Pfizer Once Again Returns To Doubling Merck, In Quarterly Lobby Spending — Q3 2023 Trendlines…

It is time again, to line out the things that Big Pharma is plying Congress on.

And reversing the anomaly from last quarter, Pfizer — at about 40% larger than Merck — is once again nearly doubling it, in lobby spending. [Last quarter, for the first time since well before about 2002, Merck outspent Pfizer, despite the smaller size. It had to do with lobbying on the silly lawsuit it had filed.] Here are the Pfizer areas of concern, and a side by side graphic. A full four way trend graphic will appear here, tomorrow:

…Drug Pricing, Support of Biosimilars, Out-of-Pocket Costs, Rebate Reform, Vaccine Infrastructure/ Excise Tax, PDUFA, Pandemic Preparedness/PAHPA. . . .

Medicare Part D, Rebate Reform- PBMs, Out-Of-Pocket Costs, Government negotiation on Medicare, Antimicrobial Resistance, March-In….

Comprehensive Corporate Tax Reform, International Tax Reform, OECD Profit Allocation, U.S. Manufacturing Credits, Build Back Better Act, Minimum Tax….

International Supply Chain/Buy America, Harmonize International Drug Manufacturing Standards, Global Access to Medicines, Foreign Market Access Issues (including IPR)….

TRIPS Waiver, Bayh-Dole March-in-Rights, General IP Issues….

Now you know — we will cover Merck, Amgen and Amazon later in the coming week. Onward, into the sunshine.

EmptyWheel Has The New GOP… Dead To Rights. Do Go Read It.

As we’ve noted in the last several posts — on the GOP’s existential crisis, the nation sees… an emperor with no clothes. Absolutely… none.

Not a stitch. And EmptyWheel has it all down cold, as we mentioned about Scott Johnson’s claims on the non-scandal. But I’ll let her lay it out for you, as she’s able to tie it tightly to the overall failures of the GOP to clean its own house — now, for over two decades:

…James Comer is waving his dripping dead frog around — a personal check for a personal loan between brothers — like he just found a $2 billion bribe from Saudi Arabia.

This is… fucking insane.

Republicans can’t keep their own caucus together. They may not be able to keep government open.

And all the while, James Comer is there writhing around about about easily debunked conspiracy theories about a personal loan….

Yup. That is it — in a nutshell. Damn, boys.

Paul Seems To Think This GOP… Stands For… Something: It. Clearly. DOESN’T.

Overnight, Mirengoff took another GOP operative to task for saying the new GOP is doing a terrible job of articulating what it is POSITIVELY in support of — as ideas, policies and/or visions.

In sum, the thesis is that GOP is now only the party of “no”.

Paul feels this is not a valid criticism — as (in his estimation) there is much the new GOP agrees on.

Yet everything he lists… is a “no” item. Stop this. End that. Exclude these people. Have no Speaker for months and months.

Not once does he point to a “thousand points of light” type-vision for America.

And so… Paul proves that critique correct.

I might go just a lil’ way more down the road… and say the new GOP is dead as a brand.

Unless the KKK is a brand, the GOP has… none.

Out.

Perhaps The Most Durable, High-Tech Spacecraft Ever Launched (Certainly, The Most Distant!): Voyager, Getting More Software Updates…

As the legacy graphic at right indicates, the twin Voyagers have vastly exceeded even NASA’s lofty near-half-century expectations.

But bit by bit, the smallest propellant tubes are developing deposits, much like clogged arteries.

So in the next decade or so (if nothing is done), they will no longer be able to adjust attitude, to keep the dish pointed toward Earth. This latest software package upload will let the pointing algorithm be more fault-tolerant, and thus fire the thrusters less often.

And with that small adjustment, Voyager 1 and 2 may see even longer mission extensions. Here’s the latest, from NASA:

…Engineers for NASA’s Voyager mission are taking steps to help make sure both spacecraft, launched in 1977, continue to explore interstellar space for years to come….

One effort addresses fuel residue that seems to be accumulating inside narrow tubes in some of the thrusters on the spacecraft. The thrusters are used to keep each spacecraft’s antenna pointed at Earth. This type of buildup has been observed in a handful of other spacecraft.

The team is also uploading a software patch to prevent the recurrence of a glitch that arose on Voyager 1 last year. Engineers resolved the glitch, and the patch is intended to prevent the issue from occurring again in Voyager 1 or arising in its twin, Voyager 2….

In 2022, the onboard computer that orients the Voyager 1 spacecraft with Earth began to send back garbled status reports, despite otherwise continuing to operate normally. It took mission engineers months to pinpoint the issue. The attitude articulation and control system (AACS) was misdirecting commands, writing them into the computer memory instead of carrying them out. One of those missed commands wound up garbling the AACS status report before it could reach engineers on the ground.

The team determined the AACS had entered into an incorrect mode; however, they couldn’t determine the cause and thus aren’t sure if the issue could arise again. The software patch should prevent that. . . .

Now you know, on a fun Science Saturday night with the baby girls! Onward…. smiling.

Hinderaker Talks Very Brave BS, To Israel — For A Near-Septuagenarian — Sitting In A Minnesota Suburb…

This is such a quintessential Hinderaker piece of belchery.

In it, as a non-Jew — living in the bucolic upper midwest, in a multi-million dollar mansion, and almost daily bloviating over hard-right radio / podcasts… John Hinderaker tells the people of Israel that they must exterminate anyone ever even “associated” with Hamas.

Hmmm… where have we heard rhetoric like that… before?

Oh. Right.

Goebbels, Göring and Himmler.

Lest anyone misunderstand, here are John’s exact words — in context: “So, yes, Israel must kill everyone who is associated with Hamas in any way, so that that organization will never rise again….”

The general point here is not just that Hinderaker is wrong on policy — he is — but ALSO that he has exactly ZERO skin in the game 4,000 miles off, on the other side of the globe.

So as people seek, in good will, to defuse the war, and minimize civilian casualties… Hinderaker calls for more ruthless bloodshed, this time by the IDF. He does so, willfully ignoring that both sides have been killing each other into the tens of thousands of bodies, for well over three thousand years, in the region. [And just about six years ago, the IDF slaughtered 183 Gazans, women and children mostly, by firing automatic rifles, through chain link fences, at trapped targets. It was an intentional terror act.]

To be clear — no one is “in the right” here. At least, everyone is wrong, insofar as the killing of women and children goes, on either side.

So shut up John. You are a bitter, doddering old malign… fool.

And a blood-thirsty one — with none of your own children or grandchildren — or even property… in harm’s way, it is easy for you to call for… more murders.

Mastermind, On The Loose: Steve Bannon’s “We Build A Wall” Charity Fraud Cases Lead To ANOTHER Five Year Sentence, Beginning Monday… No Surprise.

The time has now long passed, for faux outrage (in the GOP) about the Trumpian levels of corruption, on so many, many fronts — but I want to remind the public that, as Mr. Timothy Shea was sentenced to over five years in federal prison, yesterday… as he departed, Donald Trump granted a pardon to the mastermind, one Steve Bannon. A pardon, for nothing more than old style mafioso behavior — likely stealing over $3 million, in the life of the scam. [Just one of my backgrounders on it, here.]

From the irrepressible InnerCityPress publisher/reporter (via live-blog then), in the SDNY courtrooms — a great public service (do consider donating, at that link, if you value independent journalism):

…This Court has previously sentenced Mr. Kolfage to 51 months, and Mr. Badolato to 36 months. Both have medical problems that Mr. Shea doesn’t. I sentence Mr. Shea to 63 months in prison.

Defense: We ask for surrender in 90 days. AUSA: The current standard is 45 days. . . .

Judge: The surrender date is October 23.

Defense: We’d like a prison in Colorado….

Judge: We are adjourned….

Now you know. Disgusting, that Tangerine pardoned Steve Bannon out of what was straight up consumer fraud — stealing charity funds. There is simply nothing “fake” about stealing from moms and pops… all to NOT build a wall.

How much (in total, over the years 2017 to 2021) did Bannon pocket, for himself? We will now likely never know.

Onward, just the same.

Scott Thinks… Something… About A Biden Son… While Ignoring That TWO Of Tangerine’s Lawyers… Flipped.

So… Denial Ain’t Just A River In Egypt.

This morning, Scott thinks some tiny development in the Hunter matter is a world-beater. Yawn.

If he did crimes, he will be punished. But the silly idea here (on Johnson’s part) is that a guy who never held office at any level… and is at best, a troubled son of a politician… is not really news at all — or at best… scant news.

OTOH, despite Hinderaker’s not-so brave whistling past the boneyard earlier this week… now TWO of Trump’s own Georgia election lawyers have turned state’s evidence, and taken plea deals, to avoid long jail stretches. And they will be disbarred, when the dust settles.

Kenneth Cheesebro, in particular, will both be required to — and actually can spill a lot of beans, as to Tangerine’s demands — since he was “inner circle”. Maybe Sidney Powell less so, but both together strongly suggest that Trump hisself… is going down for felonies in Georgia (where even if he were to be elected again, he has zero pardon power).

So… this is all just a distraction, by Johnson — no surprise there.

Out.

Given The Alito / Thomas / Gorsuch Dissent, It Seems There Is A 6-3 Majority At The Supremes… To Strike Louisiana Judge Doughty’s Deeply Befuddled Opinion.

Reading tea leaves from grants of cert. is often dangerous.

But here, only three justices dissented from stopping old Doughty in his tracks. His opinion was unhinged — and he never established that anyone in his courtroom had standing to even initiate a case, in Monroe Louisiana.

So — reading the tea leaves in reverse, it would seem there are at least six votes to wipe his opinion off the books, as well as its twice modified cousin in the Fifth Circuit.

We shall see — but this is… pretty encouraging news, for the Supremes’ Spring of 2024 term. Onward.

The Sixth Cir. Dissent Has It Down Correctly, In Tennessee Trans Care Ban Case… On To The Supremes.

The Sixth Circuit entered an opinion ordering the lower courts (Tennessee and Kentucky) to reconsider their original rulings, in view of a 2-1 decision that says “this is a new area — tread lightly, as to underage humans“.

That is singularly unhelpful. This outcome is certain to be appealed to the Supremes now. But do go read the dissent (starting at page 42). It is where the likely 5-4 majority of the Supremes will ultimately land, Condor predicts:

…Much of the [majority]’s analysis focused on the rights and role of parents in American society as caretakers for their children. “[A] state is not without constitutional control over parental discretion in dealing with children when their physical or mental health is jeopardized,” but “[t]he statist notion that governmental power should supersede parental authority in all cases because some parents abuse and neglect children is repugnant to American tradition.” Parham, 442 U.S. at 603. “Simply because the decision of a parent . . . involves risks does not automatically transfer the power to make that decision from the parents to some agency or officer of the state. The same characterizations can be made for a tonsillectomy, appendectomy, or other medical procedure.” Id. Ultimately, “[p]arents can and must make those judgments.” Id. (emphasis added).

Applying these principles, Tennessee’s and Kentucky’s statutes plainly intrude on parental autonomy in violation of Parent Plaintiffs’ substantive due-process rights. Although this case presents issues at the center of political controversies, the legal analysis on this point is rather simple. “Parents possess a fundamental right to make decisions concerning the medical care of their children.” Kanuszewski, 927 F.3d at 418. Tennessee’s and Kentucky’s statutes prohibit parents from deciding whether medical treatment otherwise available to adults is appropriate for their minor children. And given that the statutes fail intermediate scrutiny, they fail strict scrutiny as well….

[…A] state cannot simply deem a treatment harmful to children without support in reality and thereby deprive parents of the right to make medical decisions on their children’s behalf. Allowing the state to do so is tantamount to saying there is no fundamental right. Cf. Schall, 467 U.S. at 265 (“[I]f parental control falters, the State must play its part as parens patriae.” (emphasis added)); Prince, 321 U.S. at 166 (noting “that the custody, care and nurture of the child reside first in the parents” (emphasis added)). A fundamental right backed up by strict scrutiny demands more. “Of course [judges] are not scientists, but neither may [they] abandon the field when government officials… infringe a constitutionally protected liberty. The whole point of [heightened] scrutiny is to test the government’s assertions.” S. Bay United Pentecostal Church v. Newsom, 141 S. Ct. 716, 718 (2021) (statement of Gorsuch, J.). Our nation’s constitutional history teaches that, when a treatment option remains otherwise available to the public, legislatures should not decide whether that treatment is right or wrong for minor children; parents should make these decisions….

So it goes. On to the nation’s highest court. Have a good weekend, one and all — despite this rather patrician, doctrinaire setback at the Sixth Circuit. Onward.

Mirengoff Thinks “Concern Troll” — About Democrats And Israel… Is A “Good Look”?!

Well… somehow Paul Mirengoff this afternoon manages to write ten paragraphs (also to distract from multiple Trump lawyers — now pleading guilty and flipping — down in Georgia) on the idea that despite the fact that both Democrats and Republicans, within limits, back Israel — as a general rule… Mirengoff thinks the Biden speech of last night could cost him 2024.

That is simply… too precious for words.

This is what’s left, after MAGA has decimated the GOP brand entirely: argue that Democratic party regulars will in 2024 skew so far left, that they would prefer to back Iran and Hamas.

Not likely, Paulie.

But sure — whatever relieves your cold sweats at night.

Hilarious. You guys are a pure comedy show. A… clown show, in fact.
