“Ongoing Vendetta”?! Hinderaker Is Fanning The Flames — Of Insurrectionist “Proud Boy” Violence.

Hinderaker called the FBI’s warrant service, at Mar-A-Lago, a “vendetta” against Tangerine, on Australian TV last night.

Aussies are, as a rule, smarter — and less prone to lock-step buffoonery than the US GQP, so I don’t worry too much, about the effects of his stupidly un-American remarks, down under.

But again — if or when FBI agents here state-side are threatened, or God forbid, injured or killed by the increasingly violent Q-branch of Trump’s shock troops… it will be on John’s head as well.

He’s an entirely lost soul.

Out.

Hinderaker Now Daily Reminds Us: He Hasn’t Understood Any Supremes’ Ruling — In Over 20 Years.

Overnight, John openly suggests he’s never read (or even heard about!) the last two decades of Supremes’ opinions, at least as they pertain to race, promotions and employment.

It’s okay, Hinderaker. Do buck up.

There’s still time to correct… your wrong-headed, last century views of the law.

Read this one, called Fisher v. Univ. of Texas…. Or… this one, among dozens of others.

If, that is… your mind is NOT so far gone to pot, that the English on the pages here and here (among other cases)… is effectively rendered as a set of foreign hieroglyphs now… to your aged, and in-decline faculties.

Cheers.

After Over Two Years Of Relatively-Quiet Labor Relations, The USW Local (#10-86) And Merck Are Again Going Before An ALJ At The NLRB…

For over a dozen years now (thus the throw-back masthead, centered below, this morning!), we covered the various strikes, votes and lock-outs — at Merck’s West Point (Lancaster, PA) facility, where the USW represents some 2,000 workers, we were told. There have been other problems at the Riverside / Cherokee facility, as of last year, but…

The West Point facility had all gone relatively quiet, just a few years back when a new four year contract was signed (and then another three year extension was approved).

But now, as of August 1, 2022 — there is a new charge under the NLRA, that Merck management is denying at least a few union members the right of fair representation, and arguments over super-seniority provisions for certain members, in that contract:

…Continuing Case No. 04-CB-300462. . .

Charge: 8(b)(1)(A) Duty of Fair Representation…

Location: Lansdale, PA…

Region Assigned: Region 04, Philadelphia, Pennsylvania….

Now you know — but the story of this year may well be… the renewed rise — of fair bargaining power, by organized labor. Onward, smiling into the temperate mid-August sunshine, here….

The Legacy Of Prof. Eugene Parker (U. of C.) Will Reach Forward, Over The Centuries Now… NASA’s Solar Mission, At Four Years On…

Yes, she is (and call me… antiquated, if you like!) a thing of… unwasted grace. Strong, lithe and very speedy. Her brains, and communication — through the inky-black silence of space — are jaw slacking, as well… so, there you have it… smile!

And with solar max approaching, she will next month zip through the upper atmosphere of the Sun, in the most extreme “weather” there — in over a decade. That will be her sixth plunge into what Sweet Will called the undiscovered country… where no other craft has ever been — and lived to tell of it.

I also want to highlight the 60 years Prof. Parker spent, night after long night… studying solar phenomena… so as to merit being the only then-living human to ever have a craft named for him. Here’s to the U. of C.’s vision, in supporting his work for all those decades. And this craft, bearing his name — will ensure his legacy now stretches. . . into several future centuries. Here’s the latest, from NASA:

…The spacecraft’s stellar performance has opened the door for the team to optimize the amount of science returned from the mission.

“Our telecommunications links are more robust than our… predictions, allowing us to downlink at higher bit rates,” said Kinnison. “As a result, the scientists have been able to collect and downlink about three times more data than planned before launch. This means we’re able to study the Sun in more detail during each encounter but also greatly increase science return when we’re farther away. It also means we can collect data in special circumstances like Venus flybys, well beyond our basic science objectives.”

Over the course of the mission, Parker has sent back roughly 2.8 terabytes of scientific data, approximately equivalent to the amount of data in 200 hours of 4K video. Scientists worldwide will use this data for years to come to develop a better understanding of the Sun’s effects on Earth and our solar system….

Next month, Parker will complete its 13th perihelion, its closest approach to the Sun in this orbit. During that encounter, it will fly through the Sun’s upper atmosphere, the corona, for the sixth time….

Off now, to get ready for a two year old baby grrl’s party, and a rainbow cake, this fine sunny afternoon… smile.

Hinderaker’s “Thoughts” — On Hard-Right Australian Tee-Vee: So Stupid, They Could Give You Brain Cancer…

I think the entirety of his… is self refuting, as he copiously documents his own unfamiliarity with felony search warrants, and the execution mechanics of the same, under federal criminal law… that all he says… is at best… laughable.

So I will just laugh — at him. And the feckless Murdoch affiliates that put him on Tee Vee down under.

Sheesh.

Scott Lamely Hopes Andy McCarthy’s Take Buttresses His Own Insipid One… It. Does. Not.

I do not intend to spend many electrons on what a guy who thinks the US president is a king… thinks.

US Presidents are… pretty much the opposite of kings. [We actually held a little tea party / set of skirmishes… to resolve that… it was in the Hartford Courant, and such.]

Anyhoo — just because this guy McCarthy is the favored establishment GOP talking head on matters criminal… means very little — in fact, perhaps less than zero, even if he is not a Trump fan. [He’s not.]

His stepping off point is that he (in direct opposition to the Supremes) thinks the president is bound by nearly no “ordinary” law. But 18 USC § 793 was written specifically to apply to… yep… presidents.

It has never been challenged as unconstitutional, primarily because we the people… never had need of it — to use it against any current- or former- president, for stealing nuclear weapons secrets. [That statement alone refutes all either or both of these two (plus John Hinderaker and Steve Hayward) wrote — or will ever… write, in opposition.]

Thus, assuming that 18 USC § 793 is constitutional (it is, else-wise no traitorous, corrupt president could ever be reined in), all of McCarthy’s remaining claims amount to just sound and fury, signifying… nothing.

McCarthy is right about one thing, though — any salient documents recovered by these subpeonas and/or warrants, WILL be evidence in both the J6 matters, and Thomas Barrack’s September 2022 felony trial. Stay tuned.

There is noting Tangerine (or Barrack) can do about that.

See ya’ Scottie.

In Space Science — As In All Of Life — With Time, Comes… More Learning. More… Betelgeuse Wisdom.

On and off for three years or so, we’ve discussed the poetic possibility that we might soon see a second celestial object in the night skies here on Earth — almost as bright as our own full moon. That was a possibility (last in 2020) when some Hubble images and data suggested that the truly immense star on Orion’s shoulder might be about to go… supernova.

But later arriving measurements… suggest it was just a giant sun-storm. [Truly giantic — like engulfing the plane of the orbit of Mercury in our solar system (were we there) in just the inner-most rings of the observed ejection.] This event — the Betelgeuse SME — blasted off roughly 400 billion times as much mass as a typical solar flare here in our system, from our sun. Here’s the latest data, from NASA, and as imaged at right:

…[We’ve received] new spectroscopic and imaging data from the STELLA robotic observatory, the Fred L. Whipple Observatory’s Tillinghast Reflector Echelle Spectrograph (TRES), NASA’s Solar Terrestrial Relations Observatory spacecraft (STEREO-A), NASA’s Hubble Space Telescope, and the American Association of Variable Star Observers (AAVSO). Dupree emphasizes that the Hubble data was pivotal to helping sort out the mystery.

“We’ve never before seen a huge mass ejection of the surface of a star. We are left with something going on that we don’t completely understand. It’s a totally new phenomenon that we can observe directly and resolve surface details with Hubble. We’re watching stellar evolution in real time.”

The titanic outburst in 2019 was possibly caused by a convective plume, more than a million miles across, bubbling up from deep inside the star. It produced shocks and pulsations that blasted off the chunk of the photosphere leaving the star with a large cool surface area under the dust cloud that was produced by the cooling piece of photosphere. Betelgeuse is now struggling to recover from this injury….

Again… with time, the luminous… becomes… clear. Even star-sized injuries… heal. Travel well… but travel light, one and all. Dinner out, up next — under the stars, with dear old friends. Smile.

Yet Another Federal Court Rules That Tangerine Has Acted “In Bad Faith” — As President.

Last week, we mentioned that Trump’s campaign was trying to escape a putative class action in Manhattan, brought on behalf of all people who signed NDAs while at 1600 Penn., in any capacity. That purported escape… will fail — he could not have forced people (we as taxpayers were effectively paying) to stay mum about truthful problems they saw in his time at 1600 Penn.

But we write to note that he is likely to owe millions in damages, on top of opposing attorneys’ fees — since the court has already ruled that he acted “in bad faith” in threatening people, and actually suing people on the NDAs — to shut them up — while he was still president. Our money paid for those people. And he is again — as found by explicit federal court order — a bad faith actor:

…[T]his Court has already found that “the Campaign’s past efforts to enforce the non-disclosure and non-disparagement provisions demonstrate that it is not operating in good faith to protect what it has identified as legitimate interests….” Nor should it be trusted to act in good faith now with regard to the selfsame agreements….

The former President is well aware of the Campaign NDAs at issue in this case, and is likely also aware of his power to enforce the NDA. On August 31, 2019, he tweeted, “I am currently suing various people for violating their confidentiality agreements….”

Plaintiffs do applaud the Campaign’s implicit recognition that the NDAs are invalid and certainly support any efforts to reach an early resolution of the case. Plaintiffs have previously suggested stipulations and a settlement that would resolve such issues, but the Campaign has rejected Plaintiffs’ efforts. Accordingly, Plaintiffs would respectfully request a conference with the Court, at which the options for resolution or at least narrowing of the few remaining issues could be addressed.

Plaintiffs therefore respectfully request that the Campaign’s request to be allowed to bring a second motion to dismiss be denied, and respectfully request a conference with the Court with the goal of narrowing or resolving the remaining issues in this lawsuit….</font color

Now you know — this guy is a pure cancer, on American notions of ordered liberty.

Onward — to a fun night out, under the stars, on a restaurant veranda, with dear friends…. smiling.

Hinderaker Claims “It’s All Politics” — And “It Will Blow Over…” NOPE.

Ahem. Part one of the problem here is that Hinderaker, and Hayward and Johnson don’t even understand what is going on with the Trump Espionage Act Violations Search Warrant of earlier this week Part two… is that to the extent they do, Scott, John and Steve have now lied… about it. [Yawn… nuthin’ new, there, though — in truth.]

Under 18 USC § 793, the most important section charged in the warrant application, the president alone cannot declassify any top secret documents, of the kind we understand were in the eleven or so boxes marked “Top Secret”, in the basement at Mar-A-Lago (there were around 20 in total).

So, boys, comparisons to HRC are laughable, on this score — she was never even considering keeping them. She acid washed her copies of them (according to your own frothy right pundits), when she left State. And she answered numerous Congressional Committees for days on end about that, and Benghazi….

Has Trump done anything under oath, on any topic, ever — related to any of these matters… except to take the Fifth? Nope. He hasn’t. And over 400 times, at that.

So… the water just keeps running over this dam, on at least eight distinct fronts, as to which John finally (albeit obliquely) admits… the Tangerine brand has been “blackened” by all of this. John’s own memorable (if outdated and racially problematic)… turn of phrase.

So — let us be clear: to make this warrant application stick, the FBI likely has mustered a sh!t-ton of hard evidence, reviewed by a USDC Judge and found compelling… including likely the video-feeds it already has, from that basement — under a prior subpoena.

But no, the boys think it all just a tempest in a small political teapot. So let me put it in political terms they can understand: the tide has turned. Look at the polling on R v. D in generic Congressional races for this November:

…In our average of polls of the generic congressional ballot,
Democrats currently lead Republicans by 0.2 points (43.9 percent to 43.7 percent). A week ago, Republicans and Democrats were roughly tied (44.2 percent to 44.2 percent). At this time last month, voters preferred Republicans by 2.0 points (45.1 percent to 43.1 percent)
….

Yep — the GQP’s supposed lead… is G O N E. Perhaps these three stooges get (at least) that. [And there is nothing improper about any DoJ “getting their man”… on strong evidence — as here.]

Cheers boys. Another blue tsunami is breaking, about two miles off-shore, for a glassy ride — in November. Grin.

[U: Unsealed By Court ORDER — Copy Below!] Classic Steve Hayward DIS-Information Campaign: Not “Launch Codes”, Moron.

UPDATED @ 3:45 pm EDT — it includes the Espionage Act (18 USC § 793 — that is Docket No. 17, unsealed). Tangerine is… essentially… COOKED.

This silly cha-cha worked reasonably well for the boys, with the Mueller Report: have a flak (Billie Barr) release a redacted summary memo, that COMPLETELY mis-states the gravamen of the actual findings.

Get the frothy right pundits to scream loudly, day and night — until the rice field is… carpet bombed — with the lies.

But not this time.

Steve Hayward Scott Johnson argues these were launch codes. No reliable source said that. The sources said classified “nuclear weapons documents”.

And… significantly… Thomas Barrack is set to go to trial in Brooklyn (facing what will effectively be life in prison, if he gets a decade on the felonies, at age 76), in about six weeks… for working in secret with the UAE, to elevate that kingdom, over the Saudis and others, in official policies of Tangerine’s. And Jared just got $2 billion from the Saud family.

It is reasonably likely that Trump has/had some documents (classified originals) that turned up as copies in the Barrack indictment deliverables. And much the same, with Jared, and the 1.6.21 DoJ interviews he voluntarily gave.

One need not even stretch to assume Tangerine would be offering our secrets, perhaps for sale even, from the basement of Mar-A-Lago.

To sum up: this is unlikely to be about simple launch codes. It IS likely to be about how, when, where and in what ways… nukes are assembled, quality-tested and deployed by the US.

Maybe even a fool-proof how to on how to build a dirty bomb, and get away clean from an urban area.

But let’s see what the warrant actually lists, under 18 USC § 793.

Out.
