On Some Crap Site Called “Daily Wire”, Candace Owens Is Hawking Inferior Quality Active Wear…

It is all wildly-overpriced, in view of the low quality of the goods, and graphics, involved. [And, as irony would have it — it is mostly all made in… China. Preciously grift-ish.]

[No surprise there — consider her “Freedom Phone” episode, as one of many.]

But I write because she seems to prove the adage that “an envious heart cannot be… original.”

You see, she felt it necessary to steal from and/or co-opt the then-sublime BHO 44 2008 campaign trademarked graphics, whole-sale — and make a ham-handed play for “Yes We Can[dace]” as an animating graphic.

I won’t link her clothing site, but you may see it from her Twitter feed. Or, most likely, buy it in some crap-store, inside the building in Nashville, where she tapes her “show.”

She is a sad, bitter and increasingly… irrelevant human.

I’m out now. Be excellent to one another — or, at least… if you cannot be excellent — be original, for one another.

[Power Alley:] We Have Reached TWO 23 Periods Without a New Ebola Case In DRC… 13th Outbreak Is Thus… Over.

This is proof positive that mRNA vaccines… work.

Only six dead in this outbreak, and it is over, as of this week. In 2013-14, pre-vaccine — that total was over 13,000.

Here is the very good news from “Doctors Without Borders” blog postings — (updated from December 9, to December 15 now):

…More than 45 30 days have passed without any further new cases notified since 30 October; the last person was discharged after testing negative for Ebola on 4 November. Among the eight confirmed cases, six people have sadly died….

Definitely more proof that mRNA vaccines… make a vast difference. Smiling; off for the night, now….

Cahill Gordon Is Cutting Away, At Project Veritas’ Order — In NY State Court, By The Day…

This is clearly the “correct, on the law” outcome, as it only took the Supremes 16 elapsed days in the Nixon-era Pentagon Papers case to strike the prior restraint laid down by a trial court judge, there. We are well past that now, in New York’s trial courts (which ironically are called “Supreme” courts, even though they are in fact inferior) — and I think the local Westchester County judge is well aware that this particular prior restraint cannot stand.

Here is that new language, inserted into his order, today, by Cahill Gordon lawyers, appearing for the Times:

…Nothing contained herein shall prohibit The New York Times from interviewing and lawfully obtaining information and material from any Project Veritas attorney or from any Project Veritas officer or from any person designated by Project Veritas as a press representative and from publishing any such information and material so obtained.

Further, nothing contained herein shall prohibit The New York Times from publishing Project Veritas’s attorney-client privileged information or material if such information or material becomes publicly available independent of any action by The New York Times….

Now you know. Project “Veritas” is anything but.

As The US Eclipses 800,000 Deaths, From COVID-19 — We Highlight The OSHA Reply In Cincy’s Sixth Cir.: OSHA May Regulate Vaccine Standards On The Job. Period.

This idea of workplace safety has been top of mind for me, since yesterday morning, when we learned that the six workers killed, at the Amazon facility in Edwardsville, Illinois — as a result of a tornado, and subsequent roof collapse — were prohibited by Amazon rules from having a cell-phone turned on, on the shop floor.

Obviously, had any of them had one — the weather alert beacons, automatically pushed out to all iPhones, with a loud audio warning… might have saved all their lives. [Rather than await a new OSHA rule, obviously Amazon ought to declare that workers may keep phones powered on, but on silent — for safety — during their shifts, in a shirt- or pants- pocket.]

So. . . it seems almost comical to most college educated adults that OSHA need explain to the Sixth Circuit, that no — nowhere in the law (as Texas and Louisiana speciously claim) does a workplace regulation have to cover a hazard “more likely” to occur at work, in order to be Constitutional. That is a creation of pure. . . imagination, by Texas and Louisiana.

Consider steel-toed work boots (an OSHA requirement at construction and mining worksites since the 1950s): the notion that after one’s shift ends, if one were working on one’s car, on a jack — and the jack fails — dropping the car on one’s toes… would that NOT have been properly an OSHA regulation, on workplace standards? Clearly more accidents happen at home than on the job — of this nature. So the states’ arguments in opposition are truly preposterous, here. But let’s read it in 26 pages of well-argued context, from OSHA as of late Friday night:

…The statute independently covers dangers “from new hazards,” 29 U.S.C. § 655(c)(1), and “COVID-19 is a ‘hazard,’” as the State petitioners admit (State.Opp. Mot. 10, 13-14. Some petitioners’ contention (Phillips.Opp.-5) that a “recognized” hazard cannot be “new” overlooks that a hazard must already be “recognized” before regulation is possible and disregards that during the summer 2021, the danger changed meaningfully. Mot.-13-14….

Equally untenable is petitioners’ claim (BST.Opp.-13) that OSHA “must find that the harm is more likely to occur [in workplaces] than in other places.” That limitation appears nowhere in the statutory text. Petitioners cannot derive this constraint (e.g., RNC. Opp.-6) from scattered provisions with generic references to “workplaces” or “employment” that establish nothing more than the undisputed premise that OSHA can regulate hazards that exist in the workplace. E.g., 29 U.S.C. §§ 651(b) (“working conditions”), 655(d) (“places of employment”). OSHA can address dangers in the workplace, and Congress did not limit OSHA’s authority to petitioners’ atextual and undefined subset of dangers. Mot.-14, 15-16. OSHA regulations have long addressed hazards that exist both inside and outside the workplace, including rules for sanitation and fire prevention, electrical safety, and exit routes [Ed. Note: think here, of the candle factory in Kentucky, or the Amazon facility in Edwardsville, Illinois]. Mot.-15-16; 29 C.F.R. §§ 1910.33-.37 (exit routes), 1910.302-.305 (electrical safety); see Amic.OSHA.Admin.-13-14….

Petitioners’ unsubstantiated allegations… make little sense on their own terms. There is nothing pretextual about an agency whose mission is to protect the health and safety of workers taking critical steps to establish a workplace health standard just because those steps are consistent with a broader effort to combat a pandemic that affects individuals inside and outside the workplace. White House statements about the dangers and spread of COVID-19 and the ability of vaccines to address these concerns are fully consistent with OSHA’s analysis and supporting record — which describe the scientific consensus that COVID-19 is highly transmissible, has significant morbidity and mortality, and can be addressed through several means including vaccination…

So it is that very soon, OSHA will prevail. And I’ll say again that Texas is no mythical “Brigadoon” kingdom… free to disappear into the mists, when it doesn’t favor real science on protecting workers in the state from known (800,000+ dead, now) hazards. Either it is a state of the union — or it is not. It is time to choose: one of 50, or… one, of one?

[U: Sunday — An Added Dose Of Lunacy] US Rep. Paul Gosar Thinks Sedition Is Within The Peoples’ “Patriotism” When Some Of Them Don’t Like A Lawful Election Outcome. Poppycock.

We note it (at right, again from the social network of choice for racists and secessionists!) primarily for the record, as he will be seen — by the longer lens of history — as no different, in substance than the southern white Congressmen who committed sedition, on their way to creating the Confederate States, to keep slavery.

That is who this dude is, at base. And we will mark him down, as a throwback to the Neanderthals, of yore: his fore-brain is clearly under-developed.

Or, perhaps more likely — he knows better, but is simply evil — and an insurrectionist himself, at heart. He swore an oath to uphold the Constitution, when he entered Congress… he had defiled that oath. He should be removed from his seat, lawfully.

UPDATED, with more — on Sunday afternoon (see at left — click to enlarge).

Either way, he belongs in… the dustbin of US history.

Out.

Tangerine… Confirms Tonight, His Party Is Just… The KKK-Light.

Baby-T says tonight on Gab and Parler that he doesn’t think his brand of racism will ever win another election, if federal voting rights laws are re-introduced and re-inforced.

He’s… right.

It is gratifying to see the thing call itself by… its name.

That is all.

We will beat him in 2022 by proxy, in the Senate and House races, and we will beat him straight up, in 2024 — if these morons are stupid enough to try and run him again.

[I will also note in passing that Hinderaker opined this evening that much of the 1960s music was positive and upbeat (he was referencing the death of Michael Nesmith). True. He meant it as a criticism of most harder edge rap, or “protest rap” if you prefer — of today.

But without Marvin Gaye and Eddy Starr and Barry McGuire and Nina Simone… John Hinderaker would have no reason to live — no reason to write, and no lucrative post-law ultra-hard right “public interest” lobbying firm “think” tank to run.] So he should just say “thank you, 1960s — you saved my life — I would be long-dead, about 55 years ago” (having been drafted), and then shot dead, in some forlorn rice paddy in Vietnam, Laos or Cambodia… had it not been for the above artists.

In sum, these artists saved his life, by causing in no small measure, the end of our involvement in Vietnam. So, he ought to just… sit down.

Supremes: Texas SB-8 Is Likely Unconstitutional On Its Face — But A Trial Record Needed, Say Five Supremes… Sent Back To Federal Trial Courts, In Texas.

I am immensely frustrated by the Gorsuch wing here (with Thomas in-, or out-), in that the four/five of them seem to acknowledge that this “law” will not survive, when the courts reach the merits, as even they are willing to let the challengers sue state actors, on it.

And so, it is hard to imagine that these state actors in Texas can offer any factual theory (in a trial court) as to why this is within their state level powers — and not contra-indicated by the federal Constitutional rights accorded to all inside our borders, nation wide. Women cannot be made “second class citizens” in Texas alone, unlike any other state in our union.

That is to say, Texas is not “Brigadoon” — existing as a mythical kingdom, in some here… and then gone, vanishing mists, of fantasy… as to the rest of our proud nation.

It is a state. And it must obey the Constitution’s commands, or decide to leave this union. But the defenders of Texas SB-8 will now take a month or more, before it returns to the Supremes, for an “on the merits”… likely invalidation. For women in dire circumstances in the Longhorn state, that ridiculous delay (as the wise Latina Justice Sotomayor correctly observes) is just… awful. Just get on with it — and do what you are required, SCOTUS — from her dissent, then — a bit:

…For nearly three months, the Texas Legislature has substantially suspended a constitutional guarantee: a pregnant woman’s right to control her own body. See Roe v. Wade, 410 U. S. 113 (1973); Planned Parenthood of Southeastern Pa. v. Casey, 505 U. S. 833 (1992).

In open defiance of this Court’s precedents, Texas enacted Senate Bill 8 (S.B. 8), which bans abortion starting approximately six weeks after a woman’s last menstrual period, well before the point of fetal viability. Since S. B. 8 went into effect on September 1, 2021, the law has threatened abortion care providers with the prospect of essentially unlimited suits for damages, brought anywhere in Texas by private bounty hunters, for taking any action to assist women in exercising their constitutional right to choose. The chilling effect has been near total, depriving pregnant women in Texas of virtually all opportunity to seek abortion care within their home State after their sixth week of pregnancy. Some women have vindicated their rights by traveling out of State. For the many women who are unable to do so, their only alternatives are to carry unwanted pregnancies to term or attempt self-induced abortions outside of the medical system.

The Court should have put an end to this madness months ago….

Indeed. This has taken on an Orwellian tone — with Thomas categorically refusing to enforce well-settled precedents that he disfavors (as a purely political, non law-related matter) — and thus (further) risk the integrity of the high court. Onward.

International Cooperation — On Space Science: Japan Shares 10% Of Its Hayabusa-2 Asteroid Sample With NASA | AMES…

This is heart-warming news, in a world with nation-states more than occasionally at each others’ throats.

Science — and scientists — keep each others’ best interests in mind. They. . . share. Communicate, and renew old friendships, in that way.

So it is — as Hanukkah ends, and Christmas-time gift-giving arrives, that JAXA has shared a goodly portion of the primordial rocks and dust, from its Hayabusa-2 mission of 2018:

…Just as fossils hold clues to the history of life, asteroids hold clues to the history of the solar system. Rare samples collected from the surface of an asteroid by NASA and its international partners are helping to decipher these clues.

Now, scientists in the Astromaterials Research and Exploration Science (ARES) Division at NASA’s Johnson Space Center in Houston are among those able to study samples retrieved by the Japan Aerospace Exploration Agency’s (JAXA) Hayabusa2 spacecraft and returned to Earth in late 2020.

JAXA is sharing a portion of these samples with NASA, and in exchange, NASA will provide JAXA a percentage of a sample of asteroid Bennu, when the agency’s OSIRIS-REx spacecraft returns to Earth from the space rock in 2023.

NASA received 23 millimeter-sized grains and 4 containers of even finer material from Ryugu — 10 percent of the total collected – from JAXA on Nov. 30. A JAXA official and a JAXA scientist delivered the asteroid fragments to Johnson, meeting with agency team members to complete the sample transfer and receiving training on safe handling procedures for their portion of the OSIRIS-REx samples….

And, as ever — regular readers do know that. . . rocks from the basement of time do fire my… imagination. For under those rocks, in many of the rivers of the mountainous West of my youth… are timeless raindrops — and under those raindrops, are the words… and some of those words… are my words, to you… grin. Go now — and be excellent to one another.

More, In Re Veritas: The “Veritas” Account On Gab.com Is Openly Lying About The Able US Judge Torres’s Oder. Here It Is. In Full.

A minor point, perhaps — but given that it involves the “Veritas” jokers, we have come to expect misrepresentations… of public documents. Of a five page order, these chuckleheads display only a snippet of one page, married to a clip of the last page.

Charming.

The able USDC Judge in Manhattan went out of her way to compliment the able AUSAs in her courtroom, and then said — purely as a matter of deference (to what are very-likely made-up, specious and wholly unrealistic concerns) she would appoint a special master.

The special master will watch the cell phone extraction process — and aid the AUSAs office. Nothing more. Here is that five page order published late today — in full, and in context:

…The Court recognizes, as other courts in this district have concluded, that “the Southern District prosecutors have integrity and decency,” and the filter team alone could conduct the review “with utmost integrity.” In re Search Warrants Executed on April 9, 2018, No. 18 Mag. 3161 (S.D.N.Y. May 2, 2018), ECF No. 38 at 8; see also United States v. Grant, No. 04 Cr. 207, 2004 WL 1171258, at *3 (S.D.N.Y. May 25, 2004). However, the Court determines that the appointment of a special master is warranted here because “it is important that the procedure adopted . . . not only be fair but also appear to be fair.” Stewart, 2002 WL 1300059, at *8. In light of the potential First Amendment concerns that may be implicated by the review of the materials seized from Petitioners, the Court finds that the appointment of a special master will “help[] to protect the public’s confidence in the administration of justice.” Id. Accordingly, the Court appoints the Honorable Barbara S. Jones (retired) as special master (the “Special Master”)….

Nowhere does she suggest, as the Gabbers falsely do, that there is or was any concern with what “Veritas” claimed.

No — she simply is shutting down any argument for an appeal, once the indictment is unsealed, and these morons end up in jail, convicted of crimes, including trying to fence stolen property worth more than $5,000.
