Trumpian Lunacy “Leaps Off The Page”: His Filing To Block Warrant Affidavit Unsealing, Even Redacted…

It is clearly a frothy, angry political manifesto, not a proper legal filing / document — of any sort. Certainly not worthy of the federal courthouse (in my opinion).

Yet the half-truths, deceptive omissions, and the outright lies… found within likely imperil each of the three lawyers whose names appear at the end of it.

In a felony matter such as this, intentionally misstating the factual evidence already in the public record… might well be grounds for disbarment. It is thought, correctly, prejudicial to the “without fear or favor” administration of justice.

I offer the link here, solely to keep a complete (if pungent) public record.

But my assessment is that it is highly likely, when the government offers its redacted versions of the warrant affidavit(s), Trump’s request will be mooted. He. Is. Just. Too. Late.

He didn’t bother to file, or show up last week — but he posted on social media, to millions — complaining about it all, in near real time, as the hearings last week unfolded.

He well knew that the facts would out, if he did formally appear, and he wanted to keep his false narrative alive for as long as possible — so he hoped the able Magistrate would keep it all sealed. That didn’t happen because the fourth estate rightly showed up. Sweet.

So now… he is almost certain to be indicted by early fall. Again, sweet.

Hinderaker’s “Darling” Gov., In The Dakotas… Found Likely To have Committed Ethical Violations. Charming.

John has long pushed her as a 2028 GOP ticket-topper for 1600 Penn.

Seems that train has run off the rails.

…A South Dakota ethics board on Monday said it found sufficient information that Gov. Kristi Noem may have “engaged in misconduct” when she intervened in her daughter’s application for a real estate appraiser license that it could take action against her.

The three retired judges on the Government Accountability Board determined that “appropriate action” could be taken against Noem, though it didn’t specify the action….

None of these GQP grifters and con-women… can seem to avoid… lawless action. This time, it was a threat that may… lead to a censure, and bar from higher office — inside the state.

Could. Not. Happen. To. A. Nicer. Lady.

Out — laughing at Hinderaker — again.

Trump Can’t Find A Competent Criminal Lawyer In Miami?!

Tangerine still hasn’t moved to oppose unsealing the redacted portions of the affidavits, from the search warrant of two weeks ago now.

That is likely because… no one capable… wants anything to do with his endlessly lying obstructions. Lawyers not infrequently go to jail themselves, in felony matters, if they knowingly offer false testimony into a federal court.

Tangerine’s stock in trade… is falsities.

So — while he claims he is going to file a “major motion” (sounds more like a… constipated, days-old and hardened… no. 2!)… he is running out of time. By later this week, the government will have submitted its proposed redactions (latest full opinion and order in Miami here).

The redacted version might be public the next morning. And that will be… devastating to Tangerine’s false narrative on it all. Will he find a locally admitted Florida shyster — to take on, and file, his specious motion? We shall see.

Do stay tuned.

Well. Trump Was Deposed, In NYSD Case, About Stealing “Electric Avenue”. But He Will Not/Cannot Explain… Who Might Know Anything. Vexatious Deposition Tactics.

Not surprising. But it is plainly bad faith, under the federal rules of civil procedure to have the president of an entity come to an hours long deposition, without preparing. To testify under oath that he isn’t a “responsible officer”, and he “doesn’t know” who might be — even though the entity is called “Trump for President 2020.”

It is also bad faith, not to disclose that the entity was dissolved about a year prior — likely right after Mr. Grant served it papers, in this suit. Here is the letter requesting an extension, to get Dan Scavino… properly served a subpoena:

…There have been two previous extensions for Defendants to locate and produce a corporate representative of Donald J. Trump For President, Inc., pursuant to Federal Rule of Civil Procedure 30(b)(6), which were so ordered by the Court on June 14 (ECF Doc. No. 67) and July 13, 2022 (ECF Doc. No. 69).

The extensions both followed President Trump’s deposition, which occurred on June 9, 2022. [It is clear from the context, here that Tangerine himself said he did not know who would be a qualified representative of his own organization.]

On August 16, 2022, for the first time, Defendants represented that they would not be able to locate a corporate representative to testify on behalf of the Company and thus would not be producing a 30(b)(6) witness or witnesses to respond to Plaintiff’s deposition notice (a copy of which is attached hereto as Exhibit 1). Then, on August 18, 2022, Defendants disclosed that the Company dissolved in October of 2021….

Given these recent developments, Plaintiffs seek a 45 day extension to serve a subpoena on Dan Scavino, the former deputy chief of staff under President Trump’s administration and social media director for the Trump campaign. Mr. Scavino is reported to have frequently authored and/or reviewed Mr. Trump’s tweets and Defendants have represented that Mr. Scavino had a role in the alleged tweet containing the infringing video. Defendants have also represented that Mr. Scavino was not employed by the Company. Plaintiffs have requested Mr. Scavino’s last known address from Defendants and Defendants have responded by providing Plaintiffs with Mr. Scavino’s attorney’s contact information….

Now you know. What a wise-guy / mob-boss approach he takes… to everything. Anyone who would vote for him now… is purely voting for… mob rule. Ugly.

But I remain very comfortable about the mid-terms, and yet another blue wave in the Senate / Congressional races. Grin.

This Time, Amazon Angles For Home-Health Services Provider (Signify)… After Seeking Primary Care Providers (OneMedical).

Not terribly surprising, as we had previously mentioned that the company’s 1.5 million (soon to be unionized?) workers will likely demand and get comprehensive health benefits — including a generous alternate site care benefit/rights. So — we also expect Amazon is likely to experiment on its own “captive” workforce, as to what is most cost effective / profitable, in delivery of health services. And we expect it is going to do so./. via these piece-meal acquisitions.

Here is the succint MartketWatch summary of the WSJ story.

…Shares of Signify Health Inc. (SGFY, -2.44%) rose 37% in premarket trade Monday, after the Wall Street Journal said that Amazon.com Inc. (AMZN, -2.86%) is among the bidders for the the home-health services provider. Signify is for sale in an auction that could value it at more than $8 billion, the paper reported, citing people familiar with the matter….

Bids are due around Labor Day, according to the people, but it is always possible an eager bidder could strike a deal before then. Other interested parties include CVS Health Corp. (CVS, +0.40%), UnitedHealth Group Inc. (UNH, +0.57%) and one other unnamed corporate buyer. Signify shares have gained 49% in the year to date, while the S&P 500 has fallen 11%….

Now you know — onward, grinning — out into the mid-August sunshine. Annual physical tomorrow… feeling crazy healthy!

Sad To See A Mind, So Completely In Decline… Hinderaker

John Hinderaker… is a sad shadow of what he once was — just even ten years ago.

The decade of Obama was… particularly unkind to him. His mind… completely… lost its way.

It is one thing to disagree in good faith, on policies… but during the latter part of the second Obama term, Hinderaker… simply slipped into race- and gender- based tropes / hate.

He forgot that conservatism was rooted in individualism, and that “mind your business” was its key tenant.

The real conservatives STILL tell people not to fret about what others do in the privacy of their own adult lives, at home.

So it is especially… sad, that under DeSantis’ / Tangerine’s version of xtain-fascism, Hinderaker and Co. adopt the view that they alone should be able to decide (for all of us!) whether it is okay for someone to dress a certain way, or put on make-up — or to choose not to. Hinderaker would say (now, in his twilight years) that it is his, and DeSantis/Trump’s business to regulate, legislate, and ultimately… criminalize. Damn.

He has… gone… senile — and malevolently… so.

Out.

A Rare Dissenting Opinion — On One Of NASA’s Mission Plans — And Goals.

As the Blue Angels prepare to strafe the lakefront (at Mach 1.1) here in a few hours… at the Air and Water Show… I want to register a rare dissenting opinion, about a NASA mission sequence. I do not mean for this to ring in on an unpatriotic note, but the truth is… we have already put boots on the Moon. We have very little reason to do so anew now. The science there is pretty well-vetted.

And, most importantly, this will not be a meaningful stepping stone to humans on Mars in the near term. [I likewise question the wisdom of humans on Mars.] Nothing in the Artemis series will solve the space radiation / insulation dangers a crewed mission to Mars will face.

And, it is clear that we don’t have the engineered / practical science solution (yet), to fully eliminate that long term radiation danger — for as much as three months out and three months back — without Earth’s magnetosphere as a shielding protective blanket, such as the ISS enjoys.

Regular readers know I love the science of space discoveries — but in truth, Artemis to the Moon grew out of a prior administration’s foolish dream… of people on Mars by 2024. And we can use that money in so many more worthy ways. So many more promising science missions, that these. And we are learning almost all there is to learn on Mars, with our proven robotic mission sequences. [And robots won’t die of cancer — from radiation in the years-long journey.] In any event, here are the sites, as proposed by NASA, for a human crewed moon landing.

…[T]he agency has identified 13 candidate landing regions near the lunar South Pole. Each region contains multiple potential landing sites for Artemis III, which will be the first of the Artemis missions to bring crew to the lunar surface, including the first woman to set foot on the Moon.

“Selecting these regions means we are one giant leap closer to returning humans to the Moon for the first time since Apollo,” said Mark Kirasich, deputy associate administrator for the Artemis Campaign Development Division at NASA Headquarters in Washington. “When we do, it will be unlike any mission that’s come before as astronauts venture into dark areas previously unexplored by humans and lay the groundwork for future long-term stays….”

We are better than this: we need not “conquer Mars, by boot-falls“. That is my supposition. I would ask that my friends at the agency and in Congress, take a hard look at the relative science benefits versus other worthy programs — like these, we mentioned yesterday. Fund them all.

Onward, grinning — to perhaps (if the weather holds) bike down along the lake path — to see the Blue Angels at 3 pm, at North Avenue Beach.

NASA Will Fund “Next Round” Of Study For Four Missions — Then Ultimately Choose Two, For 2026 Or 2027 Launch

The future (it is often said) will belong to… science. And what we learn from it.

This, despite small portions of the electorate being both anti-science, and against lawful order. [Tangerine has promised to oppose the release of the warrant affidavits, in court filings next week in Florida. That ought to be… stultifying. No competent lawyer wants to represent him.]

Even so, we will choose to hope that those forces lose their voices, and their local elections, and we will press on — to a future bounded only by what we may learn to be. . . the truth. Here’s the latest, from Space.com:

…The two Medium Explorer teams will each receive $3 million for a nine-month mission concept study. These are:

▲ UltraViolet EXplorer (UVEX). The mission would survey the whole sky in ultraviolet light to provide new insights into galaxy evolution and the lifecycle of stars. The spacecraft would seek to capture light from the explosion that follows a burst of gravitational waves caused by merging neutron stars, as well as study massive stars and stellar explosions. The principal investigator is Fiona Harrison at Caltech in Pasadena, California.

▲ Survey and Time-domain Astrophysical Research Explorer (STAR-X). The spacecraft would use sensitive wide-field X-ray and ultraviolet telescopes to study supernova explosions and active galaxies. Deep X-ray surveys would map hot gas trapped in distant clusters of galaxies. Combined with infrared observations from NASA’s upcoming Roman Space Telescope, these observations would trace how massive clusters of galaxies built up over cosmic history. The principal investigator is William Zhang at NASA’s Goddard Space Flight Center in Greenbelt, Maryland.

The two Mission of Opportunity teams will each receive $750,000 to conduct their own nine-month concept study. These are:

▲ Moon Burst Energetics All-sky Monitor (MoonBEAM). The spacecraft would operate in the so-called halo orbit between Earth and the moon, meaning it would be able to see almost the whole sky at any time, watching for bursts of high-energy gamma rays from distant cosmic explosions. MoonBEAM would then rapidly alert other telescopes so they can study the source. The principal investigator is Chiumun Michelle Hui at NASA’s Marshall Space Flight Center in Huntsville, Alabama.

▲ A LargE Area burst Polarimeter (LEAP). LEAP would be mounted on the International Space Station to study gamma-ray bursts from the energetic jets launched during the formation of black holes after the explosive death of a massive star, or in the merger of objects such as neutron stars, and black holes. The principal investigator is Mark McConnell at the University of New Hampshire in Durham.

The costs for medium explorer missions are capped at $300 million each, excluding the cost of launch. NASA Mission of Opportunity costs are capped at $80 million each….

Now you know — it is indeed a bright, science filled future ahead… even as GOP operatives (and incredibly, some candidates running for higher offices) call for violent attacks upon the agents of the IRS, FBI and US Marshals. These people… are insane.

Scott Johnson: Understands… No Law — Or, More Likely, LIES About It: Private Property / TX Border

Welp. The senile old whyte guy collective is at it, again.

This time the malevolent idiot Scott Johnson tries to tell us that — contrary to literally… centuries of Texas state real property law, private property owners are NOT allowed to unlock their OWN private property gates, if the same is within 100 yards of a national border.

This is purely for the jingoists.

It may even be a form of protected speech / protest, against Gov. Abbott grabbing asylum seekers, and taking them over 2,000 miles away from their hearing situs, and dropping them penniless — in DC, Nashville and NYC.

If Johnson won’t call out that lawlessness — or this, a Texas Natl. Guard unit padlocking a private gate, on private property… I do wonder… are the mediocre old whyte boys at Powerline… in fact latter-day Confederacy operatives? That may be their ultimate aim — Civil War 2.0.

Damnation, boys. Grow up — stand for America — not the old Confederate states.

More New “Bio-Bucks” Collaborations — Perhaps As Much As $3.5 Billion For ORNA Therapeutics — From Merck Research…

It seems that vaccines are a likely ultimate target for this R&D collaboration.

Only two mRNA vaccines have been approved by FDA as COVID-19 vaccines, neither of which use circular RNA (or “o” RNA). As we’ve previously reported, Merck has teamed up with Moderna on mRNA-related projects, including a now multi-billion collaboration on the possibilities of cancer vaccines, among others. But this would be a wholly-new foray (and approach), one that might reach $3.5 billion in bio-bucks, if all milestones are met. Here’s the latest:

…Merck has entered a collaboration with circular RNA company Orna Therapeutics to develop several programs, including vaccines and therapeutics for infectious diseases and oncology. Merck will pay Orna $150 million up front and invest $100 million of equity in Orna’s series B financing round, which initially closed Aug. 16 with $221 million. Orna could receive up to $3.5 billion in milestone payments.

The company’s technology stems from research done at the Massachusetts Institute of Technology by cofounder Alex Wesselhoeft and molecular geneticist Daniel G. Anderson, who is on Orna’s board of directors. To make circular RNA, which the firm has dubbed oRNA, Orna brings together the two ends of a strand of linear messenger RNA (mRNA)….

Now you know. Onward, grinning into a flawless August afternoon… with a possible lil’ grrrl sleepova’ Sat. night… be excellent to one another!
