NLRB Receives A Charge In Cleveland Metro, This Time, Alleging Amazon Fired An Employee For Unionizing Activities…

The win on Staten Island certainly looks to have marked a modern-day sea-change, in the history of US union activity.

We learn this morning that unionizing activities are underway at even more facilities around the company’s network of warehouse hubs (but not yet known is the name of the organizing entity / individual(s)). [So, in theory it could be a single disgruntled now ex-employee. But that seems highly unlikely.]

By my count, this marks six separate locations in the process of either starting a recognition campaign, voting on, or appealing an election outcome — each with a charge of unfair tactics. I would expect answers in the Alabama appeal to the NLRB, shortly (at least nominally, an initial loss for the unions — but now under review for unfair labor tactics, by Amazon management, there). Here is the latest, from the local papers — with “the new face of labor” (depicted at right) set to speak there in just about a week and a half:

…According to the charge, Amazon was aware of unionization efforts the employee was part of at the facility. The employee was then fired for a security infraction. The employee was also not allowed to use Amazon’s in-house appeal process, according to the filing.

The complaint filed with the NLRB said the security infraction — or “alleged incident” — did not happen, and that the employee was actually fired because of their support for the union, and to further discourage unionization at the facility….

Chris Smalls, leader of the Amazon Labor Union, was already scheduled to visit Cleveland June 8. He’ll be a special guest at an event at the Building Laborers Local 310.

O’Malley said the entire labor movement stands ready to fight alongside the unionizing Amazon workers.

The 885,000-square-foot fulfillment center opened in North Randall in September 2018 on the site of the old Randall Park mall. It’s one of several fulfillment centers now in Northeast Ohio….

Look, I understand that sometimes in middle management at a big company, it is “hard to see the forest — for the trees“. But what Amazon seems to have forgotten (as alleged, with a series of now six fundamental labor rights violations, across multiple facilities), is that the NLRB may soon simply label the company a “pattern violator” of § 8(a)(5) — and under the Act (as it last did in the late-1940s), impose a nationwide bargaining order, under the Supremes’ Gissel precedents. That would mean that any Amazon employee, nationwide, could simply raise his or her hand, and say they wanted to join, at Staten Island — and Amazon would be ordred to negotiate a nationwide contract for all.

In turn, that contract would start by being set at the very high wage rates prevailing in the NYC metro area. The middle managers at Amazon should read up on the history of the coal miners, steel workers and garment workers of the early half of the 20th Century, and the air-traffic controllers (for a contra example) — as well. Bezos completely mis-apprehends the power of the federal government to order him to either (i) bargain with these honest, hard working but clearly disaffected workers (all at once) — or effectively, (ii) close shop in the USA.

Onward, smiling — with a sunny cool Spring Sunday on tap… and the park — with baby girrrrls, due over in a bit! Yep….

I’ll Do a Two-‘Fer, On Hinderaker’s Sad Lunacy, Tonight… [He Doesn’t Think Coerced Sex (At Work) Is Any Issue…]

First (in full-on-senility mode!?), he waxes nostalgic for a return to the time when older slump-shouldered whyte male professors (wishful, much, John?!) could seduce, and sleep with younger lab underlings with complete impunity — in what he calls the “Playboy Philosophy.” It was often normal, and never frowned upon, for such professors to fire the underling and threaten the underlings’ careers in science — when the doddering old fool tired of the effectively forced sexual contacts.

Charming — I need not (and will not) say… another word, about that — his position is… well, self-refuting.

And, at least three whiskeys in, on this Saturday night — he tells us that a lower level HRC lawyer making one false statement — that the lawyer had no client, is bigger than… Watergate.

Cool story bro — so, of the two, the first is far more serious, as his incessant lies go… as it will condone/support (at least on the far, frothy right!) more of the odious behavior that most of the moral, right-thinking world has firmly declared off-limits.

His second piece on the Durham / Sussmann trial… is in no manner to be taken seriously (we took it apart earlier this week). It evokes only… guffaws, from all people who were “out of diapers” by the time Watergate went down.

So…

Cheers, chucklehead!

Now We Must Endure Hinderaker’s Inability To Do… Math (Again)?!

Well… without a shred of evidence, Hinderaker closes his evening by saying that California Governor Newsom is in large part responsible for the nation-wide inflation of late. Hilarious.

While it is true that California (were it a nation) would be the fifth largest economy in the world, Hinderaker’s nonsense ignores the idiotic (19th Century economic ideas, these!) tariffs Tangerine levied — ostensibly against China (mostly just fully kicking in this year, now), and they, in fact now drive inflation. They inflate the cost of foreign goods, which US consumers must pay — even as Mr. Biden tries to undo them, in steps — so as not to crater any one sector of our economy.

Christ, John — take a basic history of econ. course. This was/is 1890, all over again.

Here’s his stupidly ahistorical dodge (of what he and Trump wrought) in full:

…State spending has played a major role in the current inflationary spiral as the federal government doled out many billions of newly-printed dollars to the states….

Gee John — that’s a special kind of… feckless lying.

But even your pin-headed followers won’t believe that the current nationwide, coast to coast inflation comes from overspending by state governments. That is just… a dumb, dumb lie.

Out.

[Friday Trivia | Musk Tangent:] As A Friend On Twitter So-Cleverly Put It… Now We Learn “Elon Bought ALL The Horses…”

Hinderaker tonight thinks “elongate” is a clever turn of phrase, while disbelieving what he calls a “double-hearsay allegation”, below (he says he has no position, but plainly takes Musk at his less than credible word). But in so doing — he simply ignores any inference from the undisputed fact that Musk paid a flight attendant $250,000 in severance — under confidential terms. And Musk has a documented history ($320 million worth) of losing race and sex discrimination lawsuits. Oh — and union busting, per the NLRB. So — if it comes to the word of someone like Musk, against the documented facts as shown thus far to be uncontroverted… I choose to believe the woman. Now on to my friend’s great riff, on the Musk-man:

This is… flawless.

To be certain, sexual assault is no joking matter, but…

Satire aimed at his… misogyny may be the best approach to dealing with the loathsome cad.

No longer the richest man on the planet.

That’s got to be what hurts him the most — he’s short a few… ponies.

UPDATED, on Friday morning: Musk apparently denies the allegations — however, he long ago tweeted that when a scandal about him worthy enough… appeared… he wanted it to be captioned “Elon-gate” — or elongate, if you prefer. Churlish, that.

However, given the above, it seems destiny is not without a sense of… irony, then.

Hey — maybe he should take some “singles-looking-for-love” advice, from this guy: two days out of federal prison, and into a halfway house in NYC… and he’s already on Bumble… swiping… right (or left). [Or whatever one does, there. Heh.]

Damn. But so, so… on brand.

Out.

Once Again, On Title 42: An Under-Qualified Trump Appointee, In The South/Gulf… Gets The Law… Laughably… Wrong.

We will offer only a relatively few (common sense) words here. And we certainly won’t quote any of his “reasoning” in his 47 pager, here — such as it is.

If this sub-par judge in Louisiana (a 2018 Tangerine appointee) is correct, it would mean that no future President might be able to change policy decisions about the southern border, once adopted by Trump. In fact, it should also mean that Trump’s “Muslim Ban 3.0” must have been unlawful (but it did survive — on only its third try, at the Supremes), since it directly contradicted the prior President Obama administration’s “more welcoming” stance.

No, this guy is simply moving the goal posts, to say he liked Tangerine’s cruelty at the border more than a more humane Biden administration position, there. To be sure, each President must take care to faithfully execute our treaties and Constitutional commands (two bedrock proscriptions as to border policy Tangerine openly flauted) — but other than that, the people did cashier Trump’s policies, at the ballot box in 2020 — and Mr. Biden got the message.

Arguing now, two years later, that the APA as to border decisions required a quasi- “free expression” analysis (found nowhere in the positive law), and a balancing of the interests of… border guards’ preferences over those of the Commander-in-Chief… is non-sense.

Even the conservative Fifth Circuit will say so. This guy is only marginally brighter than Bruce Drew Tipton, in the southern district of Texas. Which is to say… they both are dim bulbs, on the law. And the upper chambers will so hold.

That is all.

Out, into a warm Friday evening, smiling just the same… at my own graphic, here. Grin.

Candace Owens And CPAC Are Out Raising Money… In HUNGARY?! Damn!

Look, I get it: Candace Owens never met a whyte dictator she didn’t like — but ONLY if they paid LOTS and lots… of loot.

In her simple world view, though seven months preggers, it is well worth the risk(s), to take a flight to Budapest, from Nashville — some nine hours, if non-stop; eighteen, if not so… when CPAC knows that she sees Orban as akin to… Putin, and loaded, to boot.

And… there is Hungary’s record of support for whyte supremacy movements… so she’s the perfect “but my [lone] black friend says…” shill.

At bottom, it is never about ideology for these tools.

It is solely about new buckets of cash — after they’ve now completely tapped out the local USA / red-neck masses.

And sanctions have locked out the flows they used to collect from Russian-state-affiliated oligarchs, and perhaps… Putin, hisself.

[Maybe CPAC is now on… fumes?!]

Charming. We may only hope.

Some “Make America Great” mantra that must be… Damn.

More, On Hinderaker’s Endless Hypocrisies…

This morning, I want to return to how utterly silly it is that Hinderaker claims the Durham investigation is in any manner a vindication of Trumpian lunatic conspiracies.

Sussmann is on trial now for a single lie. That lie was NOT about any part of any theory Hinderaker or Trump hold.

The lie was whether he “had a client” when he went to law enforcement (i.e., perhaps had a bias). In fact he was a low level lawyer for the HRC campaign. He said he was there as a mere citizen.

No, he should not have lied (if, in fact he even did — in those circumstances). But to suggest that his lie was material (and thus allows this trial)… is silly. I’ll leave it at that: the FBI conducted dozens of other interviews on these topics, and Mueller’s investigation established the essential truth of the actual “merits statements” made by Sussmann, from many other sources. Thus, that’s a mere “process” crime — to use John’s own ninny-fying turn of phrase.

The only thing Durham has on him, is that Sussmann (in this single instance) did not disclose that he was working for a candidate. Sheesh.

As irony would have it though, Timothy O’Shea is about to go on felony trial in Manhattan next week, for the millions of dollars that were stolen from small donors, nationwide, during the “We Build The Wall” farce. Nope. Not. A. Process. Crime.

Steve Bannon accomplished it, but cannot be tried — after stealing millions… because Trump openly pardoned million dollar thieves — that benefited him, personally. Mr. O’Shea didn’t plead guilty — but all the other, low level people did — and so he will go down for a crime-spree Bannon orchestrated, stealing from charitable donors (no process crime, that)… all while Trump pardoned the master-mind.

Yet not even a peep, from Hinderaker about the mobile, multinational multi-billion dollar crime spree that was the Tangerine stay at 1600 Penn.

How very… droll.

Hinderaker — Isn’t This A Mere Single Count… “Process Crime” — Your Words?!

So — Hinderaker is gloating tonight, even though it took Durham over three years, to come up with one count, of one false statement, by a lower level HRC lawyer, related to the 2016 election. That’s six years ago, now.

Let’s just laugh out loud, at a single false statement being all he could get — after spending more than the entire Mueller investigation. But Muller’s — which yielded dozens of felony convictions, and then multiple Trump pardons — of those same felons… actually found false statements by 1600 Penn.

Look, I don’t love that a minor lawyer for HRC told even a single lie, to the FBI — but this in no manner is comparable to Trump himself being fined over $110,000 at $10,000 a day for openly lying to a New York judge, under oath, about where his cell phones from last year might be. Or, taking top secret documents to Mar-A-Lago for over a year, after he was cashiered, by the people of America in the 2020 cycle.

This is comparing fish to… bicycles, John.

Take your Special Olympics victory lap, now. It is your… special day in the Sun. Maybe that insults people who are differently able, though — so I’ll retract it… and mention that Hinderaker told us the crimes various Trumpers were convicted of (dozens of counts of lying to the DoJ and FBI)… were mere “process crimes”.

So John — you have here a single count of a single process crime, by a low level HRC lawyer. Do compare that — to the multi-count felony (20 plus years!) superseding indictment alleging over $374 million in direct payoffs, to Thomas Barrack, the chief financier of Trump’s 2016 run.

Damn, son. Just… damn.

It Takes Two Days, For Light To Go Round Trip To Where Voyager 1 Is, Now… So “Talking” Is… Slow As Molasses.

Again, Anon. found a great story I’d missed. As Anon. perfectly riffs, the Voyager One craft (middle — lithe lil’ ship, at right) was also the subject of the original Star Trek theater release… and in that telling, the craft’s antenna must be reconnected, by Earthlings, so that a self-aware silicon based computer planet / spaceship (in blue, upper right side)… may touch what it regards as its creator. And thus download all the knowledge it has amassed, wandering the Universe — for hundreds of millennia.

To give the thing a “human element” though, the computer-being had taken the human form of the ever-fetching Persis Khambatta (natch‘, with the shaved head, at right!)… formerly an officer on the Enterprise. And so it is no small irony that it seems the real Voyager One is now — via a “glitch” (or, a computer planet?!) — incorrectly reporting the attitude of its antenna. Perhaps it wants us to come out with a touch-up mission. Smile….

In any event, here is the NASA story — from from Space.com — with a hat tip, to Anon.:

…NASA’s Voyager 1 mission launched in 1977, passed into what scientists call interstellar space in 2012 and just kept going — the spacecraft is now 14.5 billion miles (23.3 billion kilometers) away from Earth. And while Voyager 1 is still operating properly, scientists on the mission recently noticed that it appeared confused about its location in space without going into safe mode or otherwise sounding an alarm.

“A mystery like this is sort of par for the course at this stage of the Voyager mission,” Suzanne Dodd, project manager for Voyager 1 and its twin, Voyager 2, at NASA’s Jet Propulsion Laboratory in California…

One of the first rules of space flight, is… if it is working, but you don’t know why it is working… leave it alone. We shall see if NASA can resist the urge to “correct” what is likely 45 years of interstellar radiation degraded circuits not spitting out accurate ones and zeros. Just let it fly, people — it has long exceeded every mission goal, and any fix… might prematurely end it (just like Decker and I’lya). Grin… what a guilty pleasure of a movie.
