Hinderaker Crows — About Likely Russian Dis-Information (And He Knows It!) — Lacking A Patriot’s Sense.

Let us pretend for a sec., that these emails aren’t complete forgeries — let us pretend, hoping beyond any reason to hope — that they are genuine. [But they are not.]

But let’s pretend — then… fair point, John. So….

Okay. Lover-ly, Hinderaker — now do… Trump himself [golf club graft ($1.1 million!), by booking his traveling team in — and USG pays the bill], Ivanka (Chinese-trademarked voting machines, an exclusive arrangement made by pull from USG), Don Jr. (bilking the campaign funds, and charging for state business — that isn’t), Melania (at a minimum, kickbacks on the $26 million in the inaugural party spending)… and that’s before we look into the $500 million plus in loans Trump owes (likely to Russian state-connected finance arms), and Jared’s 666 Bldg. bailout / lending — also likely Russian backed.

This is… REALLY a good game, John — shall we play on?

Or, have you had enough?

Out.

The McCloskeys’ Object Lesson: When Lawyers Act To Represent Themselves — Idiocy Often Ensues…

It seems, via the superseding indictment just released in St. Louis, that the McCloskeys (both litigious lawyers) after the events that led to the first felony indictments, intentionally tampered with evidence — by mis-assembling the pistol she had (here, in the satirical guise of Trump!) trigger-fingered, at right — and then, the so-altered gun would presumably be argued not to be capable of being an offense, since it was not capable of… wait for it! actually firing a bullet, though one was certainly in the chamber, that night.

That’s all… just preciously… stupid.

And as irony would have it — it makes out yet another felony — for tampering / obstruction of justice.

Yep — and we should note — for the record, these are just two of the people… the GOP had make official appearances, at their nominating convention.

That alone should make a vote for any GOP candidate… a non-starter.

[Of course, we may safely predict that Hinderaker will be along shortly — to argue some nonsense second amendment “right” to tamper with firearm evidence. Insane, that.]

History Will Prove Justice Sotomayor’s Dissent Here… Was The Better View: Census “Pause” Case.

What this latest SCOTUS case teaches, in the main — is that our government, specifically, and exclusively under Trump and Wilbur Ross… lies to us, and lies to the courts — almost as a rule. In the courts below, the government swore it could not meet its deadline. Now it swears to the Supremes that it can — if it stops counting right now. But it could spend some money to both keep counting, and tabulate results already in. That it will not do — because it will show more brown and black people live in the USA — and they count for US House seats, just like all other people do, under the apportionment clause of our 14th Amendment. Charming.

Of course, A Biden administration may order a re-canvassing — to correct this. We shall see. [Backgrounder, here.] Do read it all. It is both wise and judicially modest — unlike the grant of the stay:

…The Government now claims that this Court’s immediate intervention is necessary because, absent a stay, the Bureau will not be able to meet the December 31 statutory deadline for reporting census results to the President. This representation is contrary to the Government’s repeated assertions to the courts below that it could not meet the statutory deadline under any circumstances. Moreover, meeting the deadline at the expense of the accuracy of the census is not a cost worth paying, especially when the Government has failed to show why it could not bear the lesser cost of expending more resources to meet the deadline or continuing its prior efforts to seek an extension from Congress. This Court normally does not grant extraordinary relief on such a painfully disproportionate balance of harms….

So it goes — about twenty more days — do vote. Onward.

A Dose… Of “Hope-Ium?!” Or… Opium, More Probably.

John posted a particularly crazy purported electoral map, last night.

I note it only for the fact that it lists states in the Trump column where Trump is no longer bothering to run a ground game, or spend on TV ads.

In sum, in states like Minnesota, where Trump has conceded he will lose.

So… smoke that opium pipe all you like, GOOPers… he’s all done, except for the shouting.

Out.

Aside From All Else — Melania’s “Contracts Case” Lacks… Teeth / Enforceability.

We’ve discussed previously what a gi-normous misuse of government assets this suit by the DOJ is.

After dinner and dessert — and a lil’ more time to reflect, with a frosty root beer… I will note that it is an even bigger waste of our taxpayer funds, than I first imagined… because there is no “there, there…” in this supposed suit (for a private contract breach). In sum, on the substance of Melania’s claim… there is in fact, no substance.

Let me explain: it is highly likely that the Trump family (Melania included) has long used these NDA agreements, as private parties — to control the narrative about them. Several chunks of this agreement (Sections VI, VIII and X, among others) read very much like a private wealthy party NDA, for “domestic” and other ancillary help.

I will thus conjecture that Ms. Wolkoff had previously signed one (when Melania was just a NYC socialite) — and that it took until August of 2017 (eight months into Trump’s term) to work out an agreeable written “government duties / negotiated” version, that addressed the all differences between being a party planner for a private New York City socialite, and the duties of (among others) avoiding waste — imposed on a FLOTUS, now on our payroll.

To that end, given that there are reports of very inefficient spending patterns in the book, at left — and given the likely futility of reporting these goings-on to any acolyte White House Counsel (as we’ve seen with numerous others), or the ethics officer in the White House — it is very likely that this book is also a form of federally protected whistle-blowing, under common law.

In this regard, I would note specifically Melania’s callous attitude about the welfare of innocent babies being ripped from their parents at the border (on audio tape, no less!) — in a clear violation of enforceable treaties we’ve signed, and the international protocol on refugees, as well as several congressional federal statutes — and dozens of federal rules.

Stacked against this, is a claim that a “contract” forces silence — on an no-doubt aghast fellow citizen — in which the second part of Section V of the contract itself acknowledges that federal law on responsible, open government cannot be trumped by a mere contract secrecy clause (in Section IV and elsewhere). No, the secrecy provision, if enforceable at all — must yield to public policy on open government. This is our own money — not theirs any longer, you see.

That Bill Barr and Melania style this as a government services contract… is in fact fatal to its enforceability. The “contract” itself amounts to an uncompleted gift — of services. As such it cannot be enforced at law — that is, a promise for which no money was exchanged — a pure gratuity… is no contract, at all. So, the idea that truthful reporting about Melania should cause a forfeiture, and a civil suit, by the government… based on promises made as gifts (i.e., not enforceable at law) is patently… silly.

So Bill Barr DOUBLY wastes our money, here. Charming. I’m out, now — fuming.

The Melania / Stephanie Contract Is…So Much Swiss Cheese — And All Rather… Droll!

Updated @ 6: PM EDT: Here is the disputed contract in full, such as it is (and do read yellow highlights at right — click to enlarge). It is plainly a “amended continuation” of a private one, previously signed, before Melania became first lady. [So it may well not be enforceable at all, as it lacks consideration.]

But even if Bill Barr clears that hurdle, it also contains the “gratuitous government services” language — which means, per force, there was no consideration to support the NDA portion — and as a matter of law (as the contract itself recites) it cannot “trump” (heh!) the federal rules which allow federal reporting of waste, abuse of power, or other malfeasance — in violation of applicable federal rules and laws. In sum — Melania and Bill Barr, her flunkie lose — long before we get to whether it is “a gross waste of public funds” for the DoJ to handle a private civil contract dispute for Melania (Hint: it is — and thus, another violation). End update.

See next post.

Namaste….

There Is ZERO Reason That The DoJ Should Act As Melania’s Private Attorney. ZERO.

I’m just getting to reading the pleadings now, more in a sec — but Bill Barr has simply lost his tiny mind. [And may now lose his… law license.]

The purported confidentiality agreement (claimed breached) predates her time at 1600 Penn.; and is beteween two private citizens (in no way impinging state secrets); and Melania — whatever else one might say about her — she… simply has no formal (Senate confirmed) role in the Cabinet (no distraction / privilege argument).

Condor predicts that Simon & Schuster will prevail here — since to the extent that Melania uses the Do J as her lawyers, she is per force saying the matter relates to her “government service” (whatever she might think that might mean) — and so there cannot be any gag (outside of pure state secrets), as to her government service. We the people, under Amendment, First, are certainly entitled to know what she did or did not do, in our names — even if a private party decides to breach a contract to tell us. I absolutely “don’t care (do you!?)”. . . what happens to these book profits….

…The Justice Department on Tuesday sued the author of a book about first lady Melania Trump, claiming the writer violated a non-disclosure agreement….

If, on the other hand, she wants to argue that she was a private citizen whose NDA, as a private person, was breached — she absolutely cannot have the Billy Barr / Kowtowing DoJ represent her, for no cost. Absolutely not.

Yet here we are — we, the taxpayers are providing her with civil lawsuit legal talent, in a tell-all book scrap?! Color me… disgusted. Utterly corrupt — but entirely… unsurprising, for these crooks.

Live Blogging Far Right Domestic Terrorists’ First Hearing In Michigan…

We will get underway as soon as all the appearances are entered on the record… on hold now.

✿ Defense attorneys have appeared. We are underway.

✿ Two defendants will have their preliminary hearing Friday; all others to go forward now.

✿ FBI Special Agent Trask testifying now… nine years as FBI — 15 years in law enforcement.

✿ He is the affiant in the charging documents. FBI monitored these defendants since January 2020.

✿ Dublin, Ohio meeting occurred — multiple self-titled “militias” from five different states met. Not real militias at all.

✿ Discussed both Michigan and Virginia Governors — and threats of harm — due to “lock-down” orders to ameliorate COVID-19.

✿ Most of these defendants were at the Michigan state capitol armed protests. [These are far right terror groups.]

✿ Wanted to storm the capitol with 200 men, kidnap the Michigan Governor, and then put her “on trial” — before 2020 election….

✿ By mid-August the plan had evolved to attacking her at her lake side vacation home, and blowing up a bridge that provides access to it… the group was scouting and surveying the sites, creating maps, timing police distance/response times…. [This is truly… jaw-slackingly terror-inducing.]

That’s all I needed to hear — end of the live blogging. These are not left wing groups, you congenital liar, John Hinderaker.

Do refresh often as content will be added in chunks.

[Updated @ 3 PM EDT: Power Alley Return] Moderna Rising, As JNJ Halts Clinical Trial To Conduct Safety Review: COVID-19 Vaccine Candidates Update

UPDATED: For its part, Lilly, while not testing a vaccine — but rather a therapeutic — has paused its trial, due to a safety concern, here this afternoon. This literally is bleeding edge research, folks. Onward. Ever onward — end, update.

JNJ’s stock will be fine in a few sessions, as it reported robust Q3 earnings, and raised full-year guidance, this morning. But as proof of the idea that one should not take the word of a congenital liar and former reality TV show host(!) as gospel — in complext matters of vaccine bio-science… there was apparently at least one serious adverse event in one arm of the JNJ candidate trial. [Moderna has moved up for four days running now, and is above $75, pre-market, again — but still remains a bit shy of the all-time high of $95. Now you know. Grin.]

There have been some hiccups in co-leader Pfizer’s trials as well (and sadly, Pfizer is the company most visibly being pressured by the village idiot residing at 1600 Penn — to rush things). So far, though — it looks like Moderna’s mRNA candidate is largely free of the concerns seen in the non-mRNA (old school) vaccine candidates. But to be clear, we have quite a distance to traverse yet, through a dark and tangled wood. And we will let sound science (not some moron) call the ball, on the finisher. Here’s a bit:

…Johnson & Johnson’s late-stage coronavirus vaccine was paused after a participant reported an “adverse event” about 36 hours earlier, the company’s chief financial officer said Tuesday.

The pause will allow the data and safety monitoring board to thoroughly investigate the unexplained illness, CFO Joseph Wolk said in an interview….

“What it should also do is reassure the public that every scientific, medical and ethical standard is being applied here,” Wolk added.

J&J confirmed to STAT News on Monday that a “pausing rule” in the 60,000-patient clinical trial had been met, but declined to provide further details on the patient….

We are quite optimistic that a safe, effective vaccine will emerge, but it may not emerge until the end of Q1 2021. Do not listen to the Tangerine Must-o-lini. Onward, smiling at the corners of my eyes, from behind a very stylish mask….

Perhaps Old Drumpf Might Have Mentioned The People Who Were Here For A Minimum Of 1,000 Years Before Columbus.

John Hinderaker is at it again, complaining that recognizing indigenous, tens of centuries’ long standing non-white culture and history is threatening, in some vague way to the American way of ordered liberty. Nothing could be further from the truth.

Far from it — we are truly the people of “e pluribus unum“. Of many, we become… one.

Soon enough… Trump’s own insecurities — in his own manifest, and manifold… inadequacies — and John’s too… will be set aside, so that under new leadership we may celebrate all the peoples that are America.

Soon — 23 days or so from now.

Bu-bye, Hinderaker.
