And It Wouldn’t Be A Full Sat. Night Out, Without Hinderaker’s Racism On Display…

In this installment, John decides, without any evidence, that the shooting he is “reporting on”… is related to BLM’s efforts.

Why?

Because Hinderaker still believes in The Fallacy of Composition. His concluding words:

…If you like getting shot at on major avenues with no apparent police presence, Minneapolis is the city for you.

But, hey: Black lives matter! And Saint George Floyd is commemorated everywhere. So it’s all OK…

So… it is fascinating (at least in terms of logical inconsistencies!) that he didn’t mention whyte separatism after Buffalo/Tops.

Even though Buffalo was (by all official investigation results, immediately proved to be) a hate crime by a whyte racist — there… he’s mum — about race, utterly mum, there.

Why?

Because over the course of the last two decades, he’s become a whyte separatist.

He’s a bitter, and sick… old codger.

Out.

Funny — When Gun Legislation Is Proposed…

Hinderaker rolls out all his Columbine era tropes.

And now that it is clear the mood of the nation is in favor of more responsible gun control policies… suddenly his answer is more mental health services.

Hilarious. He points out that about 95 per cent of all the prior mental health facilities are gone (in the last four decades).

https://powerlineblog-reviewed.com/wp-content/uploads/2022/05/whopper-alt-nejm-2021-death-kids-us-guns-2022.png What he doesn’t say about those shuttered facilities is that state level GOP health funding cuts… are largely to blame.

Now he wants Democratic / federal powers to fix this.

But of course, he doesn’t want to pay for it. And he repeats the lie that mass shootings are rare. He ignores that more young people die from shootings than car crashes now.

Guns are now the No. 1 cause of death for 2 to 19 year olds in the US.

Cheeky.

We Would Advise AOC And The House Oversight Committee… To “Let The Process Work” — At Amazon Edwardsville…

As the Universe works in… mysterious ways, of late we’ve happened upon quite a few stories about Amazon. And candidly, we’ve been critical of upper management in most of them.

We are also fans of AOC. But this would be one moment where we think it wise to let the normal workplace processes play out, after the six fatalities in Edwardsville, Illinois last year. The law is well-equipped to deal with these tragic deaths. And to the extent that Amazon may be shown to have actually had a “no cell phones inside the shop” rule, the OSHA- and NLRA- level labor laws will adequately address it. [Backgrounder from December 2021 here.]

And there is the ongoing unionization campaign, company wide.

So I (for one) think the US House Committee ought to give the federal government a chance to work the problem in the normal way. If Amazon is actually able to thwart those very well known routes, then Congress might immediately intervene. Here’s the bit, from Friday morning:

…Last December, a tornado ripped through one of Amazon’s Edwardsville, Illinois, warehouses, known as DLI4, causing the 1.1 million-square-foot facility’s roof to collapse, while 40-foot-tall, 11-inch thick walls on the sides of the building fell inward.

Six workers were killed. Many of the victims were contracted delivery drivers, who pulled into the facility just before the storm hit and frantically fled to a bathroom in an area of the building that was hit by the storm.

The House Oversight Committee in April opened a probe into Amazon’s labor practices and is specifically zeroing in on its handling of the warehouse collapse. Lawmakers gave Amazon until April 14 to respond to its inquiry and produce the requested documents. The committee is seeking communications between Amazon managers and employees at the Edwardsville, Illinois, facility, among other things….

Onward… smiling, as “Maverick” was indeed… a great guilty pleasure.

Elon Musk’s Net Worth Is More Than One Hundred Times The Entire SEC Annual Budget: A Model T, Trying To Race A P85…

This morning, NPR reporters raise the provocative notion that perhaps, just perhaps… the world’s richest man… cannot be regulated. He can tie the agency up in endless appeals, and effectively keep violating the market integrity laws… for a decade.

I think that’s a little overwrought, as he is now a serial pattern fraudster — and they can ban him for a period, or for life — from running public companies, under clearly constitutional federal law, stretching back nearly 80 years, now.

The more salient question (I think) is whether the agency is ready to deal with the whirlwind (collateral sector rotation moves, primarily) in the stock markets… such a ban — even for just two years — would create in stocks — like Tesla and Twitter.

Though I do think Musk will voluntarily walk away from Twitter — so it is really “only” Tesla, and its affiliates, its supply chain and the SpaceX federal government contracts we are talking about, here. But that whole entangled ball is… nearly a trillion in economic effects. So, we shall see — here’s the very good angle, from NPR — do go read it all:

“…We [at the SEC] have blunt tools in the securities laws that are designed to penalize fraud,” Fagel says. “But if somebody sends a poop emoji and investors decide that they are going to buy or sell stock on that, the securities laws aren’t really designed to protect them at that point.”

That particular tweet didn’t lead to a dramatic move in Twitter’s stock price, but several of Musk’s other tweets have, including one in which he declared his deal for the company was “temporarily on hold.”

Musk seems to have figured out something, Fagel says. In this new world, using the social media platform that Musk is trying to buy, you can mess with markets and it “doesn’t really rise to the level of fraud.”

Sure, that can hurt investors, but under current law, the SEC can’t do much….

I for one am pretty certain the SEC will take resolute action to curtail his involvement in public companies outside of Tesla (that ship sailed). A “tailored” remedy that allows Tesla investors to orderly exit if they wish, with his wallet being the buyer… coupled to an order preventing him from closing the Twitter deal (though I think he’s quitting it, on his own), might do the trick.

Finally, an order preventing him from owning more than one percent of any public company for at least five years… would be immensely helpful, for market integrity. Onward, smiling — this afternoon to see the Maverick guilty pleasure, in theaters!

[U: Indictment And USDC Judge Moss Civil Orders] In Which Hinderaker Cries About “The Law” Applying To Navarro…

“Oh. The. Humanities!” [Feigned outrage… fainting even, perhaps.]

Peter Navarro… F-ed around, and now… he’s finding out. Here is his just unsealed $100,000 — and potentially two years in the can… felony indictment, in full (a seven pager).

Yes Contempt of Congress allows for an arrest, and a perp walk. [And yes, Navarro’s legal team understands… essentially nothing, about challenging a lawful contempt of Congress arrest — as the able USDC Judge Moss pointed out in DC on Thursday.]

Preposterously, Hinderaker whines that Eric Holder (a then sitting US AG) wasn’t arrested. But neither was Bill Barr. Both were held in contempt, but in Mr. Holder’s case, after he delivered over 7,000 pages of documents, the GOP House operatives just wanted to waste his time with testimony, despite his having both blanket privilege claims and a full time job as the Attorney General. Note that Navarro (and Barr) are both private citizens, with no claim to duties of office interfering with a date to speak to the Committee, about the 01.06.21 Domestic Terrorism. [And Navarro hasn’t delivered any documents, at all.]

Oh. And the 512 page report from the OIG on Fast and Furious entirely cleared Mr. Holder, of any complicity, or pre-knowledge of the problems with Fast and Furious.

Meanwhile, the analogous reports… at least suggest that Mr. Navarro might be implicated.

Get used to it — Hinderaker, there’s going to be a lot more of this.

And your whining is just silly. This is what oversight looks like. Sit down.

There are actual consequences for being contemptuous of Congressional / Court orders.

Cheers.

It Is Increasingly Clear That Hinderaker Has Nothing To Say…

This tonight is proof of that proposition.

He. Offers. Literally. Not. One. Sentient. Sentence.

No matter. We will turn to the one who “runs” him.

Yeah — we were starved for entertainment — and so cobbled the below “truth enhanced” video of Candace Owens’ June 1 remarks together, from an Instagram video, of yesterday. We stripped the audio, to offer visuals that tell truths about her, as she rambles on about Amber Heard. Enjoy:

Out.

Hinderaker Hosted A “20 Year Party” — As A Live VIP Event… Here Is A Look, At His Core Audience.

I am sure (to ironically mock Tangerine’s turn of phrase) there are lots of very fine people in his audience, too.

But I am reliably informed that about a third of them… look and sound like this a-hole, at left.

The screen cap is from gab [dot] com, this morning… but I have confirmed that two of the three handles seen in it were… at John’s VIP Event, last night by Zoom. I know who they are.

Obviously, the recent immigrant speaking at the bottom of the imaged chain was not present last night.

So — now you know… who was. And Hinderaker, Johnson and Hayward do… too.

They are the quintessential “last white settler” morons — each.

Camden County, NJ: Amazon Shipping/Warehouse Workers… Walk Off Job, Mid-Shift.

Well — the middle managers, under the HQ executives (from Music City to Chicago to LA)… should buckle up, for a lot more of this — as this hot labor summer progresses. We bring it to you in near real time, now.

Do click the link to catch a live CBS Eyewitness News Channel 3 video-feed of the walkout, underway as I type this:

…The workers tell Eyewitness News they are upset that Amazon is closing the Bellmawr location. They also say the company is forcing them to “pick-up shifts” at a warehouse that is farther away….

One worker says he feels like Amazon is treating them like “warehouse machinery” and not people.

They’re also concerned that veteran workers will be forced out, and that newer employees won’t be able to keep up with the demanding pace of the work….

Mr. Bezos — you mess with the bull long enough… and you will see. . . the horns. Be warned.

So — At Something Called “American Greatness”, Hinderaker Repeats A Claim That Durham Was Duped By “Deep Staters” At FBI?!

Well… I do find it… all rather charming… it is so preposterous as to be… sorta’ cute.

From the alleged fact that a few government agents had a “secure workspace” at a law firm (spun up, to be a nefarious deep state operation!?), John infers that the whole of the Durham investigation was a hoodwinking (by a complicit with HRC FBI). But this is in fact, a very common occurrence, in my considerable experience — as when, for just two examples, the FDA (in an NDA/clinical trial review, or plant inspection setting), or the HSR offices of the Antitrust Div. of the FTC or DoJ… (when working to pre-clear a merger, in under 20 days)…

Loony John Hinderaker would try to spin this as a vast FBI conspiracy — one concocted to “trick” Durham (a wise old lawyer, he) into bringing impotent charges (and thus losing!) against Mr. Sussmann.

What?! C’mon, man…

The notion that Durham (someone the GOP told Tangerine was a fine trial lawyer!) couldn’t see that his only hoped-for card, was a single-piece of double hearsay — offered, in truth, we all now know — simply to smear HRC (but if he were truly worth anything, he well-knew it would never sustain a false statement charge — so he would have never brought the case).

This all fails the “straight face” test, for any real… lawyer. Damn.

No, John just makes up a fantabulous story here — but it is very common for even targets of indicted companies to create “clean-rooms” available to government agents, on premises, so that very sensitive competitive or trade secret IP documents need never leave a physical building controlled by a retained law firm, for the defense.

This happens all the time in public company investigations, and in pre-merger reviews, and in FDA visits — at least where the involved companies are sure they did nothing wrong (just as the HRC campaign was sure it had nothing to hide, John!), and the involved actors want to help the government quickly answer all questions with immediate access to ALL the original documents.

Jeebus Hinderaker — you apparently never really practiced high stakes public company law, at all — did you?

Apparently… not.

Onward — grinning.

Amazon Web Services, In Particular, Now Getting Deeper Attention From DoJ / Antitrust, Post The MGM Buy…

Several mainstream media outlets have stories on the renewed vigor of the antitrust authorities’ reviews of Amazon, generally — but particularly in both US media markets, and the company’s roles, and de-facto rules, in what has traditionally been called resale price maintenance. Suggestions have long been lawful, but hard rules, by dominant market players like Amazon… are largely considered, even after 30 years of GOP erosion… unlawful as anti-competitive.

It seems Amazon has “rules” for sellers in its retail channels, that nearly completely prevent them from selling at a lower price on an alternate platform. This was long litigated in the 1950s and 1960s, in the big three automakers attempts to set prices at retail car dealers. So-called vertical resale price maintenance is unlawful.

Confidential Note, to one Jeff Bezos: It. Cannot. Be. Done. Lawfully. In. The. US.

In any event, do pop the popcorn — as the robber-barons get schooled in federal law, here — and on the labor relations front. Out, smiling….
