Unbelievable. John Cannot/ Will Not… Capably Read A Clear Sentence’s Structure.

This is a new low: I gather from his, Hinderaker believes if a pregnant woman from China kills someone while visiting the US… she would not be “subject to US jurisdiction” — that is, could not be arrested and tried here.

In order to believe that the Fourteenth Amendment doesn’t create birthright citizenship… that is what he has to espouse.

Rubbish. The Amendment does create citizenship at birth.

His contrary lunacy… of tonight, is just that: lunacy — of an aging, sadly addled mind.

A mind that wants people to “get off his lawn“.

Funny thing: it was never “his” lawn, in the first place. He just wishes — like his boy, Trump — that he could prohibit the various things he doesn’t like. Things ordered liberty guarantees.

That is… the Constitution expressly protects… those same ideas and values.

So his rant is (as ever)… an impotent set of largely incoherent ravings. The amendment means that people present in the US at birth are subject to the US law, and that they may in turn choose citizenship here — of right, if born here.

It is simple grammar — well drafted — and crystal clear.

John’s nonsense won’t change it — and the Supremes will never hold his tortured fantasy readings… to be good law.

Here endeth the lesson.

Hinderaker Hates Romney Because Romney Wants… Evidence…

John has his crazy pants all knotted up — once again tonight, thus:

“…Four Republicans need to betray the President, their party and the American people to allow the impeachment farce to continue…. [John still thinks] it is too close to call. What infuriates me is Mitt Romney’s attitude:

“I think it’s important to hear from Mr. Bolton,” Sen. Mitt Romney (R-Utah) told reporters Wednesday.…”

That’s just loony. Heaven forbid the Senate act as a body distinct from the crook at 1600 Penn, John. [We aren’t in Putin’s Russia — yet.]

Hilariously… sad. John is now a pure ditto head, for whatever Trump tells him to say, and think.

Just a day ago, Steve Hayward offered some faint defense of his former office-mate, and long time friend — John Bolton — as an ambitious but solid thinking conservative. Now the PowerLine boys will solely wear knee pads for Trump.

Hayward and Hinderaker should accept the truth of Bolton’s account — not try to bury it, along with all the other evidence the GOP and Trump ardently, and in most cases, unlawfully prevented from reaching the US House Committee’s investigation.

But… finding a patriot — in today’s GOP is like looking for a Mao-ist in today’s Communist Party in China.

Onward — just the same. Let’s see what Friday brings.

Steve HEyWEIRD… Gets EVERYTHING Dead Wrong — About Prof. Anastaplo [Including… His Surname.]

powerline-loyola-george-obit I don’t often mention any of the other delusionary writers at Powerline, not because they aren’t worthy of debunking — but precisely because debunking all of their collected nonsense [often hateful nonsense, in truth]… would consume the bulk of any competent lawyer’s day — every day.

And so I generally “leave them be.”

But this one, I must counter for the record. Tonight, Steve purports to offer a recounting of Prof. Anastaplo’s life and work. Specifically, he quotes some of his earliest writing on the Nixon impeachment’s earliest stages. [In doing so, he completely ignores all of the professor’s later (post-1973-era) writings and speeches on that impeachment. That is dishonest enough, to merit mention, but there is more. So much more.]

As a young lawyer, I had the privilege of knowing the professor, personally — and in several professional capacities [that will remain unspoken, since death has… closed his mouth]. Steve even mis-spells his name. Disgusting.

Suffice it to say that Steve HEyWEIRD’s shameless — and incorrect as a matter of law, and fact — appropriating just one of his writings, in isolation — while ignoring all others — is meant to offer a foolish bolstering of Trump’s chances… and is… well, reprehensible.

Not terribly surprisingly, Steve also gets the central historical facts — about the professor wrong. He was never “disbarred.” He was refused a license in the first instance, for failure to sign a what amounted to an unconstitutional loyalty oath.

Whopper-Obama-NFW In the slowly meandering river that is the fuller passage of time, the Illinois lawyers’ regulatory world cleared up the lawless affront to his person, and reputation — and then, long after the death of Joseph McCarthy, himself — granted him a law license with accolades, too numerous to recount here, to boot. [In fact, George privately declined the license when it was (much later) first offered by Illinois, in order to impress upon that later sitting Illinois Supreme Court… the error its prior members had committed. In sum, Hugo Black was right about George.]

I heard George lecture many times in public — and none of what Steve wrote rings true.

In addition, and more directly, I sat in his small cubby of an office at Loyola, and over stacks of his notes — discussed with him many of the ideas that animated his views of Con. Law — over slowly cooling coffees, in old, chipped ceramic mugs… in the middle of many a gray wintery afternoon, on Chicago’s near north Gold Coast — ones not unlike those I just walked from the train, out into… tonight… thinking of him.

whopper-weird So yes, Steve is… here, a charlatan… plain and simple. That’s as charitable as I can possibly be,  as angry as I am, here tonight. George was a great man, a man of principles, and ideas… and a friend.

Steve has gravely insulted my long dead friend’s reputation — in essentially the mirror image of the way the Illinois Supreme Court insulted him, by first refusing him a license… about  70 years ago now. [And, as originally posted — Hayward had mis-spelled his name as “Anastapilo” (now corrected overnight). Par — for his sloppy, lazy course. Thus my turnabout with his sur-name. Childish? Perhaps — but deservedly so, in my humble estimation.]

Steve should apologize. But — like John — he never will. His vain pride won’t allow for that.

Hinderaker Decries Democrats Of A Century-And-A-Half Past…

Whopperline-John-Cole-Cartoon-Trump-2016John’s New Year’s fare… is to complain yet again about events from 157 years ago. [Yes Lincoln was a light of the then young Republican Party. Since then, the parties’ roles have reversed — certainly post- the Goldwater early 1960s “southern strategy”.]

But even so, Mr. Hinderaker would ignore his own party’s — and president’s — crimes, ongoing, as of this morning.

The older Hinderaker gets, the more it brings out more of the… John in him. He’s an embittered, sadly shrinking old man — increasingly isolated from modern (forward facing) schools of thought.

Whopper-Stars-Bars-Hind-2015 So he needs to [again!] revisit his largely imagined wounds [at the hands of avowed, but long repudiated racists of 157 years ago — not any official party now in existence] — ones not even his great grandfather ever actually endured.

My children’s great-great grand-mother, and -father, on the other hand endured slavery in America. So John ought to… just. shut. up.

Why-Oh-Why… Is John So Panic-Stricken, About Admitting Our True(er)… Past?

Whopper-Hinderaker-Land-of-indigenous-Peoples A friend of Hinderaker’s apparently recently saw a holiday performance of Dickens’ A Christmas Carol* at the Guthrie.

In the program notes, the Center acknowledges the truth of the actual title chain for much of what we now call America. The Guthrie… in sum, tells a truth:

People arriving from Europe, in the main, simply took the land they crossed. In most cases, hideously paltry sums were only belatedly “exchanged” — for these takings. [This is true of essentially all the land and waterways Minneapolis now sits upon.]

As a lawyer, John should at least be willing to admit that this was addressable, lamentable error, under all then-known Anglo-Saxon law. [Dickens would have admitted as much.]

A capacity for genuine, humble self-reflection, and accepting and reconciling with the responsibilities, for the darker parts of our nation’s rise — is part of the social gospel John hears on many a Sunday.

Whopper-Matthew25-300x276 But as we’ve long noted, John reads most of Christ’s social gospels out of his New Testament.

And that’s a shame, for it writes him down, from his own hand, no less — as a small, embittered old man. Perhaps that is, in the end, all he… is. I would hope not, but after nearly two decades of watching now, I see scant evidence to contradict that assessment.

Saying one is sorry is a virtue, not a vice, John. It seems here is what he fears most, I guess:

“…You may wonder, what is the point? What are the activists after? They want to recast American history — your history and mine, not theirs — as evil. They want to bend the rest of us to their will, by imposing “land acknowledgements” and renaming sites and buildings.

untitledAnd, of course, as with all political activism of this sort, the day will come when money is expected to change hands….”

So… [aside from boastfully claiming a history he did not author alone — to the exclusion of others], that’s the nut of it: he’s afraid of having to pay… for what we as a people… outright stole. And he is congenitally incapable of admitting his… errors. [But to be clear, no one has asked him to pay.]

A lethal combination — to be certain: his sub-conscious guilt [one he hides from his own conscious mind, no less] — married to his… entitled sense… of self.

Onward.

~~~~~~~~~~~~~~~~~~~~~~~
  • This entire post by Hinderaker is ironic, indeed — as Dickens wrote the “Carol“… as at least one Christian’s apology of sorts, for the mean-spirited, rapacious and property-grabbing, money-grubbing capitalism… he saw as then-ascendant in old England. Irony. A Christmas Past gift, entirely lost — on Mr. Hinderaker.
John — In An Effort To Replace Lost Ad Revenue…
Whopper-12-26-Umoja-Mocked-19 …is holding another of his “VIP events” — for PowerLine. [Yep — the revenue pinch, from being listed as a white supremacy / hate site at the SPLC is… real.]
The VIP idea apparently — is that people pay $48 a year to read his drivel. Uh-huh.
The additional, bonus level idea… is that he’ll do one on the afternoon immediately after Christmas.
December 26.
Tonight he promoted it by saying derisively that they would use the event to celebrate Kwanzaa, since it is being held on the 26th.
I will just mark it here, for the record — as additional evidence of his… racism. It is a certainty that he [and Ammogrrl, whomever that is!] will use the occasion to unsult others’ genuinely held beliefs — all as he proclaims small “c” christianity over all other traditions.
He is… an avowed racist. Out.
[U] I’ll Probably Regret This… But Let’s Take This Hinderaker Post… Seriously.
Whopperline-No-Answer-Lone-TerroristUPDATED — 12.11.2019 @ 4 PM EST: It is my decidedly sad duty to report… more empirical evidence that John is wrong, here [below]. Just this afternoon, we’ve seen an “armed man” immediately detained on a Corpus Christi, Texas Naval airbase. And… he was, of course, immediately spotted BECAUSE… he was armed. Thus Mr. Hinderaker’s views below could not be more completely refuted — but it is sad that these events have become so commonplace, as to be largely unremarkable. End, update.
Overnight, John Hinderaker offers a post in which he [as ever, without any evidence] opines that fewer lives would have been lost in Pensacola [the most recent US Navy base shooting], had all cadets, midshipmen and officers — all persons on the base for that matter — been allowed to carry guns.
I can see how he might [ever childishly] think that.
Let us assume he really doesn’t get the policy idea here. Let us educate him.
US Navy bases are “no gun zones“.  That way, anyone running with a gun on the base is a KNOWN threat — not a friendly.
Now… consider the opposite state of affairs: everyone carrying guns. And, at least somewhat likely — a random fight over say the last chicken wing — in the canteen… is suddenly probably… lethal.
That said, I can see a case for only allowing MPs to carry on base, and then response to a known threat like the one we just saw might be marginally faster. Only marginally, though. The idea that stopping a lone terrorist is a more likely with LOTS of guns, a pre numerical quota — and not a focus on Navy policies to prevent loss of life [far more likely and common] from hot-headed young men in bunk fights/shootings… is silly, in a word.
Whopper-Obama-NFW This particular Naval Airbase is located in Pensacola, solely at the invitation of the people of Florida, and all other bases are at the invitation of the people of the US — please read Amendment Two [no forced quarter of troops, etc.]. These fine people long ago set that in motion; and set the rules of engagement.
As such, more generally, we civilians decide where bases are — and how much potential mayhem/lethal firepower  we want in our own backyards [collectively]. Florida long ago decided that having a few thousand super-testosterone infused midshipmen/air jockeys between the ages of say 18 and 28 — while needed for national defense, when on the high seas — should/would not be barracks full of armed men, on hair triggers, 24/7.
No — with arms safely locked away, fistfights and perhaps a stabbing or two would be about all the on-base mayhem we’d tolerate.
More fundamentally, nothing changes, if a terrorist decides to come on base with automatic weapons. Nothing the Navy men and women would do would much change the outcome — cogent research shows… where some terrorist is willing to sacrifice his life, to end the lives of at least a few others, including well-trained military officers, there is going to be some loss of life, regardless.
Whopper-Gun-2012-300x192 It should be noted that this particular terrorist, under Florida’s insanely liberal gun laws, had lawfully obtained his weapons. Let that sink in. He initially violated the law, solely by violating the federal law preventing guns inside the base facility.
In sum — adding more guns inside a base, a school or a factory… will not change the outcome appreciably.
Here endeth the lesson, for childish John’s testosterone.
John Apparently Didn’t See Paul M.’s Multiple Memos…
Whopper-Paul-M-Ukraine-Truth Okay — tonight, Mr. Hinderaker preposterously opines — in yet another foray into moral relativism — that no president ought to be impeached when the stock market is… rising.
I guess I missed that part — in the Jefferson / Franklin / Hamilton / Washington and Madison-authored national founding documents.  But no matter, John’s opinion has been succinctly put, thus — from his own keyboard:
“…The Democrats insist that President Trump is a threat to the republic, although no one can explain why….”
Mr. Hinderaker, please do now meet Mr. Paul Mirengoff — he is your fellow blogger, of now nearly two solid decades, day in and day out. Hmm. Kinda’ surprised you didn’t bump into him at the communal Powerline coffee pot, at some point.
Whopper-2020-Ramirez-Satire-2019 In any event, here is his opinion — from just two scant weeks ago:
“…Documents and testimony leave little doubt that Trump did in fact withhold aid for the purpose of getting Ukraine to investigate his chief political rival. The aid eventually was released, after news of the hold became public and people started asking questions. However, this doesn’t negate (though it might mitigate) the fact that Trump tried to use military aid as a lever to cause harm to a domestic opponent….”
This. Is. Unlawful. 2 U.S.C. § 682, et seq., the Impoundment Control Act — signed into law, post Nixon and Watergate, prevents him from doing so, as a high crime and misdemeanor.
Hey Paul — please do go have a heart to heart with John. Please explain to him that… “Трамп закручений.”
Thanks.
