Suddenly… The “Cat Has The Tongues” Of The Powerline Boys…

Do recall that just one week ago, Hinderaker was saying the warrant business was a yawner.

If he still thought that was so, tonight’s Miami filing by Tangerine should have been a “Game. Set. Match” moment — for John to crow about.

S I L E N C E.

Hinderaker clearly knows Tangerine is felony bait, now… so he’s whistling nervously as he walks past the graveyard fences… you love to see it.

So — instead — he posts on… the tragedy of bread lines in Havana, Cuba. [Sure — I don’t want Cubans going hungry… but they’d ALL be far richer, if Baby-T hadn’t reversed the thawing of relations with the island, begun under BHO 44.]

Nope… this warrant business has the GOP mournfully dreading the midterms (behind closed doors) now.

I love it!

Tomorrow’s hearing should be a… Donnybrook!

[U] Team Tangerine Will Apparently Appear At “Kangaroo” Judge Cannon’s Hearing Tomorrow — Unarmed, In A Battle Of Wits…

UPDATED — do go read this flawless piece of satire, that deftly conveys all the missing gravitas… in the Orange Team’s filing. *Chef’s kiss*! [End, update.]

Later this evening, Tangerine’s team filed a turgid 19 page response to the government’s filing of late last night — in anticipation of tomorrow’s likely three ring circus of a “special master” consideration hearing in the federal district court, in Miami.

Fascinatingly, most of Trump’s surrogates have been claiming for days (weeks, even) that Baby-T “magically” de-classified all the documents he held at Mar-A-Lago. Even Trump’s son has said this. But now in about its fourth substantive filing on the matter, it still has not said a word about “declassification”.

Of course, if he had in fact “declassified” these documents (not that that alone would end the inquiry), each of those depicted at above left would have had the obvious protective red and white cover sheets, removed, and the underlying pages stamped “declassified”.

But even such a thorough move, had it occurred (it hasn’t)… would not remove the taint of “national defense information” — as to which it is an independent felony, simply to possess, without clearance, and outside of a secure facility. See, 18 USC § 793(e), under the Espionage Act.

But the Tangerine Team is silent on all of that, because it leads, inexorably to what is a life sentence for Trump, if uttered in a court of law.

You see — he cannot say “DE-classified” without admitting that some were… classified.

And he well-knows some of those… are “national defense” items, over which he has exactly zero power to change status on (even whilst living at 1600 Penn., if acting alone).

So, all of his filings are far more damning (on this aspect) as to his exposures, in their silence, than in anything they actually assert.

And so, tomorrow afternoon, the able US Attorneys will walk into what is clearly a battle of wits (albeit in a likely Kangaroo court), against wholly-unarmed… opponents. Trump will be indicted. Out.

Near Midnight Eastern, The Full DoJ Reply In 22-cv-81294 (USDC SDFL) Was Docketed…

We will discuss this fine 36 page piece of lawyering in the morning, in greater detail. [The exhibits, from which the photo (derived at right), of just a portion of Tangerine’s purloined document hoard is included (on page 18) is here — and… Welp, damn son, that’s… some serious mess.]

But as I wander off, to hear the sheets… chanting my name… sweet and low — but chanting, just the same… I will post this morsel, from the response proper:

…Once in a secure government setting, the FBI conducted a preliminary review of the documents contained in the Redweld envelope. That preliminary document review revealed the following: 38 unique documents bearing classification markings, including 5 documents marked as CONFIDENTIAL, 16 documents marked as SECRET, and 17 documents marked as TOP SECRET.

Further, the FBI agents observed markings reflecting sensitive compartments and dissemination controls. Counsel for the former President offered no explanation as to why boxes of government records, including 38 documents with classification markings, remained at the Premises nearly five months after the production of the Fifteen Boxes and nearly one-and-a-half years after the end of [his] administration….

It is hard to overstate the gravity of these offenses against our national security. And he ACTIVELY, personally, persisted — for over five months, in obstructing… the return of the stolen documents — in obstructing… justice.

G’night, one and all of good will. Tangerine has been roundly… shown the gate, by his betters, on every dimension now. He will be indicted; no doubt. Grin….

Voyager One Is Transmitting Normally Again, From Outside The Heliosphere…

But if one were looking for a sci-fi(-ish) moment (as we earlier mentioned), this finally… might be it.

JPL says that the spacecraft mysteriously started trying to send its telemetry data back through an onboard computer that failed decades ago. [The team long ago decommissioned that errant processor.]

And NASA is not sure why it would have done so, unless something else is affecting its operating software. This however is the official statement; and my bracketed largely fanciful guess, immediately below.

[So, if there were any extra-terrestrial AI machines (of any sort) beaming intermittent radio waves at V’ger… that might manifest by a reboot, to start sending telemetry data via the busted old computer, on board. I’ll admit that this is a very odd way to reveal intelligence to Earth, after-all if the AI is smart enough to reconfigure sixty year old software on the fly, it is certainly smart enough to know that the data stream is being sent home to Earth. That is, why not just beam back directly to Earth “take us to your leader” or some such? Who knows?] Here is the JPL/NASA release, in any event:

…Engineers don’t yet know why the AACS started routing telemetry data to the incorrect computer, but it likely received a faulty command generated by another onboard computer. If that’s the case, it would indicate there is an issue somewhere else on the spacecraft. The team will continue to search for that underlying issue, but they don’t think it is a threat to the long-term health of Voyager 1.

“We’re happy to have the telemetry back,” said Dodd. “We’ll do a full memory readout of the AACS and look at everything it’s been doing. That will help us try to diagnose the problem that caused the telemetry issue in the first place. So we’re cautiously optimistic, but we still have more investigating to do….”

Indeed — I think they… do. Smiling… out, and g’night….

[U] In USDC Judge Aileen “Kangaroo” Cannon’s Miami Courtroom (Where Unserved, But Orange, “Motions” Are Permitted, Apparently), The Government Has Properly Answered, UNDER SEAL.

Updated, late on Tuesday night — a group of former GOP prosecutors has filed an amicus brief in this matter, and here is the money quote — but do read it all:

…Indeed, to allow a former president to use a claim of executive privilege to undermine the work of a current president would undermine the very purpose of executive privilege: to ensure that the Executive Branch can effectively discharge its constitutional powers. U.S. v. Nixon, 418 U.S. 683, 711 (1974) (“[T]o the extent this interest relates to the effective discharge of a President’s powers, it is constitutionally based.”).

In this case, it is clear that the dispositive view of the sitting President is that the seized materials should be provided to the DOJ and the FBI, regardless of any claim of executive privilege by the former President….

This is all very good sport, burying Trump, line by line. End, update.

Well, Merrick Garland’s team is about a paragraph ahead of both “Cocoa Puffs” Cannon, and the Kumquat hued opponent, in this crazy kangaroo court proceeding (perhaps I… repeat myself).

The government noted yesterday that it would file answers, on time, and on target. It also made plain how sensitive candid answers might be.

So, this evening, true to its word, three filings were made in Case No. 22-cv-81294 (SD FL) — under seal.

The former guy… is toast.

It almost won’t matter what those filings say — nor what Crazy Cannon’s court decides to do with them on September 1, 2022 at her hastily scheduled hearing. As we’ve said, all the sister agencies already have the parts of the national defense documents that are not privileged, and they are acting on them. It. Is. Too. Late. [Tangerine waited almost three weeks, in a felony matter, to make any appearance. Bad show, old bean.]

It is highly likely now that an indictment for multiple felonies will be unsealed against the former guy himself… the central question, now is whether it will come before — or after — the midterm elections.

Honestly, either way… the outcome won’t change: he is going to wear a jumper of the same color as his faked perma-tan spray: orange… eventually. Out, grinning.

Q.: Did Alabama “Botch” The Execution Of Joe Nathan James. Jr. — Causing Three Hours Of… Torture?

The state laws in Alabama impose a broad, thick blanket of State secrecy — on executions. That alone should give moral people pause, about the true nature of what happens in a death chamber, there.

The triangulation of what all is known however, strongly suggests that in searching for a usable vein, to inject the lethal concoctions, up to three hours may have passed. There were long cut lines, on both arms, at the autopsy.

And there were other indications that he was chemically-immobilized — but felt it all. That is, they paralyzed him, and then took their time about killing him. At a minimum, ABC’s closing quote rings… in my ears — as does Justice Blackmun’s, at right. Again. Sigh.

“…This execution is Exhibit A as to why execution secrecy laws are intolerable,” Dunham wrote in an email to the AP. “The public is entitled to know what went on here — and what goes on in all Alabama executions — from the instant the execution team begins the process of physically preparing the prisoner for the lethal injection until the moment the prisoner dies….”

This is beneath us, as a supposedly civilized nation. Way… beneath us.

Merck Has Released Its Latest Corporate Responsibility Report, This Morning…

Certainly, the company could be doing significantly more — in many areas — but to my eye, the report shows remarkable progress, particularly since the bad old days of the early 2000s.

In the 1960s to 1970s, Merck was consistently the most admired company in America. . . then, first under Reagan, then under Bush… all of that was replaced with means and methods to charge the top end of whatever “the market would bear” on many fronts. And it was in large part due to regulatory capture, by free market forces — that allowed unbridled price inflation on life saving medicines. So Merck just rode along with the loosening regulatory tide. And, not surprisingly, Merck’s reputation fell precipitously in the eyes of most Americans.

However, with the passage of the ACA of 2010, and the ascension of Kenneth Frazier as CEO and Chairman, the arc was bent back toward responsible, ethical and sustainable… growth at Merck.

So, do give the report a once over. I’ll not make any sort of commercial out of this (so I’ll include no details from the report itself), but the truth of it is that this very old-line company — and more than most of its peers, perhaps in the life sciences space, today… had ethical roots, in its leadership.

…George Wilhelm Herman Emanuel Merck (March 29, 1894 to November 9, 1957) was the president of Merck & Co. from 1925 to 1950 and a member of the Merck family….

Now you know. Onward, grinning — as the noose tightens — around a would be (former) Tangerine dictator’s ample, but turkey-skinned… neckline.

So — Tangerine Thinks A False Story, About One Entirely PRIVATE Citizen… Means He Should Get A “Mulligan”, On 2020 LOSS?!

I guess there is only one way… to look at this.

His mind is broken.

He is utterly non-compos-mentos.

This very afternoon, as the filter teams complete the marshalling of the proof — that he personally is guilty of 20 year felonies involving national defense documents… he thinks that some [false] story about a son of a candidate (or his supposed / faked by Russians laptop hard-drive, more precisely), a troubled young man… who has never held public office in his life, was the single biggest reason Tangerine lost by over eight million votes?

He thinks he should just be named president, nunc pro tunc?!

Or at least, get a new election, already this afternoon?! Wow.

Well… anyone who would vote in 2024 for such a… lunatic… will be throwing their vote into the ocean, never to see a return….

Okay. I am definitely cool… with that. Whoever is the Democratic candidate will win by over 13 million votes, in that case.

H I L A R I O U S.

We Wish To Note… A Deeply Tragic Anonymous Passing, In The Brazilian Jungle.

After seeing all his relatives and fellow community members ruthlessly slaughtered, he hid alone — for 26 long years, minimum.

In time, both the isolation, and the demands of surviving in an open jungle… returned him to the Infinite. Here’s that story:

…The last remaining member of an uncontacted indigenous group in Brazil has died, officials say.

The man, whose name was not known, had lived in total isolation for the past 26 years.

He was known as “Man of the Hole” because he dug deep holes, some of which he used to trap animals while others appear to be hiding spaces.

His body was found on 23 August in a hammock outside his straw hut. There were no signs of violence.

He is thought to have died of natural causes at an estimated age of 60.

The man was the last of an indigenous group living in the Tanaru indigenous area in the state of Rondônia, which borders Bolivia.

The majority of his tribe are believed to have been killed as early as the 1970s by ranchers wanting to expand their land….

Be better… to one another.

Ebola Resurfaces — Hard News — In Beni, Kivu, DR Congo…

The single case (so far) showed up last Sunday.

It was fatal, but the woman had co-morbidities. So far, she is the only known case in this outbreak. It is hoped that like the last Congo outbreak, the numbers will remain in low single digits. Here’s the news, from WHO:

…On 21 August 2022, the Ministry of Health (MoH) of the Democratic Republic of the Congo announced that a new laboratory-confirmed case of Ebola Virus Disease (EVD) had been detected in Beni health zone in the province of North Kivu. The case, a 46-year old woman who had co-morbidities, died on 15 August 2022 after being hospitalized for 23 days.

Oropharyngeal secretion samples were taken after death on 15 August 2022 and tested positive for EVD. The body was buried before the EVD results were known. Field investigations are ongoing to identify hospital and community contacts.

The last EVD outbreak in the Democratic Republic of the Congo was in Equateur province and declared over on 4 July 2022….

We will keep the fine people of the DRC in our morning meditations… let this be the end of it. Stay safe, one and all of good will.
