COVID-19: Reductio Ad Absurdum — Or, Reductio Ad Hinderaker — But I Repeat Myself.

This truly merits scant mention — and no analysis.

A man who declared, without any evidence, on July 19, 2020 — that the dying in the USA “was mostly over” [about 150,000 were dead then]… and the US death total sits around 212,000 tonight…

…IS SOMEONE NO ONE SHOULD TAKE SERIOUSLY. EVER AGAIN.

That was… Hinderaker. And… a lie he’s never apologized for, by the way.

Tonight, John complains about some California mask-wearing rules in restaurants. They do seem a little excessive (put the mask back up between bites, in essence) — but if the alternative is to close indoor restaurants, altogether… John ought to… hush, if in fact he wants to be pro-restaurant commerce.

Seriously, John. Just shut up.

We are on track for perhaps a quarter of a million deaths by Christmas.

And the notion that we should NOT close indoor, sit-down, dine-in service at restaurants… is becoming less defensible, given the continued acceleration of spread/positives — and deaths — nation-wide.

He should read what his fellow blogger, Paul M. wrote, this afternoon. With some significant under-estimation errors, Paul is right: John’s and Trump’s NON-policies… are causing excessive deaths.

Full stop.

Hinderaker: God’s own fool/moron, on all matters of pandemic mitigation / life-science.

Mazars Update — No Surprise: Trump’s Silly Subpoena Arguments Bounced, From Second Circuit In A 35 Page Opinion — Supremes, Next (Again!)

As expected (and as we predicted, just last week), Cy Vance has the right to run regular grand jury subpoena enforcement mechanisms, against all criminal defendants. The president is not above the criminal law.

Here are all of the 35 pages of the well-grounded opinion — with a short stay (see below), for the Trump lawyers to ask the Supremes (and lose, there):

…We find that the claim of overbreadth is not plausibly alleged for two interrelated reasons. First, the President’s bare assertion that the scope of the grand jury’s investigation is limited only to certain payments made by Michael Cohen in 2016 amounts to nothing more than implausible speculation. Second, without the benefit of this linchpin assumption, all other allegations of overbreadth — based on the types of documents sought, the types of entities covered, and the time period covered by the subpoena, as well as the subpoena’s near identity to a prior Congressional subpoena — fall short of meeting the plausibility standard. Similarly, the President’s allegations of bad faith fail to raise a plausible inference that the subpoena was issued out of malice or an intent to harass….

The parties have previously agreed that, should the President seek interim relief from the Supreme Court after our instant affirmance of the district court’s judgment, the District Attorney would “forbear enforcement of the Mazars subpoena until a decision is issued by the Supreme Court denying such a request for interim relief… provided [the President] complies with” a briefing schedule agreed to by the parties….

Onward — we will vote this crook from office in under 30 days, now. Out.

In Which John Complains About Some Kid — At A City Council Meeting In Portland…

But wholly-ignores Trump’s ongoing lies against, hatred toward — and accelerated endangering of — over 210,000 more… of his fellow Americans’ very right to exist.

Here’s a road-map / field guide-book for Hinderaker’s inability to discern who, and what, ACTUALLY matters, in this nation: one is a deeply, likely incurably diseased, disaffected, likely drug-addled, sleep deprived raving lunatic — with a mean streak the width of his back.

The other is… just a sleep-deprived kid in Portland.

But that first one, he’s the leader of John’s party — and claims to be the leader of the free world.

Unlike the kid — he won’t just go sleep it off. Trump will kill dozens more, with COVID-19, all by himself, in the coming weeks.

Stephen Miller (the architect of Trump’s border cruelty) is now positive for COVID-19, tonight.

All I can say is… “τὸ κακὸν δοκεῖν ποτ᾽ ἐσθλὸν τῷδ᾽ ἔμμεν’ ὅτῳ φρένας θεὸς ἄγει πρὸς ἄταν….”

G’night — and good riddance, to you — John.

Well — It Seems Trump Is Looking At A “Scorched Earth” End To His Time In Office…

Both Facebook and Twitter — over the past 15 or so hours — have blocked viewers from seeing certain statements made by the (for now) sitting president of the United States. These actions were not taken lightly. These are duly-deliberated, previously warned about remedies… for intentionally lying about matters of life-or-death public health.

Let that sink in: this man — supposedly the leader of the free world… is intentionally lying about a life or death issue, to his own base, and the world more widely — about the potential lethality of COVID-19. This, with over 210,000 of his fellow citizens dead of it, and that number is climbing every night. Here’s some of the story, from MSNBC:

…Facebook and Twitter on Tuesday took action against a post by President Donald Trump that falsely claimed the seasonal flu is more deadly than the coronavirus.

Facebook removed the post, and Twitter added a label warning of misinformation about the coronavirus before a user could click to view it. Twitter also prevented the tweet from being shared.

“As is standard with this public interest notice, engagements with the Tweet will be significantly limited,” a Twitter spokesperson told CNBC….

The core of his lie is that it is no worse than a flu. Of course, we have long had FDA approved and widely available, nearly free of charge vaccines, for the annual flu variant strains. Not so, COVID — not even close. This is a man who seems to be in the throes of a steroid therapy side-effect dementia — or the fog of COVID brain. He is actively spreading a deadly virus, and lying about it.

The 25th Amendment may yet come into play / be needed — before election day. He is also ordering the Treasury Secretary, and the Majority Leader in the Senate to cease negotiations with Democrats in either chamber, on a second round of stimulus until after election day. Before then, it is probable that at least one airline will… fail. Call me crazy — but I think his chance of winning… is now very near zero. Out.

The Able USDC Judge Nichols Will Hold The Next Preliminary Injunction Hearing On TikTok In DC… The Morning AFTER The Election. Smile.

As we’ve said several times now, with Trump likely to lose the Electoral College by a margin of 338 to 200, as of this morning, even the federal judges appointed by Trump are treating his so-called “emergencies“… as business as usual.

Latest example? The hearing on the more permanent injunction against his “order” which purported to ban TikTok app downloads… is now set for after election day.

When Trump loses, it is very likely the Trumpian / government lawyers will fold their tent and dismiss this loser, outright, on their own motion [on very clear First Amendment violations] — so, no hurry to hold a hearing:

…MINUTE ORDER: Preliminary Injunction Hearing set for 11/4/2020 at 10:00 AM in Telephonic / VTC before Judge Carl J. Nichols. So Ordered by Judge Carl J. Nichols on 10/6/2020….

If this hearing does somehow go forward, I will live blog it. Onward, grinning — and baking up some potica cakes.

“Unprecedented, In Its Absurdity” — Just Not… In The Way Hinderaker Imagines…

Here is his quote, this morning (updated graphics at right):

“…unprecedented in its absurdity….”

John refers to what he calls a “media freakout” — about Trump’s antics, after having seen his blood oxygen levels take precarious cliff-falls on Friday, and then serious breathing difficulty on Saturday, due to a full-blown COVID-19 case, as… (wait for it!) absurd. [To be clear, I want Trump fully recovered, to face his consequences — but the reality is that he has a better than 50-50 chance of relapse, as an obese 74 year old, who gets nearly no real exercise, and eats predominantly a fast food diet. That alone should sober John — but it will not.]

With the minimum number of infected in Trump’s inner orbit now at least 33 — and growing by the hour, even as Trump tries to suppress news of additional positives — and with significant parts of the Pentagon going into a modified lock-down due to exposures to the West Wing crew of Super-Spreaders… yes, it is… absurd, John.

It is absurd… that 210,000 have died, and rising, daily [while he joyrides, and endangers the Secret Service professionals for no point or purpose]. Absurd, that most of the 210,000 are dying alone, due to isolation rules — not getting to hug their loved ones one last time before they depart this Earth… while Trump recklessly endangers every person who has agreed to work for him, and some who have not explicitly agreed (career civil service personnel and wait-staff, janitors, etc.), yes… A B S U R D.

Absurd — that John agrees with Trump that we should not let COVID overtake our lives — and instead be willing to die, for a feckless blowhard’s fragile ego.

John himself is now showing all the signs of narcissism Trump exhibits. Perhaps it is… infectious, just like the virus — in the GOP.

[Funny that none of the hard-right small c christian “ministers” — who regularly tell us that god’s wrath is falling upon liberals, when ever a blue state like California experiences a forest fire — don’t see the obvious Sophocles’ wisdom (from “Antigone” — verses 623-630) here in Trump’s latest… White House plague, thus:]

“…τὸ κακὸν δοκεῖν ποτ᾽ ἐσθλὸν τῷδ᾽ ἔμμεν’ ὅτῳ φρένας θεὸς ἄγει πρὸς ἄταν….”

or, “…Evil [Trump] appears as good, in the minds of those [like Hinderaker] whom god leads to destruction….”

Words to ponder, John… Out.

There Are Times When One Simply Has To Say It: This. Is. Lunacy. Watch The Video…

There is simply no charitable way to say it — so I’ll just blurt it out. This is one of those impolite times. This close-up video loop looks like someone trying to hide. . . dyspnea. Dyspnea is very common among sufferers of pneumonia, emphysema, advanced COPD. . . and of course, COVID-19.

This video (shot about an hour ago) — a seven second loop — looks like he’s a fish stranded on the beach. . . gasping for air, all while trying to project a calm exterior.

It is… tragic. Even though plainly self-inflicted, this is sad to watch — even with a likely full medical suite outfitted and powered up, in the White House residence by now, he is taking a very grave risk, for literally no good reason. This may very well… not end well.

And right before this video clip tonight, he took his mask off, still absolutely shedding the virus, and walked through the doors of the White House, around staff and guards. Aside from the extreme risk he has taken with his own life, by demanding early release from Walter Reed — he has no right to risk others’ lives.

He is actively putting everyone in the White House, and everyone they live with, and love… in very grave danger, by being around them. He is — and yes, this is impolite — an asshole. [BTW, the now-privatized White House Gift Shop is selling $100 coins online (photo coming soon) that proclaim “Trump Defeats COVID!” Disgusting. Truman v. Dewey, anyone?]

This Won’t Age Well, John…

Precious. [One would be tempted to think Hinderaker was the one snorting crushed Adderall, not Trump — based on the below.]

“[Trump returns] …not having missed a day of work as a result of contracting COVID, as I think is true for most people who catch the virus….”

Because… Trump, and only Trump… matters.

You’re an… idiot Hinderaker. And when people ask me, about who knew what when… I’ll cite this excrement of yours.

Cheers.

As We Predicted, And On A Sunday No Less(!), Ninth Circuit Says Trump Loses — On Second Appeal Of “Isolating / Hotelling” Minor Refugees.

This is the fully-expected decision on the argument we covered from last week, in which Sarah Fabian sent an underling because she knew she would lose.

But the rule of law — and human decency won, yesterday, if entirely as expectedly, as we said — in a 16 page opinon:

…The district court issued two orders precluding the Department of Homeland Security (“DHS”) from detaining certain minors in hotels for more than a few days in the process of expelling them from the United States. Addressing the government’s emergency motion for a stay, we conclude that the government is unlikely to succeed on the merits of its appeal, as we likely do not have jurisdiction over the appeal.

The government also has not established that it would be irreparably harmed if it were obliged to comply with the district court’s orders while the appeal is pending. We therefore deny the government’s motion for a stay….

The government asserted at oral argument that this Court has jurisdiction over the appeal because the district court’s orders require the government to take “specific actions,” not simply to comply with the Agreement. Flores II held that we did not have jurisdiction to review the district court’s order enforcing the Agreement at issue in that case. There, we distinguished Flores I, in which we exercised appellate jurisdiction over the district court’s order requiring the government to take “specific actions,” such as releasing a minor’s accompanying parent. Flores II, 934 F.3d at 914 n.5. In Flores I, however, the district court’s order required the government to take actions that the Agreement did not require (i.e., releasing adults along with their children). See Flores I, 828 F.3d at 908. The order thus modified the Agreement, and provided a basis for concluding, as the opinion did without explanation, that there was jurisdiction under 28 U.S.C. § 1292(a). Id. at 905.

Here, in contrast, as in Flores II, the district court just directed compliance with the Agreement, specifying in its September 4 order the paragraph of the Agreement being implemented by each directive: DHS must ordinarily transfer minors held for longer than three days to a licensed facility, as required by paragraph 12.A of the Agreement, see Sept. 4 Order, 2020 WL 5491445, at *10; Sept. 21 Order, 2020 WL 5666550, at *4….

The government has not shown that the district court’s orders require it to take actions not required by the Agreement. We therefore conclude that we likely do not have jurisdiction over the appeal, and that for that reason, the government has not shown a strong likelihood of success on the merits….

Onward, into a perfectly crisp, sunny fall morning here. Grinning, sardonically, at Trump’s ongoing and self immolating. . . narcissism (see new masthead). Almost all of the rage tweeting this morning by Trump is likely a side effect of the steroids he is on, to reduce the lung inflammation. This man is seriously ill (Remdesivir, plus monoclonal antibody cocktails and steroids) — and this time (and this time, only!), I am talking only about his COVID-19 morbidity risks.
