Defaming The Victim Of One’s Alleged Rape… Is In No Manner Part Of The “Job” Of Presidenting: USDC Court

Not even remotely a surprising conclusion.

What is surprising (to me at least)… is that Bill Barr had to be ordered by a United States District Court not to try such a brazenly unlawful waste of the taxpayers’ money. He clearly knows better.

Here are all of the 61 well reasoned pages, out of Manhattan’s USDC Judge Lewis Kaplan, and a bit of the juicier parts:

…The holding that the president of the United States is not an “employee of the Government,” as Congress defined that term, is sufficient to resolve the government’s motion. But the parties have briefed also the question of whether, if the president is a government employee, President Trump’s allegedly defamatory statements were made within the scope of his employment. And it is appropriate to address that issue as well in order to avoid the possibility of an unnecessary remand should a higher court disagree on the “employee” question….

[E]xcept for the payment of a salary, not one of the five factors relied upon by D.C. courts to determine whether a master-servant relationship exists is satisfied here. The president is selected by the electoral college, not the executive branch or any part of it. The government does not have the power to discharge him in any circumstances, unless one construes impeachment, or removal under the Twenty-Fifth Amendment, as forms of discharge. And while commenting on the operation of government is part of the regular business of the United States, commenting on sexual assault allegations unrelated to the operation of government is not….

The “decisive” factor, however, is the fourth and most important: control. The president is the chief executive of the United States government. No one, inside or outside of the executive branch, has “the power to control the [president’s] conduct.” That conclusion is found in the first sentence of the president’s job description. Under Article II of the Constitution, “[t]he executive Power shall be vested in a President of the United States of America.”112 As Justice Scalia explained in his famous dissent in Morrison v. Olson, 113 “this does not mean some of the executive power, but all of the executive power….”

No one [need] give him permission to speak. No one can require him to say, or not to say, anything at all. No one has the authority to cut him off. And the statements he makes, as well as the topics he discusses, are entirely of his own choosing.

These points are clearer still on the facts of this case. No one even arguably directed or controlled President Trump when he commented on the plaintiff’s accusation, which had nothing to do with the official business of government, that he raped her decades before he took office. And no one had the ability to control him. President Trump is not a “servant” controlled by a “master” within the meaning of the District of Columbia’s scope of employment doctrine. Thus, his allegedly defamatory statements were not “actuated, at least in part, by a purpose to further the master’s business.” He was not acting within the scope of his employment when he made them, and [Bill Barr’s] certification under the Westfall Act was erroneous….

Only about seven more days of this insanity, now. What a completely… matched pair of little piggies.

What They’ve Purported To Do Under Cover Of Darkness… Will Have Consequences, In The Cold Winter’s Light — In January 2021…

In what can only be fairly seen as ignoring Senate rules, the Judiciary Committee voted without a quorum (and without a single Democratic vote, or presence) to bring her nomination to the floor last week.

Then, eight days before a presidential election, the Senate (highly likely to no longer be in Republican hands in nine days) voted to confirm her — without a single Democratic vote.

The president then held a ceremony after 9 PM EDT on a Monday night. Today, just seven days from Election Day, the Chief will swear her in.

It is not unreasonable to expect that federal litigation about the invalidity of her appointment will begin in January 2021. There never was a quorum to advance her nomination to the floor.

It is also reasonable to expect that (since there are no fixed laws about the make-up or size of the Court) once the Senate and the White House are in Democratic hands, the Court may properly be expanded to 13 seats, if for no other reason than to undo the effect of the Republican rule-breakings described above. The 13 could be reversed, if a final non-appealable order is entered, in the above-contemplated federal litigation — ruling her a nullity, and her seat invalidly taken — and all decisions that break 5-4 with her vote in the majority, from now to then… overturned.

And then Mr. Biden could appoint that ninth seat.

Or, if the Republicans would prefer, Mr. Biden may simply appoint four new Justices — to reach a 7-6 split. Decisions… bring… consequences. And it will be time to set the record straight — in nine days. Out.

Next, In Flores Immigrants’ Notice of Legal Rights Proceedings…

The next hearing will be on December 4, 2020 — but lots of reports are due before then.

Here’s the full four page order, and a bit:

…The ICE Juvenile Coordinator shall also provide:

i. Specific explanations for the continued detention of each minor detained at an FRC beyond 20 days, which the Juvenile Coordinator will review with the Independent Monitor, Andrea Ordin, before submitting the updated report to the Court;

ii. Specific updates on the status of the FRC licensing regulations in the State of Texas and Defendants’ efforts to obtain licensing of the FRCs in Texas, if available; and

iii. Updates on the implementation of the new ICE COVID-19 protocol, particularly in light of the Independent Monitor’s forthcoming interim report on “safe and sanitary” conditions at the FRCs….

It is unfathomable that Trump has treated the children this way, for four long years.

Unfathomable — dragging his feet, on clearly correct federal court orders to remediate this — and we should bear in mind that Sarah Fabian has enabled it, at each step.

[U: 10.27.2020] PA GOP Voting Case Again: Will Supremes “Step In Front Of” The Penn. Supreme Court, Before It Rules? State Level Mail-In Voting

UPDATED: here is the Secretary of State’s well-argued opposition to the below. And here is the Democratic Party’s response opposing the Republican Party move below. End update.

I’ll simply say this — these Republicans are tireless, in the effort to disenfranchise lawful voters.

It seems clear that the GOP is only now, at this late date, realizing that embracing Trump’s hatred and divisiveness has all but guaranteed that the party will never win another national election (and perhaps not all that many local ones!), unless it is dismantled and reformed — to the core. [I’d note that, on the meager GOP merits, when and if we get there, it is hard to see how counting legitimately cast ballots… is in any arguable way a violation of any federal voting rights statute.]

So the now-disgraced party lumbers on — vainly trying to limit the number of valid voters who might cast ballots in each local election (surmising correctly I think that most of the remaining voters, those not yet spoken for, are going to break toward the Democratic approaches to policy). Here is the formal cert. petition, and the motion to once again expedite.

My own view is that this is a matter for the Pennsylvania Supreme Court to decide — a pure creature of state law, only. And the ruling sits squarely on the COVID emergency. It is a one-off.

But we shall see. Just last week, Chief Justice Roberts — a reliable conservative — voted with the liberal wing, that this case should not be expedited. With a four-four tie, the Supremes didn’t accept the case.

Now it is back — and I’d suspect the Chief will vote the same way, again. Even if ACB is sworn in by later this week — I suspect the law will remain, that in the fime of COVID, a mailed ballot, received less than four days after the polls close… given DeJoy’s attempts to dismantle reliable prompt mail delivery (for Trump)… will STILL be counted as a good vote — in the Keystone State.

What Are The Odds That Hinderaker Will Tell The Truth, About The Third Precinct In Minneapolis, NOW?!

During the unrest after George Floyd was murdered, Hinderaker repeatedly (incorrectly it turns out) blamed only BLM and whatever he thought “antifa” meant, for the burning of the Third Precinct station house.

John’s hometown paper reports that according to the FBI’s unsealed indictments, the AK-47 / AR-15 style assault rifle was being fired by a Boogaloo Bois “false flag” domestic terrorist, in an effort to start a civil war, thus:

“…In the wake of protests following the May 25 killing of George Floyd, a member of the “Boogaloo Bois” opened fire on Minneapolis Police Third Precinct with an AK-47-style gun and screamed “Justice for Floyd” as he ran away, according to a federal complaint made public Friday.

A sworn affidavit by the FBI underlying the complaint reveals new details about a far-right anti-government group’s coordinated role in the violence that roiled through civil unrest over Floyd’s death while in police custody.

Ivan Harrison Hunter, a 26-year-old from Boerne, Texas, is charged with one count of interstate travel to incite a riot for his alleged role in ramping up violence during the protests in Minneapolis on May 27 and 28. According to charges, Hunter, wearing a skull mask and tactical gear, shot 13 rounds at the south Minneapolis police headquarters while people were inside. He also looted and helped set the building ablaze, according to the complaint, which was filed Monday under seal….”

Not that he’s man enough to offer it, but Hinderaker owes BLM an abject apology. He libeled the group.

Onward, on a cool rainy Friday.

Meg Tirrell / CNBC With The Good News: Gilead’s First Experimental COVID-19 Therapeutic Now Fully FDA Approved

I am a little tardy with this one — but I was distracted last evening, and enjoyed watching Joe Biden run circles around Trump. In any event, Gilead has traded over $66 in the premarket this morning, putting it up nearly seven per cent in two days, due solely to this news.

And as fate would have it, one of the then-still experimental drugs that helped nurse Trump back from respiratory distress during his acute bout of COVID-19 last month [can it only have been three weeks ago?]… is now FDA approved. No word on pricing just yet, out of Gilead. Here’s the bit:

…In May, the FDA granted the drug an emergency use authorization, allowing hospitals and doctors to use it on patients hospitalized with the disease even though the medication had not been formally approved by the agency. The intravenous drug has helped shorten the recovery time of some hospitalized Covid-19 patients. It was one of the drugs used to treat President Donald Trump, who tested positive for the virus earlier this month.

The drug will be used for Covid-19 patients at least 12 years old and requiring hospitalization, Gilead said. Remdesivir is now the first and only fully approved treatment in the U.S. for Covid-19, which has infected more than 41.3 million people worldwide and killed more than 1 million, according to data compiled by Johns Hopkins University….

Onward to another first day delivery (soggy at that!) of the latest Apple handset product — the 12 Pro, arriving by 11 AM CDT, my fed ex ap tells me. Grinning ear to ear, just like eight [at B&D], six, four, and two ago….

Trump Needed A “Knock-Out Flying Mare From The Upper Turn-Buckle” Type Win Tonight.

He didn’t even come close to “staying even”.

To hear Hinderaker tell it, Trump won. I disagree, but the truth is… it doesn’t matter.

Trump simply came up woefully short, on every dimension that matters to ordinary voters.

And other than Joe simply (impossibly) dropping dead at the podium, there was never any chance that Trump could close the yawning gap in his campaign with this debate.

John thinks he still can. Nope. I voted today, at my City Hall. Early. It is over — and for more than 44 million other Americans — the voting is over. He needed to find perhaps 12 million NEW votes tonight — and he turned away almost all remaining independents. He fed the ugly base, only. So he… lost.

Trump has no doubt lost. But the moment he lost this election was (as I clearly said that very night, in response to John’s ever-frothy nonsense)… in the fading half-light of June 1, 2020 — that was the moment he had Bill Barr trample and gas peaceful protesters, to hold a Bible upside down — for a photo opp at a church that had not invited him.

He hasn’t been back there since. No surprise. It is called Black Lives Matter Plaza now.

Get ready for at least eight years of inclusive democracy, John — and note that I didn’t say Democratic Party rule. But it will be that, with Kamala Harris quite possibly stretching it to 12.

Indeed, it will be far more inclusive than Trump’s last four — or those you and your Tea Party / Freedom Caucus / Alt Righter jokers have seen — in decades (going back to Dick Cheney’s early White House), for certain.

You’ll have to learn to live with that.

Cheers.

Proposition: I’ll Trade Hinderaker — Answer For Answer — If He Delivers TRUMP Family ANSWERS.

Funny. Suddenly, John wants to push far away from that purported laptop, with Rudy’s corrupted mitts all over it.

Now he claims a second source for supposed stuff, on the Biden family. Never mind that it comes from a guy locked away in prison, looking to get out early, by offering largely faked “snitch” testimony… let’s just humor old Hinderaker, a moment, shall we?

An offer of a wager: I will trade complete truthful written answers to each of John’s questions about Hunter Biden, if John will commit to the same, on behalf of all Trump family members: Melania, Jared, Don Jr., Eric, Lara and of course… the queen of graft — Ivanka.

Why was she gifted CHINESE patents on everything from voting machines to clothing fabricators, again?

Let’s start — I’ll post mine — you post your list of questions, John.

This will be… droll.

Moderna Likely To Make Emergency Use Filing With FDA In Early December — Might Have Limited “Ring” Vaccination Authority In Early 2021(?)

Step by step — with solid science as the guide. This is incremental good news, and we will keep a weather eye on it all.

[Yesterday, in describing Merck’s prospects for a multi-billion dollar revenue stream for its Prevar 13 competitor vaccine, I said I thought that would only occur after we had a working COVID-19 vaccine, since gathering kids for shots, across the US will first be focused on that coming vaccine. As expected, that may begin in early 2021 now.] From the Tweet announcing Moderna’s enrollment of the last of 30,000 subjects, in its ongoing study, and a bit:

…Moderna will determine whether to submit a dossier to FDA requesting Emergency Use Authorization based on an assessment of whether the potential benefit of the vaccine outweighs the potential risks once the 2 months of median safety follow-up have accrued.

The Company separately shared its statement at today’s U.S. Food and Drug Administration (FDA) Vaccines and Related Biological Products Advisory Committee (VRBPAC) meeting.

Moderna worked closely with BARDA and the NIH, including NIAID’s COVID-19 Prevention Network (CoVPN), to conduct the Phase 3 COVE study under Operation Warp Speed. Moderna’s partner PPD (Nasdaq: PPD), a leading global contract research organization providing comprehensive, integrated drug development, laboratory and lifecycle management services, has also been essential to the successful execution to date of the COVE study. PPD also supported the Phase 2 study of mRNA-1273….

Onward, to what promises to be a raucous, largely uninformative debate (from the Trump side) in Music City tonight. So it goes. Twelve days left, give or take.
