Trump To Host A Large Public Gathering At The White House Today — And A Rally In Sanford Florida — On Monday.

Less than ten days after he had severe symptoms. Anyone who understands how the bio-science of viral transmission works… knows well how colossally careless this is, on his part.

His malignant ego alone drives this.

He will cause the sickness and deaths of at least some — and perhaps hundreds — more (most of them people likely to vote for him). This is… insanity.

Well — This Trump-istan-ism Is Astonishing — In Its… “Caucacity”: NAACP Policing “Commission” Case Update.

The background on this is here — but in sum, Trump and Barr have been holding secret meetings (at least 38 of them, to generate a pre-baked report) to provide cover, for more militarized policing at the state and local levels. This effort plainly violated a myriad of laws, and resulted in an order suspending everything about a week ago.

Now, as the able USDC Judge John D. Bates gets set to shape the full remedy, the ever-officious team Trump lawyers, in effect, told him tonight… obeying federal laws (by law enforcement, related to policing practices)… is only for the “little people.”

The brown and black people.

Not us — you know… the MayoSapiens. The “Masters of the Universe”TM.

Oh. The utter Caucascity — of it all. These a-holes told a federal judge, in an official filing, that he shouldn’t concern himself with any… actual law. Trump says Judge Bates was, in sum, wrong (his lawyers say) to expect that anything Trump-related would follow the law, and the judge’s… a fool for trying to make these Masters of the UniverseTM bow to all these puny laws, thus:

…Defendants respectfully ask that the Court amend its Order to remove the requirements to file a charter, provide notices of future meetings, and to designate a federal officer for the Commission. The Commission is only one week’s worth of work away from finalizing its report. See Third Declaration of Dean Kueter ¶ 11 (“Third Kueter Decl.”) (attached as Exhibit A). As a consequence, there will be no further meetings of the Commission, id., and no purpose would be served by requiring Defendants to comply with those procedural requirements….

Accountability. Someone — perhaps Bill Barr himself, is responsible for these violations of the law. And he should be held to account. That is the purpose, you mediocre-white-guy-morons. The idea that these goons might just go ahead and put out a report, after violating innumerable federal open government laws — so that they might give legal cover to policing of communities as though they are Baghdad, outside a Green Zone — i.e., enemy military territory — is. . . well, insane. Thank goodness, for real federal judges.

Now– if you’d like to read a REAL relief shaping memo, from the cogent counsel for the NAACP Legal Defense Fund — do read it here. I will highlight it, separately, on the morrow. Gosh but these a-holes need to be. . . evicted, like yesterday.

But the able judge is very likely to adopt just about all of the NAACP’s suggestions, in that last link — and almost none of the government’s, since it has so discredited itself, with the brown matter pull-quote, above.

In Which Paul M. [Intentionally?] Loses The Plot — On Michigan’s White Domestic Terrorists.

Paul M. (I will assume for now, without any real evidence) means well. He would like all of us to stop… inciting violence.

A noble goal.

But he quickly goes astray, by trying to blame the Wolverine Watchmen on… anarchists. Here are the facts:

The FBI had informants, on the inside of the plot. They were all being… recorded. By far, over 90 per cent of all the talk was anti-Democratic Party, and Pro-Trump.

Facts matter. Paul would do well to read the charging documents, before spouting off — with his vast, blithering ignorance.

Out.

Supremes Rebuff Trump’s “Emergency” Attempt To Limit Access To Family Planning Drug Mifepristone, In Maryland…

As we saw in August, out of Louisiana, the Supremes overnight told Trump’s FDA counsel that in order to challenge the injunction on Trump’s attempt to restrict access to the so-called abortion pill, mifepristone during the COVID-19 crisis, he needed to follow the regular path, and duke it out in the Fourth Circuit, if his request to modify the injunction fails in the District Court in Baltimore. And that is likely, after losing outright (getting enjoined) in Baltimore, Maryland. [There he lost to the American College of Oby/Gyns., among other pro personal autonomy/liberty parties.]

[My prior post, as background on this particular case’s appeal, here.] Here it is, in full — (with a largely non-sensical disssent from Justices Alito and Thomas) and a bit:

…The Government seeks a stay of an injunction preventing the Food and Drug Administration from enforcing in-person dispensation requirements for the drug mifepristone during the pendency of the public health emergency. The Government argues that, at a minimum, the injunction is overly broad in scope, given that it applies nationwide and for an indefinite duration regardless of the improving conditions in any individual State. Without indicating this Court’s views on
the merits of the District Court’s order or injunction, a more comprehensive record would aid this Court’s review. The Court will therefore hold the Government’s application in abeyance to permit the District Court to promptly consider a motion by the Government to dissolve, modify, or stay the injunction, including on the ground that relevant circumstances have changed….

So it goes. Trump’s time is mercifully drawing to an end, so long as we all go vote. Onward, smiling on a clear warm fall Friday — with no pumpkins to paint here, this year….

Trump: “I do not tolerate ANY extreme violence.” [Hmm. Only “Non-Extreme” Violence, I Guess.]

This overnight hours tweeted insanity merits preserving — for the record — of a historical telling, one day.

On a day when the FBI foiled a far right white domestic terror gang’s plot to kidnap and execute the duly elected Democratic Governor of Michigan, Trump waited until late in the evening to speak on it. He almost exclusively spent his tweet time, in praise of himself, and claimed that he was solely responsible for the FBI’s excellent work (after regularly demonizing the same agency for looking into inconvenient facts about him, and/or his cronies)…

And then he criticized anew the Michigan Governor, on politics, rather than expressing a sentiment of national unity — against domestic grown terror groups.

Finally, rather than condemn them by name — he simply said he doesn’t “tolerate” extreme violence.

Truly the man’s lack of command of the English language means we can never really be sure what he intends to say — since he says it so poorly… but the implication might fairly be that he does “tolerate” ordinary violence.

This, just a month or two after he tweeted out that his people should “Liberate Michigan!”

The man — even if the steroids have left him with COVID brain-fog — should be declared unfit to lead, and relieved of his duties by the Vice President. But that guy’s brain… is controlled by a fly. So we are looking at… President Pelosi, I guess.

Do go vote. Vote him out.

Onward.

Trump Must Be DOA, If Hinderaker Is Touting… This Bin Ladin Family Endorsement — For Trump!

To be fair, this is the now distant niece — and she spells her name differently, for obvious reasons.

But… seriously, John… dude, this is not really a winner, for 45.

The goal is to find US votes, not people who renounce family ties — wholly outside the US — to murderous dictators.

But as long as you’re on this quixotic quest — maybe you should ring up one Mary Trump for some pull quotes (she’s a niece of murderous dictator, btw — in case you haven’t checked The New York Times Best Sellers’ List lately).

I mean… as long as you are rummaging through rubbish piles for positive news about Trump… Oh. Erh… Wait. I think she might not be so good for your ole’ boy, either.

Never mind.

Out.

Serving Up Some Comedic Relief: In Which Sidney Powell Pretends Not To Know How Plea Agreements Work: In Flynn’s “Treason” Case…

Okay — surprisng no one (no one, paying attention at least), the ever over the top Sidney Powell, yesterday — in a turgid 40 plus pager — moved to recuse the able USDC Judge Sullivan, in the ongoing Flynn felony lies matter. Y A W N.

Read that link only for comedic relief. It is almost without exception devoid of actual legal analysis, and relies on conjecture and character assassination, against an esteemed sitting federal judge in DC — to try to “wrestle the narrative away” from the facts (now admitted, by Powell) that (i) she submitted altered evidence in this matter, without flagging it — and that (ii) she discussed this criminal matter with the then-sitting president himself, A/K/A “Individual One” (and then as we earlier reported claimed an entirely non-existent executive privilege when pressed about what horses wre being traded, there!). Of course, Individual One is. . . the single person (other than Flynn himself) most likely to benefit from Mike Flynn’s NOT going to jail (and thus NOT diming Trump himself out).

She bases her entire recusal notion/motion — preposterously — on the fact that Judge Sullivan understands how felony plea deals actually work. Which is what Flynn signed up for, of course. [If his claim is that his prior lawyers did a bad job on his defense, his remedy is to appeal — after his own personally negotiated sentence is handed down — not to go get a “Mulligan” from Bill Barr, by going through to Trump, himself.] The way these plea deals work is the indicted defendant (Flynn) pleads guilty to some fairly minor offenses, in return for cooperation against bigger fish (Trump, himself) — with everyone in the courtroom well-knowing he could be charged, and likely convicted, of much more serious offenses — up to and nearly including. . . treason (in this case). Significantly, Flynn repeatedly told Judge Sullivan under oath that he was guilty of these offenses. Yet in Powell’s telling, it is bias, on Sullivan’s part — to make mention of these facts, after Flynn had done so, on the record. Precious; here’s a bit of that nonsense:

. . .At what was scheduled as a “sentencing hearing” but became an “extended colloquy,” Judge Sullivan expressed his “disdain” and “disgust” for General Flynn’s conduct, stated that he “sold [his] country out,” and suggested that General Flynn had committed “treason.” Hr’g Tr., United States v. Flynn, No. 17-232, (D.D.C. Dec. 18, 2018) at 33, 36 (herein after “Hr’g Tr. 12-18-18”). There was no factual basis for these defamatory comments. Neither General Flynn’s plea to a violation of 18 U.S.C. 1001 nor the statement of offense made such allegations….

Welp. I’ll keep an eye on it — but we should also keep an eye on Powell’s arguable misconduct in discussing her client’s case with… INDIVIDUAL ONE; and then trying to hide the substance of that discussion from Judge Sullivan (as well as offering into the record, a clearly “doctored” purported piece of evidence, without flagging it). Onward, grinning now….

The Census Data Collection Effort Shall Continue — Ninth Circuit Correctly Rules. Trump And Ross Will Not Be Allowed To “Gerrymander” US House Seats, By Cutting Off Census.

Another victory, for those of us who still believe our nation is ruled by laws — not despots. Just as we predicted — a month ago.

And so, it is yet another entirely-predictable loss, for Trump (we await the likely “hard pass” from the Supremes, as well). He and Wilbur Ross may not use the Census to reduce the number of US House seats allocated to districts that might have more undocumented persons, than others. The Constitution commands that the census count all persons — not citizens, for apportionment. End of story. Here’s the latest well-grounded 21 page Ninth Circuit opinion, overnight:

…Moreover, the December 31, 2020, deadline is nearly three months away. As we have already stated, predictions as to whether it can still be attained are speculative and unstable. And any harm from governmental attempts to meet the December 31 date are likely less irreparable than the injury from displacing the October 31 data collection endpoint. If the Bureau meets the December 31 date by using procedures that violate any accuracy requirement embedded in the Enumeration Clause, or proceeds in an arbitrary and capricious manner, existing data can be reprocessed more easily than data collection can be restarted.

Moreover, given the remaining time, leaving the December 31, 2020 date in place as an aspiration will have no immediate impact. Perhaps the Bureau will find that with an extraordinary effort or changes in processing capacity, it is able to meet its deadline. Or the Department of Commerce may seek and receive a deadline extension from Congress. Or perhaps the Bureau will miss the deadline, as statement after statement by everyone from agency officials to the President has stated it would, due to the extraordinary circumstances of the pandemic. Missing the deadline would likely not invalidate the tabulation of the total population reported to the President, see, e.g., Barnhart v. Peabody Coal Co., 537 U.S. 149, 157, 171–72 (2003), and may well be approved by Congress after-the-fact, as has happened in the past, see, e.g., Act of Sept. 1, 1841, ch. 15, § 1, 5 Stat. 452, 452 (1841).

Finally, and of great import to our balancing of the equities, and consideration of the public interest, even if — as both parties aver — data processing cannot be completed by December 31 as a practical matter, that does not mean that missing the putative statutory deadline should be required by a court….

Onward, as Trump’s chances for retaining that office wink out of existence, like a small, lone candle — unglassed, and battered, on a windy night outdoors at a sidewalk cafe, in New Orleans, tomorrow… we shall smile.

[U: 10.08.20 AM] 38 Minutes In — And We Ought To Invoke The “Slaughter Rule” — Sen. Harris Has Buried Pence. He Ought To Go Home.

And Pence won’t stop cutting her off and stealing her time. . . So, yes, even he now knows he has lost.

Senator Kamala Harris is clearly Mike Pence’s better — in every sense of that word. Out.

Okay — I cannot resist. The fly stuck to his head for over five minutes. . . because flies can smell poop, when it is being flung.

Eventually, even the fly left — as it realized Pence’s lies were ultimately… boring.

Updated — this morning (10.08.20), the debate commission announced the next debate would be virtual — not face to face, due to safety concerns. [This also means the moderator could cut a mic — or cut away — from a participant, for repeated rules violations, by way of example.]

So, naturally, Trump has declared that he won’t participate — not in a safe, fair debate. Charming.
