BHO 44 Returns To The White House — To Talk ACA of 2010 Updates With Biden/Harris…

I know this is making the frothy hard right… crazy. Here is the fine man, while enjoying his retirement from public life immensely — greeting his former Veep, now Commander in Chief — and the current Veep, the first woman of color, ever to hold that office.

The occassion was the signing of an executive order to improve access to coverage for up to four million more Americans (in 12 states):

…Currently, there are 12 states in our nation that refuse to expand Medicaid for no reason other than petty partisan obstruction. As a result, 4 million people in our country are locked out of coverage, and that comes at a cost.

For example, women who do not have healthcare coverage and are, therefore, less likely to have access during pregnancy, or before or after, to pelvic exams or vaccinations, prenatal check-ups, postpartum depression screenings, and all the other essential care they need to be safe and healthy before, during, and after birth.

We know that expanding Medicaid coverage significantly reduces the number of mothers who die as a result of pregnancy. (Applause.) So the sooner coverage is expanded in those 12 states, the more lives we will save….

But for all of us — for Joe, for Harry, for Nancy Pelosi, for others — the ACA was an example of why you run for office in the first place, why all of you sign up for doing jobs that pay you less than you can make someplace else; why you’re away from home sometimes and you miss some soccer practices or some dance recitals.

Because we don’t — we’re not supposed to do this just to occupy a seat or to hang on to power. We’re supposed to do this because it’s making a difference in the lives of the people who sent us here.

And because of so many people, including a lot of people who are here today, made enormous sacrifices; because members of Congress took courageous votes, including some who knew that their vote would likely cost them their seat; because of the incredible leadership of Nancy and Harry, we got the ACA across the finish line together. (Applause.)

And the night we passed the ACA — I’ve said it before — it was a high point of my time here, because it reminded me and it reminded us of what is possible.

But, of course, our work was not finished. Republicans tried to repeal what we had done — again, and again, and again. (Laughter.) And they filed lawsuits that went all the way to the Supreme Court three times. I see Don Verrilli here who had to defend a couple of them. (Applause.)

They tried explicitly to make it harder for people to sign up for coverage.

And let’s face it: It didn’t help that when we first rolled out the ACA, the website didn’t work. (Laughter.) That was not one of my happiest moments. (Laughter.)

So, given all the noise and the controversy and the skepticism, it took a while for the American people to understand what we had done. But lo and behold, a little later than I’d expected, a lot of folks, including many who had initially opposed healthcare reform, came around….

[Mr. Biden speaks:] …My name is Joe Biden, and I’m Barack Obama’s Vice President. (Laughter and applause.) And I’m Jill Biden’s husband. (Laughter.) By the way, the only reason Jill is not here today: She’s working. (Laughter.) She’s teaching….

If nothing else (even if you disagreed in good faith, with the premise and aims of Obamacare), do note the selfless, and often self-deprecating tone of these world leaders (real humility… is a virtue) — they understand they… serve; not reign. And they do the right thing, not the self-enriching thing (cough — confidential to one Tangerine Florida Man).

Meanwhile, Hinderaker Serves Putin, As His “Useful Idiot / Puppet” Tonight…

Hinderaker again claims to be offering thoughtful perspectives — in an academic fashion, here offering up his latest pro-Putin sound bites, and disparaging his own US Commander In Chief.

He is — in short — continuing his own 21st Century Tokyo Rose routine; only he doesn’t look nearly as fetching as she, in this latter-day Russian red lipstick.

I post his exact words (after he quoted approvingly, the propagandists beholden to Putin):

“…I think it is fair to say that nobody is taking Joe Biden seriously. That is a bad thing when our foreign policy is based on deterrence and we are dealing with a nuclear power….”

That is not… the courtly language of a scholarly analysis. It is the invective of a malignant moron. Does he care, at all?!

Nope. Hinderaker seems bent on being remembered — here nearing / at the end of his life, as a traitor to US patriotism.

Charming. I just hope he isn’t called in (by State Dept., or Homeland Security), to explain those odd checks, from what look like accounts connected to Russian oligarchs — or the Bitcoin wallets, bulging with tracked coin, from Putin himself. Heh.

Is Scott, At Least — Now, Six Weeks On… Accepting Ukrainian Reality?

I hope so.

But I will remain firmly skeptical, given the earlier lying in the face of clearly genuine video- and photo- evidence of pattern practice / clearly command-ordered atrocities, by Putin’s men.

The rest of the thinking US world… figured it out in days. These guys?

Six weeks. Makes me wonder… did all those Russian-oligarch checks dry up / and or bounce?

Heh.

So, Mr. Musk Becomes One Vote — Of Eleven, For So Long as He Stays Below 14.9% Of Twitter…

Of course, the founder, and another still-huge shareholder (at around three per cent of the total outstandings) — Jack Dorsey — is rotating off of the board, at this annual meeting. And with several shuffling moves, the board is now ten. When Elon completes his D&O questionnaire without deleterious background information coming to light, the board will be eleven. [A little more gloss, here on my last night / no “takeover” take. Grin. These detenté agreements are very common — and they essentially let Mr. Musk engage in his publicity seeking escapades, without really changing the course of the ship at Twitter — that’s my experienced take.]

I doubt Mr. Musk ever wants more than ten per cent of Twitter, in any event. He’s made his bold — mostly publicity-seeking — move, and now he will be one voice of eleven in the room — about how much hate speech the company will allow in its monetized private club. And that will be driven by how much its conversations on platform may be monetized. And hate seems not to be selling very well, with Gab, Gettr and Parler on the ropes, and Tangerine’s oddly-named “Truth” (in part due to the feckless incompetence of one Devin Nunes) now essentially DOA.

So, now we may say — he has no present intention to take over Twitter. He has the money to do so, but he is smarter than wanting it, in total:

…Company Securities. Mr. Musk agrees that, for so long as Mr. Musk is serving on the Board and for 90 days thereafter, Mr. Musk will not, either alone or as a member of a group, become the beneficial owner of more than 14.9% of Company’s common stock outstanding at such time, including for these purposes economic exposure through derivative securities, swaps or hedging transactions….

This really won’t change much, longer term at Twitter… and I think “the pop” from Musk’s investment will fade, in a few weeks — it will mostly be back to business as usual at Twitter. Grinning, five years back to the day, now….

[U: Gullibility Alert!] Hinderaker Hopes That Social Media Will Be “Regulated, Like Monopoly” Water Companies… But Wants Truly “Free” Speech There?!

Updated @ 10 PM EDT: John updated his, to say he’s glad (even as a minority shareholder) that Musk got a supposed social justice warrior/Twitter moderator to resign. The problem is that the guy who “resigned” is a known prankster. It’s right in his bio. Stupid, John. Quite… gullible, at that. End update.

This decline in logical, consistent reasoning capacity, at Hinderaker’s keyboard… is comical.

In the front part of this post, he thinks Twitter is a monopoly, and deserving of deeply intrusive regulation (like a water-, gas- or electric- utility, he says!). Forget that such a stance is deeply antithetical to actual conservative principles… and just focus on the notion that Trump/Devin Nunes launched one without any capital, or a whit of an idea how to do it — as did gab [dot] com, and of course… the notorious Mercer- and Russian- backed versions of Parler.

Not really any form of monopoly at all, right? At least not in any competent lawyers’ telling: we see three idiots; little capital and yet it yields… three social media outfits. Competitors. That John admits Trump’s has already failed… in no manner contradicts that the actual competitive field here is… wide open.

No, as Hinderaker is (apparently) no longer smart enough to understand, the problem for Trump, Parler and Gab is that… the IDEAS they promote… won’t resonate.

Generalized misogyny, pro-violent gun attacks, championing white separatism ideals, false racial identities and fake histories — jingoism and racism… with a strong dash of antisemitism in the case of gab’s crowd… along with hard x-tian hate on a wide spectrum of topics… is why they fail.

In sum, they espouse, at least permit and often condone… odious behavior, not just pure speech.

All the while advocating death penalties for women who get abortions — same for the doctors who provide this often life-saving service.

In the back half of his piece, Hinderaker then proves, without a doubt, that he cannot understand SEC Schedule 13G filings.

Elon Musk has specifically avoided the otherwise required disclosures, under Section 13, if he wanted to affect changes in policies at Twitter, with his investment. That is — he’s required to state his intentions.

His silence means John (yup!) is wrong here, as well. No surprise.

So, it seems almost gratuitous to point out that in one breath Hinderaker hopes for Elon’s total control of Twitter’s policies on hatred and lying about critical health matters… while hoping for a monopoly nowhere in evidence, so that he might see freedom to run a private club… (in the way the owners believe most likely to make sustainable profits, and a pleasant experience in so doing)… snuffed by regulators.

Actually… in that respect… Hinderaker sounds like… Vladimir Lenin, of a century past.

Charming, John… simply charming. Your whole worldview is falling apart around you — and the logical contradictions you now daily espouse… prove it.

Out, to see a Kansas Jayhawk win. Grin.

It Is Unfortunate That Hinderaker Has Run Out Of “Original” Lies. So He Now Cribs… Others’.

Truly… I don’t care, much — as I’ve said repeatedly, he — and his fellow travelers in hateful lunacy… are dying off, in America. One by one.

So I’ll just note that he cribs a Horowitz piece this afternoon, which is wholly bereft of truth. In fact, this is about exactly the opposite of what the Senate hearings reveal a week ago (shameless liars!):

“…Ketanji Brown Jackson, who is about to become a Supreme Court Justice, is a believer in and promoter of Critical Race Theory [not true; she said otherwise], which means she considers the Constitution a Supreme Court justice is supposed to defend a “white supremacist” document that social justice warriors like her are bound not to respect. And the entire Democrat Party thinks that’s okay and is ready to support her….

She also says she has no position on whether people have natural rights [false statement; she said no such thing], which puts her at odds with the Declaration of Independence as well as the Constitution….”

Well — what they are both right about… is that she WILL be the next Justice. Other than that, I don’t care to amplify their sad lil’… lies. Onward.

As We Learn Elon Musk Personally Now Holds ~9.9% Of Twitter… Another “Social” Seems To Be Flaming Out.

Often it is what is not said, that echoes most forcefully… when we look back, with the aid of the longer lens — of passing US history. That is true today, as to Mr. Musk — and Tangerine, too — as irony would have it.

Not that Mr. Musk is even-remotely fastidious in complying with his personal SEC disclosure obligations, but the filing he made this morning as to Twitter makes no mention of any intent to become an “activist shareholder” — that is, he discloses no intention to change the policies of Twitter or change its management (despite tweeting a few days ago, that a new social network might be needed, as to what he called “free speech”).

My point here is to say that it will only create additional SEC violation exposures for him personally (and he has more than a few open formal investigations pending at the agency), if he intends to “Tangerine-ify” Twitter.

We shall see, but that brings me to another topic: Trump’s so-called Truth Social seems to be… dying on the vine. Sign ups are off 93 per cent since mid February, and three key executives (including his chief lawyer) now no longer list it as their role, on LinkedIn.

He is said to be angry that (huge surprise!) building a 21st Century megaphone… is tougher than some political hacks might imagine:

…So far, however, Truth Social has failed to gain traction or popularity among users. The app has seen a 93 percent drop in sign ups since its launch, and installs declined by 800,000 users, according to data from Sensor Tower, a mobile analytics firm. Following news of the decline in usage, shares for Digital World Acquisition Corp., the special purpose acquisition company that is joining with Trump Media and Technology Group (the company backing Truth Social), declined by over 30 percent, according to Bloomberg….

My reaction? Break out those tiny violins, folks. Smile… onward; ever onward.

Hinderaker Ignores That 2020-21… Was A Very Slow Activity Pandemic/Stay Home Period…

Again John chooses to willfully lie about crime trends in the US — this time, about police injuries and deaths.

He claims the increase in officers shot or killed is… essentially Mr. Biden’s, and BLM’s… fault.

To get there he has to ignore that the entire nation mostly stayed home for the last 3/4ths of 2020 — and slowly restarted — by mid-2021.

His purported “reasoning skills” fall apart, when he needs a wedge issue. Like now.

It is very likely that everyone staying home dropped all sorts of “public” crime rates. That they are returning to normal levels, here in 2022 is most likely due to increased outdoor activity nation-wide.

In fact, the data from about 2010 to 2019 directly contradicts John’s supposition.

But oddly, he didn’t even look it up — or check Google, on that.

What a malignant moron.

Out.

[U] How Tangerine-Appointed USDC Judge Nichols Ignored Thirteen (13!) Decisions Going The Other Way: Courtesy of EmptyWheel…

Last evening, I promised to more fully explain all of this, but EmptyWheel has done a so much better job of it, in more precise terms, please just go read all of her, here — on it. In the upcoming appeal, Judge Nichols should expect that the case will be reversed and remanded, and he will need to grapple with these thirteen (13) decisions — before he can try to get back to his non-reasoned result.

But actually, I expect that at least ten of these thirteen cases, below. . . will lead to. . . a possible Ginni Thomas indictment — and perhaps, a Tangerine indictment, and sooner than the end of 2022. Onward.
