, really) that he will enter a TRO against Muslim Ban 2.0 — nationwide. You read it here first. Here is Judge Watson’s very cogent 43 page opinion. [END, UPDATED PORTION.]

. . .And, as we wait for the Sun to set, here in Chicago — and the start of the TRO hearing in Honolulu, Hawaii at 9:30 AM island time. . .

We will note that a federal District Court in Maryland held a motion hearing on a TRO request, against Muslim Ban 2.0 this morning — but likely won’t rule before midnight tonight, Eastern.

. . . .Hawaii’s State Attorney General, Douglas Chin, flashed a casual DLDL (or down low) “shaka” — or “all good” — island hand sign, as he entered the federal District courthouse in Honolulu a few moments ago. . . .

The hearing is now underway. . . . and though it’s not clear when the able Judge Watson will rule on the state’s request for a temporary restraining order, he might rule immediately from the bench — at the end of the hearing. . . .

Preeminent attorneys from the Washington, D.C. office of Hogan Lovells — acting “on brief” as special counsel to Hawaii — are on the phone conference line, as is the US DoJ (for the Trump Administration). . . .

Fourteen state attorneys general and 58 technology companies have also filed amicus briefs supporting Hawaii’s challenge. The attorneys general argue that the revised ban retains the unconstitutional components of the original order, including a broad ban on entry by nationals from six predominantly Muslim countries and a suspension of the refugee program. . . . the 1965 amendments to the federal INA prohibit barring entry on the basis of race, religion or nationality. . . . and our First Amendment prohibits religious tests, even more broadly.

Do look in here — for updates. . . . they will appear from time to time now, until late this evening. . . .

So, all eyes are on Hawaii, and the able Judge Watson, now. [Of course, there will eventually be appeals on all sides, either way. And those appeals will go. . . that’s right — to the Ninth Circuit, just as Ban 1.0, did a month ago. And you know what I bet will happen there. Smile.]
