John Knows The Heart Of THIS White Minneapolis Officer — One He’s Never… Met?!

Once again, John — with the “Faux Psi” powers — for the… epically illogical fail.

[Colin took a knee… and John full well knew why. But Hinderaker lied repeatedly saying Colin disrespected the flag and soldiers — no, he mourned dead black and brown humans, put to death in the streets — by police.]

This time ‘round, in the police sanctioned murder of George Floyd, Hinderaker’s pronouncement — that it was not racial, in the least — is directly contradicted by all the video evidence.

Even so, he tells us the white officer was not being a racist. [Ahem — okay. I’ll wait… while John documents (as the only possibly cogent evidence) the dozens of other WHITE alleged counterfeit bill passers… this monster has choked to death, with a knee hold. How many, John? Nine? 11 others? Any Asian Americans he’s killed by choking? No?! Hmmm… I’m… shocked. But of course it’s not race John. End, sarcasm.]

John Hinderaker writes, tonight:

“…The issue isn’t actually one of race. The last Minneapolis Police Department killing that made international news was the shooting of Justine Damond (white) by Mohamed Noor (African-American) for no apparent reason. The MPD has long been troubled, and its current Chief is African-American. The issue isn’t racism, it is incompetence….”

So — because an “entirely different Somali American officer killed a white person with a gun, over a year and a half ago…” Wait… What?!

I don’t need to go on. Hinderaker (if he even believes this tub of crap he wrote)… has full on… dementia.

Dementia. It’s an ugly disease, that’s the most-likely explanation for this former trial lawyer’s… loss, of his now tiny, addled and angrily hate-filled mind.

Out.

[U — Tuesday, Noon] Because It Is ALREADY Immensely Clear That Trump Cannot Win In November…

The rabid former Tea Party idiots, and more lately, Trumper MAGAts… have begun to cannibalize each other. Trump Vs. Coulter Vs. Sessions. Sweet!

Paul M. says tonight he “wishes Twitter didn’t exist / was never invented.”

I say… “live by the sword… die by… the same….”

Updated Tuesday 5.26.2020 @ Noon: It seems John too — right on cue! — wishes Trump would stop tweeting conspiracies about the non-involvement, in the non-murder, of non-public office holding minor media figures, against whom Trump holds… long standing grudges (for having the temerity to tell the truth, about Trump).

Sweet irony, that — given Trump’s addiction to it.

In Which John Claims “Psi Powers”…

One of the surest signs of a diseased mind… is the claimed ability to instantly — and unerringly, know why someone does a thing — or does not do a thing.

This evening, John “goes there.” He claims to be able to read the minds of all people donning masks.

John says… this:

“…Those who fear COVID-19, or who want to make the point that the virus is the great issue of our lifetimes, or who want to show support for high-handed politicians who have issued shutdown orders that may or may not be legal, wear masks….”

Me? I wear a mask because… I trust actual biological / epidemiological science… over… a certain moron’s… blatherings.

But John didn’t read my mind on that one. I don’t fear the virus — because I know how to protect myself. And I believe in being considerate of other people’s needs. John does not. Just read his “I need a haircut” post.

Out.

The “Watergate Prosecutors” As Amici, Weigh In — Against Barr, And Judge Rao, In The DC Circuit…

The storied amici have… arrived, in the DC Court of Appeals. Quite an entrance — one befitting such protagonists, in at least one shining moment, in our nation’s history, related to curbing the abuses — of Executive Branch powers — by then-sitting presidents. [This is actually on topic here, since John regularly argues, through counsel, that Minnesota state level prosecutors abuse… their estimable discretion.]

I’ll get right to it, then — but USDC DC Judge Emmet Sullivan is likely to adopt much of this — in his own reply (now due in eight days) to the panel, at the Appeals Court (including Judge Rao). Here’s a bit, but do go read all 26 pages:

…[G]ranting [without judicial review, as here] a post-plea Rule 48(a) motion [as Barr attempts here] threatens several core Article III values. When a court accepts a guilty plea, it “exercises its coercive power by entering a judgment of conviction.” Fokker Servs., 818 F.3d at 746. Article III courts have a strong interest in the “conservation of judicial resources and [the] finality of judicial decisions.” Garris v. Lindsay, 794 F.2d 722, 726 (D.C. Cir. 1986) (per curiam). That concern with finality “has special force with respect to convictions based on guilty pleas,” United States v. Timmreck, 441 U.S. 780, 784 (1979), which courts accept only with “care and discernment,” Brady v. United States, 397 U.S. 742, 748 (1970), and “the utmost solicitude of which courts are capable,” Boykin, 395 U.S. at 243-44.

In addition, Article III courts have a strong interest in “protect[ing] . . . the sentencing authority reserved to the judge.” Ammidown, 497 F.2d at 622; see United States v. Brayboy, 806 F. Supp. 1576, 1580 (S.D. Fla. 1992) (holding that it would raise a separation-of-powers problem if the Executive could use Rule 48(a) to “eliminate [a] [c]ourt’s authority to sentence, or if a sentence has been imposed, to set aside that result”)….

[Footnote:] Despite his extensive reliance on that case for its Rule 48(a) standard (see Pet. 9-11, 17-21), Flynn nowhere mentions that Fokker concerned a hypothetical pre-conviction motion to dismiss charges that were still “pending.” Fokker Servs., 818 F.3d at 742….

District courts must, therefore, have substantial discretion in ruling on Rule 48(a) motions filed after the court has accepted a guilty plea. The casual vacatur of guilty pleas “debases the judicial proceeding at which a defendant pleads and the court accepts his plea.” United States v. Hyde, 520 U.S. 670, 676 (1997). For that reason, a defendant’s motion to withdraw a guilty plea is committed to “the [trial] court’s discretion.” United States v. Thomas, 541 F. Supp. 2d 18, 23 (D.D.C. 2008). That discretion is substantial, and “a defendant who fails to show some error under Rule 11 has to shoulder an extremely heavy burden” to show it has been abused. United States v. Leyva, 916 F.3d 14, 22 (D.C. Cir. 2019)….

Now you know. They are… spot on, here. And we will remain convinced that calmer heads will prevail here, in the end.

Who’da… Thunk It?! John — Directing Baseless “SLAP” Suits? I’m Shocked… [Not.]

For the at least the past seven days and nights, John has been dropping hints about “serious lawyers” taking on “serious cases” — to oppose COVID-19 containment measures, in Minnesota.

Except… that this is pretty much the opposite of… serious.

This is (in my experienced opinion) pure “publicity-hound” clap-trap stuff — SLAP-style suits brought primarily to harass public officials trying their level best to minimize a global pandemic.

His mother must be proud.

Just look at any of my last five posts — they link to excrement he wrote, threatening suits. Now he is suddenly a voting board of directors member of the non-sense imaged at above, right.

Gee… Who’da guessed?!

Right. I did.

These suits will be… dismissed. They run directly counter to the Governor’s near plenary police powers — in a pandemic.

Perhaps most importantly, there is no allegation that any one religious (or non-religious) group is being favored, or harmed — they apply without fear or favor, to all.

All just for show folks — to divide, and create chaos… since that is the only remaining chess piece… the Trumpian GOP has left, on the board.

I’ll just… laugh at him — and them.

Out.

Gosh, But Isn’t John… Silly? Indeed, He Is…

Tonight, I am put in mind of the famous scene from “The Princess Bride” — at right. [Rather than accept the plain English meaning of a memo, long ago reviewed by dozens of courts and judges, and found… free from taint — John imagines yet another windmill, to tilt at, Quixote-like, in his “what about Obama?” quest. It is sad, really. He ignores Trump’s daily insanity — to cry about stuff from now almost four years ago… that never happened — not in the way he imagined.]

Here, at right, Mandy is clearly smarter than he lets on. John clearly has been… out-smarted.

The paragraph John quotes (in what he hopes vainly is a damning new revelation) serves then National Security Adviser [to then-President Obama] Rice quite well, here:

“…Director Comey affirmed that he is processing “by the book” as it relates to law enforcement. From a national security perspective, Comey said he does have some concerns that incoming NSA Flynn is speaking frequently with Russian ambassador Kislyak. Comey said that could be an issue as it relates to sharing sensitive information. President Obama asked if Comey was saying that the NSC should not pass sensitive information related to Russia to Flynn. Comey replied “potentially.” He added that he has no indication that Flynn has passed classified information to Kislyak, but he noted that “the level of communication is unusual….”

Nat. Sec. Adv. Rice was on the up and up — running a normal, vitally patriotic operation. The above just-declassified paragraph proves it. Clearly, Flynn was (and is) a bad apple.

He plainly lied to VP Pence in the first days of Trump’s Administration — and Trump said so on videotape, himself — as did Pence, when both of them fired him. He had already lied to the FBI — and that’s what this is about. Oh and he pled guilty twice in open court, on the record, before Judge Sullivan, for those lies.

But silly John (forgets all that videotape and court transcript material) to…. create a vast nefarious conspiracy, from whole cloth, to trap Trump… into something (of course never defined)… here.

Mr. Hinderaker apparently doesn’t know what “by the book” means.

John… is a blowhard — and a moron. But you knew that already, from reading any one of hundreds of entries here.

Onward.

Fifty Years Ago, The Kingston Trio Had Nailed John’s Fecklessness — To A Tee.

I’ll avoid wasting too many electrons on Mr. Hinderaker’s latest bleatings — about his right to… eat carry out. Here his from tonight is, in context:

“…I think the order served on Schiffler today was invalid because of Ellison’s overreaching.

I don’t want to give away any secrets, but I have a sneaking suspicion that Kris Schiffler will soon obtain capable legal counsel, and will be heard from in a legal forum before long.

The real news here is that normal Americans are beginning to rebel against the pointless, destructive and probably unconstitutional dictates of their liberal masters. Not surprisingly, that revolt is occurring mostly in the country’s more rural precincts….”

Yes, the lady doth protest too greatly. Or, in the words of the immortal Kingston Trio protest song — “Texas needs rain“:

Hinderaker: “No Basis”?! Moron. [This Is Another, In His “Toweringly-Stupid” Near Daily Rants]

John just loves to cherry-pick outlier data — in this case, very sparsely populated rural states (which tend to have GOP governors), and contrast them with denser, more urban ones (which tend to have Democratic governors).

He also loves to treat correlation as… causation. That’s one of the oldest “third grade level” science errors.

This morning he commits… both errors — and combine them, in one sentence.

“…The bottom line, in any event, is that there is no basis for concluding that the nature and extent of the shutdown orders in these states have had any impact on the states’ COVID fatality rates….”

Maybe he should look at Italy. Look alternatively at Spain. Or… look at… Sweden.

Geo-political economies late to issue [or never issued] stay at home proclamations. Deaths… then soared.

BTW, where is his data for the prior claim that the economies, in “no-shutdown states” — or in Sweden (no shelter in place orders), for that matter are still… “flourishing“? That is one really stupid lie. It is obvious the recession/depression is hitting everywhere in the US. Over 32 million are now… jobless, as of only last Thursday.

John…? Hinderaker… Bueller…? Ferris…?

Crickets. [And by June 1, we will have over 100,000 deaths in the US — more than double John’s original “expert” conjecture, for the entire pandemic. We are at least nine months away from a vaccine; more deaths ahead, even with Moderna’s great news, this morning.]

We need to be realistic — and steeled, for a tough summer and fall.

John… is of no help, to anyone — John is a feckless… and dishonest… moron.

See below — and, like John’s rant: “Texas needs rain….” Out.

Where Is John’s Similarly… “Abject” Apology? He’s ALREADY Dead Wrong, On COVID-19’s Severity.

As well-documented here, in near real time, too — Mr. Hinderaker repeatedly said this would not be as bad as the ’17-’18 seasonal flu. Wrong. Then he said it would be like the ’67-’68 one. Wrong… again.

As we approach a likely 100,000 US deaths by June 1 — and still accelerating, in many areas… John is left to argue (again, falsely, despite Sec. Azar’s agit-prop this morning) that no spike is being seen in states that have reopened.

Look at Texas this evening — or Georgia, you moron. And we are likely six months away from a real decline — and maybe twelve months away from a widely-available vaccine, best case. The final pre-vaccine total for 2020 — in the US is now very likely to be over 200,000 people. Tool.

But even if we buy his latest clearly-false happy-talk — he (again as I repeatedly predicted, in March) hasn’t apologized for saying that this would all top at out well-below 60,000 deaths.

At the time, I wrote that he owed us all an apology, for every death in excess of 60,000. By a week from Monday… that will be 40,000 excess deaths by June 1 — minimum, and over 70 per cent beyond John’s glibly clueless poo-pooing.

Where is his abject apology? Crickets… here’s the quote, from tonight:

“…[M]aybe it will just take a few more weeks for the anticipated “spike” to show itself. That’s my guess. But if that doesn’t happen, those who have abused their positions by imposing devastating shutdowns will owe the rest of us an abject apology….”

Owe you?! Owe… YOU? What a delusional, life-devaluing, capitalist tool of a propagandist… he is.

When this is over… it is likely no one of any real moment will want to listen to his voice, on any serious topic — as he has now shown that he is no longer… a serious adult.

And that it seems, is his deepest-seated fear — with all his revisionist back-pedalling.

Sad. Sad little old man.

John Needs… A Haircut. Is This… Satire?

It is trivial, but he falsely claims this is a “class divide“.

But he is bleating about how put upon he is, that he must wait until June 3, 2020 in Minnesota to get a “legal haircut“. Clutch my pearls, indeed.

But people on the Tee-Vee (he sez) are getting haircuts, he “knows it” — again… he sez.

How tragic. How… utterly unfair… to John’s mediocre sense of white entitlement. [/snark.]

I take it he’s afraid of handing his wife, or his… offspring sharp objects, within a foot of his… neck.

The whole premise is… preposterous.

But this is what passes… for importance, in John’s endless outrage machine.

Never mind that people are dying — all alone, in ICUs, all over the place. He’s a little fuzzy, around the ears. We cannot let this… persist. No.

Yes, this exposes a class divide — but not the one… Hinderaker imagines.

See below — and, like John’s rant: “Texas needs rain….” Out.
