The Supremes Apparently Agree: Texas HB 20 So-Called “Must Carry” (On Social Media) Law… Is Facially Unconstitutional Under The First Amendment.

About 50 to 70 years ago, the three television networks were required by FCC rules to provide “equal time” to opposing views — when an opinion, especially a deeply-political opinion piece, was aired. There were only three ways to reach that vast and immediate audience, with the impact of color television: ABC, NBC and CBS (and in some more urban locales, there was a PBS affiliate that could be received by over the air broadcast). But even those rules, against the big three, were deemed unconstitutional as Ronald Reagan’s trickle-downers took power. They were tossed, as being antithetical to a free and robust market for ideas. It didn’t help that it was the government — in the guise of the FCC — that was acting, to tell private TV carriers what they must broadcast. Conservatives, essentially everywhere, cheered when the must carry and equal time rules were allowed to lapse.

So — it is with palpable irony, now — that a half-century later, the grown children of those Reagan conservatives in Florida and Texas have passed state LAWS that purport to tell entirely private businesses / social media companies [of which there are now nearly as many (deep double digits), nationwide as there were as to TV, at the very beginning of the cable revolution of the early 1980s] which viewpoints they must carry — or at a minimum, they must provide specific federal court-like adjudications, if the platforms decide to remove any content. [Of course, this is really about being free to use hate speech and lies as political agitprop weapons, in what is effectively a private host’s / person’s living room.]

So — last week we mentioned elsewhere that the Eleventh Circuit had correctly blocked the Florida law. This afternoon, the Texas version, called HB 20 — which had already reached Justice Alito. . . was stopped, dead. Even Alito, in his own dissent from this block admitted that the law at least appeared “facially unconstitutional, under the First Amendment” — as a state government’s attempt to regulate private club speech or silence, based on content. And that is where this will end. But for now, the laws in both Texas and Florida are stayed — they cannot be enforced… until the Supremes get to a full-on merits argument / hearing, and decision.

…Applicants are two trade associations that represent major social media platforms covered by the statute. They challenged the constitutionality of HB20 in the United States District Court for the Western District of Texas, contending, among other things, that the law is facially unconstitutional under the First Amendment. The court agreed, and it preliminarily enjoined the Texas attorney general from enforcing the statute….

Onward — but if anyone needs a light-house beacon, to guide them to the conclusion, and determine that the GOP has become the anti-business, and anti-freedom party, this would be it.

Two GOP controlled states, both trying to force private companies to carry hate speech (and to force women to carry to term, even in the case of rape or incest). I did not like Reagan, but he certainly is spinning in his grave, at what these frothy nut-jobs try to call a “conservative” agenda. These are… brown-shirts, not conservatives. Out.

Shut It, Scott & John. Just Shut It.

Stop libeling an innocent man, you moron. Stop it.

You all were positively gleeful when Bill Barr lied about what Mueller’s report actually found.

You all screamed to high heaven when Manafort, Stone and Flynn were all convicted. You cheered when Trump pardoned them.

Just shut up, about Sussmann. Respect the jury’s verdict, chump.

Update: June 1, 2022 — same goes for Hinderaker. He professed great faith in the Supremes turning a blind eye to Tangerine’s Muslim Ban 3.0, but is all butt-sore that Durham came up empty.

That’s a failure of Durham – not the courts. Durham has known for two years there was “no there, there…”

Damn son.

Out.

[U: Told ‘Ya!] When The Sussmann Jury Returns A “Not Proved” Verdict (Against Durham’s “Investigation”) Today Or Later This Week, Thank Me…

…for telling you that it was coming. And it will be… justice.

UPDATED — Jury acquits / finds not proved. Heh. Sit down Durham.

But thank the irrepressible EmptyWheel, for explaining to all of us, why and how that result is the only one consistent with the US justice scheme, and the federal criminal law — which holds a man is presumed innocent, unless shown guilty by much competent evidence.

That Team Durham has wholly-failed to clear that high hurdle, is obvious, given the team’s endlessly improper attempts to admit double hearsay for the truth of the matter mentioned, even after twice being ruled against, and then admonished by the able USDC Judge Cooper.

Crazy — but those straws were all that Durham could find, after spending far more than Mueller, and taking three plus years… to get… nowhere.

Even if Sussmann is convicted on a single count false statement, he is (as EmptyWheel repeatedly showed, at most) a low level former HRC outside lawyer.

Recall that Tangerine hisself is now (after losing three appeals) going to be questioned, under oath, in a deposition — about his real estate loan applications, and his tax returns, in NY State. By the NY State AG.

Steve Hayward Offers A Single 1958 Milton Friedman Letter…

It is often said (by real scientists — i.e., not the Powerline boys!) that “the singular of data… is called… an anecdote.”

And this noontime on Memorial Day 2022, Steve offers one admittedly noble letter, from 1958 (about cancelling some conference hotel reservations to avoid supporting apartheid-era New Orleans!), as if it would refute… nine centuries worth of western economic theories (and practices) built in no small part on forced, unpaid labor from enslaved people.

The idiocy… of Hayward here, is self-mocking.

But, consider, then… a more sober telling:

…The racism we are fighting today was originally conjured to justify working unfree Black people, often until death, to generate extravagant riches for … all the ancillary white people … who earned their living and built their wealth from that free Black labor….

Onward – to a long mountain bike ride by the lake, in cool air — dappled in sunshine.

Sanctions-Evading Crypto Bro 1.0 Virgil Griffith Has Arrived At FCI Allenwood (Low)… He’s There — Until Thanksgiving Weekend… In 2025.

I note the location since that is from whence Martin Shkreli was just released — to a halfway house in Brooklyn, about a week ago. [Though it seems Martin may be headed back up there — if he cannot get a real W-2 job in a few weeks.]

Virgil was actually sentenced to less time, than Martin — in part because Virgil pled guilty on the morning of trial.

But he won’t be home in Alabama before 2025 ends. That much is certain.

…On Count 1 of the Indictment, defendant is sentenced to 63 month imprisonment, 3 years supervised release, fine in the amount of $100,000, and a special assessment of $100. Defendant is remanded into custody….

Now you know — and at right is his BoP page, plus the screen cap of his presentation in North Korea — aiding the murderous regime there, in avoiding global sanctions.

Charming. See ‘ya, jerk.

Excellent New Long Form Interview Out Tonight, With Christian Smalls, The President Of The JFK8 / Amazon Labor Union.

Every bit of the below in blue is Mr. Smalls, speaking in his own voice. Take it to heart, you Amazonian middle managers. He. Will. Not. Back. Down.

It is an excellent read. Do go read it all — this is a new world, dawning — in the right of the workers to be heard, and to be… respected, and paid fairly for what they’ve added to Mr. Bezos’ billions:

…Number one: you have to be invested in the company. I was invested in the company. I spent nearly five years of my life, opened up three facilities, and I started from entry level. I pretty much learned how to cheat the system to move up, because you don’t last long trying to make rate every day.

I did work hard. I worked hard to learn the ins and outs of the company. When I became a supervisor, I wanted to learn even more than that. I was invested in the company, to the point where I knew the company operations better than operations. The managers that it hired — the college hires, the new hires — had to come see me to be trained about what their job would entail every day.

So when it came to organizing, it was the same thing. I had to be a leader in the building. I had to be a leader with the company, and now I just played for a different team. I took my leadership skills, and I transitioned into what you guys see today….

[At Amazon: it’s all about…] the mandatory overtime, the peak season, the holiday seasons….

We were spending so much time together that the people I work with became my family. They became my extended family. I would confide in them the way I confide in anybody because I saw them every day and vice versa. They would come to me and tell me things that were going on at home….

I became more than just a supervisor. I was a friend; I was a therapist. I was whatever they wanted me to be, to make sure that their day went more smoothly than being treated as a robot on station.

Building the relationships took several conversations, consistent conversing. Same thing with organizing a committee: you find your leaders naturally. For the ones that really take charge, put in the effort, it’s natural. You can’t teach that; you can’t train that. And when you see a natural leader, you want to have people galvanized behind that leader. Whatever committees you see fit, you want to make that committee as soon as possible….

At Staten Island, we created our own culture. Amazon has its own culture that is run completely on metrics, numbers, and no human interaction. We interacted. We brought a human aspect to it. We cared for one another. We showed the workers every day that we cared for them. Even if they disliked us, we didn’t argue. . . .

Indeed — It has long been a point of pride, with me — to be able to see real potential (potential others have overlooked, for a host of truly stupid reasons) — and to see… natural leadership. He certainly is… the genuine article. You can’t get around… the genuine article. Smiling — off, into the night… now.

In Heller, In 2008, Scalia Created A Right Out Of Thin Air… Ignoring “Well-Regulated Militia” In The Second Amendment…

And children — children! — have been slaughtered, in shockingly-vast numbers. . . by AR-15s, ever since. [And before that as well, to be fair, but the Heller case emboldened states to allow open carry of AR-15 assault weapons without fear of seeing the Supremes strike the laws down.]

It is not difficult to trace a direct line from Bush 43’s active thwarting — of Democratic efforts to continue the federal assault weapons ban (a ban passed during the Clinton Administration, but with a sunset date)… to Scalia’s “pure fantasy” Heller opinion (over-ruling a half century of Supremes’ precedents to boot), striking a DC law that prohibited guns in the District… and now, on to… Sandy Hook, Route 91 Harvest Music Festival / Las Vegas, Mother Emmanuel, Marjory Stoneman Douglas, Pulse Nightclub, Boulder / King Soopers, Topps / Buffalo, and dozens of others, but this week, to Uvalde, Texas.

The text of the Second Amendment itself concerns. . . “well-regulated” militias. . . not nut-job privateers with weapons of war, at the Wal-Mart. Yes — I contend we are now a nation of savages, for allowing Scalia’s lies to kill hundreds of children. This past year, gun violence became the LEADING cause of death for children and teenagers (aged 1 to 19) — eclipsing car crashes. Let us hear from the dissent — it gets the law down right — from retiring Justice Breyer, and the long dead Justice John Paul Stevens:

…The Second Amendment was adopted to protect the right of the people of each of the several States to maintain a well-regulated militia. It was a response to concerns raised during the ratification of the Constitution that the power of Congress to disarm the state militias and create a national standing army posed an intolerable threat to the sovereignty of the several States. Neither the text of the Amendment nor the arguments advanced by its proponents evidenced the slightest interest in limiting any legislature’s authority to regulate private civilian uses of firearms. Specifically, there is no indication that the Framers of the Amendment intended to enshrine the common-law right of self-defense in the Constitution….

No new evidence has surfaced since 1980 supporting the view that the Amendment was intended to curtail the power of Congress to regulate civilian use or misuse of weapons. Indeed, a review of the drafting history of the Amendment demonstrates that its Framers rejected proposals that would have broadened its coverage to include such uses….

As Justice Cardozo observed years ago, the “labor of judges would be increased almost to the breaking point if every past decision could be reopened in every case, and one could not lay one’s own course of bricks on the secure foundation of the courses laid by others who had gone before him.” The Nature of the Judicial Process 149 (1921)….

I trust that the Notorious RBG is telling Scalia right now, in suitably dramatic / operatic terms — about the horrific cost his terrible and ahistorical lies… engendered, just in the years since he fell dead. Damn.

In a supreme bit of irony, when Tangerine speaks to the NRA / Bloodfest this Saturday night, after days of everyone walking around armed to the teeth — the hall will be cleared, and all admittees inside to hear Tangerine… will be patted down to verify they have no firearms. They must take them back to their vehicles, or hotel rooms before listening to him.

Gee — Donnie… so much for your “very fine people,” huh? Again… just, damn.

Scott Johnson Loses His Way By Citing The Discredited Heather MacDonald… Race-Baiting Ahead.

Look — Scott Johnson may rightly quibble, or agree with, or disagree with, Mr. Obama’s perspectives, and views on the second anniversary of the murder by cop, of George Floyd.

He may offer some actual evidence that he thinks relevant (which is where he starts), in counterpoint.

But, almost immediately — in a second paragraph of his rebuttal, he decides instead to repeat the open lies, and misleadingly framed data and charts of one Heather MacDonald.

Her work is shoddy, her methods suspect, and her conclusions have been widely mocked as flatly false. She is a race-hustling charlatan for would be whyte supremacists, everywhere.

But he and John Hinderaker cite her — because she’s the Klansmans’… Klanwoman here.

I’ll leave it at that. All Scott and John do, in decrying Mr. Obama’s views (in this deeply dishonest way)… is reinforce the points Mr. Obama made: these old, embittered whyte men and women… have a problem with admitting their racism. Instead they try to dress it up in a modern day pseudo-science — like phrenology, of a century and a quarter ago. Nothing more.

And so, same, same, as to Mr. Biden’s righteous remarks, on the second anniversary of Mr. Floyd’s death.

By way of contrast, these sad, evil Powerline codgers will… die, eventually, and with them — we hope — their views.

Out.

Hinderaker Openly Lies — Again, Tonight — And Likely Takes NRA Money To Do So…

And surprisingly, I am not just referring to Hinderaker’s terrible data analysis skills. No here… he just openly lies.

Tonight Hinderaker wants to claim (disgustingly) that mass shootings in schools are a rather minor problem. This despite demonically laughing — that mass shooting incidents are generally “up”, under Mr. Biden, just three nights ago. Uh-Huh.

Hinderaker wants us to look the other way tonight, because new NEJM data makes plain that in the USA, behind only car crashes, kids aged two to 16 are most often killed by guns. That was historically true, but in 2020-21, guns became the leading cause of death for children — eclipsing car crashes. That may reverse; see at right — over the next few years — but the essential truth is that guns are the no. 1 or no. 2 kid killer in the USA:

…From 2019 to 2020, the relative increase in the rate of firearm-related deaths of all types (suicide, homicide, unintentional, and undetermined) among children and adolescents was 29.5% — more than twice as high as the relative increase in the general population. The increase was seen across most demographic characteristics and types of firearm-related death….

Sadly (in another episode of Hinderaker’s “lying with graphics!”), we see he again put up the first chart he used just three nights ago.

I had modified that one, at lower left. What a stupid, stupid… tool.

Along the way, he proves my point, first made in late 2017, that Trump was the “killing-est” President — ever.

But this one tonight, he is trying to claim that school shooting deaths are exceedingly rare. I won’t take you through his plainly flawed math, since it is clear that narrowing the “problem” to just in-school shootings largely eliminates the FACT that in the United States, when an otherwise healthy child between the ages of 1 and 19 dies, the LEADING cause of that death is in fact a gunshot wound.

Either accidental, or not so — the lie John here tries to tell is… deeply vile.

So, with Uvalde’s 18 dead children — Hinderaker tells us ignore them — it’s not important… we should simply call him… a bought and paid pig, for the NRA.

As a side note, from three nights ago, there is no doubt that — except for total Allied deaths under FDR and WW II (even Lincoln, when we were killing one another, was only 600,000), no one President has ever seen so many Americans put to death by his decisions — though in Tangerine’s case all of these were due to “failures” — failures to act quickly on Covid, and failure to address streets awash in AR-15 style assault weapons.

Cheers, chucklehead. You’ve earned a marquee spot on the wall of shame. Liar.

Gee Scott, I Remember A Time When A “Non-Snowflake” Texas GOP Governor Candidate Wouldn’t…

…use the Texas Rangers to silence his Democratic opponent, in an election just six months off.

In short, I am sick to death of you cry-baby GOP office holders that are afraid of a public airing of your dumb-as-rocks policies.

So, rather than debating the topics, Abbott chooses to arrest his primary winning opponent.

“What was Beto thinking, trying to derail Abbott’s agitprop on mass shooters?” That’s Scott’s position.

He plainly doesn’t remember that these are core Amendment One moments. In public.

Damn.
