That Coach We Mentioned? Too Busy On The MAGA Paid Political Speaking Circuit — To Even Apply For A “Coaching” Job… Hilarious!

We mentioned this case, and Justice Sotomayor’s fine dissent in late June. Even though the coach was never fired (he declined to apply to renew his year to year teaching assignment, in Washington state, choosing instead to go to Florida)… five of the Supremes, based on mis-statements by lawyers for the coach, deemed him “fired” — and ordered him “reinstated”.

But as this fine Seattle Times piece points out. . . he’s not bothered to apply. See, he is “too busy” speaking at Tangerine and MAGA / X-ian events, for pay to bother with coachin’ young public school boys. In fact, the sense of it is, he’s not teaching or coachin’ anywhere (not even in Florida). Soon enough, though — his appeal, like Tangerine’s — will die out. And his old job won’t have an application, or openings for him. I’m… cool with that:

…In the end, it all was too complicated. The effect of the court’s order is that Bremerton has to reinstate someone who didn’t apply for the job then and doesn’t appear eager for it now. It’s as if the justices wanted to script an ending for a Christian redemption movie. But real life isn’t cooperating….

[And, from the Wise Latina Justice:] …Properly understood, this case is not about the limits on an individual’s ability to engage in private prayer at work. This case is about whether a school district is required to allow one of its employees to incorporate a public, communicative display of the employee’s personal religious beliefs into a school event, where that display is recognizable as part of a longstanding practice of the employee ministering religion to students as the public watched.

A school district is not required to permit such conduct; in fact, the Establishment Clause prohibits it from doing so….

Onward, grinning — looking toward Atlanta, and the Eleventh Circuit, this afternoon….

Only One Thing Matters, About Tomorrow…

In truly hilarious fashion, Tangerine’s (amateur) lawyers laid out some four pages of nonsense tonight — their wish list, if you will — in the hopes that Judge Cannon will dance to their tune, in the lower court, tomorrow at 2 pm at Ft. Pierce.

But the Eleventh Circuit has a hearing at Noon, in Atlanta — on the government’s request for an emergency stay of Judge Cannon’s orders. It is likely to stop her in her tracks.

So — as the government says by footnote, tonight — that is the controlling hearing. The first one of the day:

…The government applied to the Eleventh Circuit for a stay last week and Plaintiff’s response is due tomorrow at noon, before the Master’s preliminary conference. If the Eleventh Circuit stays Judge Cannon’s order with respect to documents with classification markings, then the Special Master will not review the documents with classification markings. If the Eleventh Circuit does not stay the review of the documents with classification markings, the government will propose a way forward….

That is some solid confidence — from the government lawyers. They think that the Eleventh Circuit chose a hearing time, prior to Cannon’s tomorrow (since her date was already known, when the appeal was docketed)… intentionally to shut her kooky clown show… all the way down.

Now you know. Grinning….

Update: There Is Now Proof That Gov. DeSantis, As Chief Law Officer In FL, LIED IN WRITING To Accuseds, In Criminal Removal Proceedings. That’s A… Felony.

Once again, a pro bono lawyer for about 30 of the people from Venezuela and Colombia has obtained (the stupidly ginned up in MS Office) written brochure DeSantis caused to be handed out to people, to fraudulently induce them to get on the plane to Martha’s Vineyard (and in the process, miss their “credible fear” hearings).

Under federal law dating back six decades, law enforcement cannot lie to someone who is already in the process — charged, in any criminal proceeding. Immigration and deportation proceedings are… criminal, in that the final outcome permits a detention, and a forced removal from the US — in effect, a life imprisonment order, by exile.

DeSantis crowed on video over the weekend, about now having the “infrastructure” in place (chartered jets, and lots more brochures, to dupe asylum seekers) to do a lot more of these chartered night drops. In sum, he is taking credit for it.

That makes out a felony.

[Three generations ago, pro-segregation Governors in the South did much the same, tricking black families to get on buses, and shipping them to Chicago and Detroit and Boston, Philly and New York — with false promises of modern housing and good jobs. But that was not crime, since none of them were in the criminal justice system. This lying… is just so… un-American.]

Me? I think DeSantis’ Catholic parish priest (the only authority he listens to, besides himself) should refuse him Communion — until he repents of his organized crimes.

Out. This is disgusting — and just so openly… malevolently… stupid.

Fine Amici In The Eleventh Circuit — On How Preposterously Wrong Cannon’s Decisions (Plural) Are…

This was actually uploaded Friday night, but the Eleventh Circuit’s PACER feed was undergoing upgrades all weekend, so the full PDF of the text, on this fine friend of the court brief (from former federal and state prosecutors, no less) just became accessible this morning, here on Monday. It is absolutely spot on.

As I say, do go read it all — 32 pages worth:

…First, the district court [Aileen Cannon] erred in holding that former President Trump could under any circumstances prevail on a motion under Federal Rule of Criminal Procedure 41(g) (“Rule 41(g)”) as to the approximately 100 documents that are at issue in this appeal. Those documents are all classified and, in some cases, may qualify as Presidential records, which are both by definition property of the U.S. government such that former President Trump does not have (and cannot have) the possessory interest in them required to prevail on a motion under Rule 41(g).

Second, the appointment of a special master was clearly improper at least insofar as the special master was empowered to decide claims of executive privilege. Executive privilege simply cannot be asserted — as the former President proposes to do here — against “the very Executive Branch in whose name the privilege is invoked.” Nixon v. Adm’r of Gen. Serv., 433 U.S. 425, 447–48 (1977) (“Nixon v. GSA”). That is particularly true here, where the Executive Branch has sought the return of its own classified records in connection with its ongoing performance of core executive and national security functions. Further, and again by definition, any records that are subject to executive privilege will be Presidential records belonging to the U.S. government, not to former President Trump.

Third, a former President is entitled to no greater protection under the law than is any other citizen. To the extent that the district court held otherwise, concern for reputational harm is not a valid basis for enjoining a criminal investigation, especially one that is inexorably intertwined with a national security damage assessment. Nor is there a principled basis for applying a different rule to this plaintiff, by virtue of the “position formerly held by” him, ECF No. 89 at 10, effectively endowing him with greater procedural rights than those afforded to other citizens….

It is hard NOT to see these Judge Cannon “Rube Goldberg machine-like” rulings as anything other than naked partisanship — she chooses the result she favors, then simply makes up a series of illogical, randomly-assembled shibboleths, in each case, to “get there.”

But in the end, she won’t matter — at all. She is… like her Tangerine handler… going to soon be… irrelevant. Out, grinning.

[Crypto-Tangent] Bitcoin Now At Four-Month Lows: ~$18,500…

Here in the wee hours of Monday morning, Bitcoin spot prices (likely due to the tandem swoon of ETH, post merge) are now below where they last were on June 18, 2022.

In any rational world, Riot should trade down at least the eight per cent or so that Bitcoin has fallen through, when the NASDAQ gets really rolling, at 11 am Eastern Monday.

We shall see, but clearly there is more downside risk near term, than the tiny risk of “missing the bottom” (for the odd long player, looking to buy back in, on either Bitcoin or any miner — Riot Blockchain included).

This — like Powerline, generally… has always just been one loooooong… con.

Hilarious!

Hinderaker Claims All Political Violence Comes “From The Left”?!

Once again — in his Sunday rant, full of lies, but just a hair shy of full senility, John claims people chanting against Tomi Lauhren, at a TP USA thing in New Mexico… is proof of the danger of violent leftists. That the left conducts almost all the violence.

Nah — he confuses boisterous chanting… with firing an AR-15, at the FBI HQ.

While I’m not a fan of “the hecklers’ veto”… it is stultifying that John and his boys… completely ignored the ardent Truth Social activist poster, as he live posted his gunfire attack just weeks ago, on the Ohio FBI offices. That was before he signed off with MAGA slogans on Trump’s platforms, and then… was shot dead, when surrounded by officers in rural Ohio.

The boys said nothing of it. It was right after a lawful search warrant was executed against Trump.

It was in the papers, boys.

Your fantasy here is… undone, Hinderaker.

Sit down and shut up.

Tardy With This — But Here Is Where Pfizer Spent Its Q2 2022 ~$3.48 Million, In DC.

We didn’t mean for it to work out this way. We just got distracted. And then, frankly… we plain old… forgot.

But we noticed that on September 9, 2022, Pfizer had amended its disclosures. So being late… let us be… accurate. Grin.

Here it is, among other matters:

…Drug Pricing, Support of Biosimilars, Out-of-Pocket Costs, Rebate Reform, Vaccine Infrastructure/HR 3656 Excise Tax- S.3087, Antimicrobial Resistance/HR 3932/PASTEUR Act, COVID Relief Package/Appropriations, PDUFA….

Medicare Part D support for access to treatments for obesity, Coverage Gap, Rebate Reform, Out-of-Pocket Costs, Government Negotiation in Medicare….

Comprehensive Corporate Tax Reform, International Tax Reform, OECD Profit Allocation, U.S. Manufacturing Credits, Build Back Better Act, Minimum Tax….

NAFTA/USMCA, Foreign Market Access issues (including IPR), International Supply Chain/Buy America – harmonize international drug manufacturing standards, Global Access to Medicines….

TRIPS Waiver, General IP Issues, Bayh-Dole March-In Rights….

Now you know. Sorry about the delay… smile.

John Cheered Citizens United, A Decade Ago. Now He Expressly Repudiates It, By Cheering NetChoice, In Texas.

Not quite eligible for the senility files, but this is pretty darn close.

Hinderaker this afternoon praises the “reasoning” of the Fifth Circuit, in NetChoice v. Paxson.

The opinion avoids mentioning the actual text of the First Amendment, upon which it purportedly bases its finding of a right nowhere set forth there, and in fact, directly countermands it, in that Amendment. [It says “Congress shall make no law” not private businesses, or corporations “must carry” viewpoints in dissent. In fact, Saint Ron Reagan killed that idea for the broadcast networks in 1982… reversing the FCC rules on the topic (ending the must carry / equal time rules). John cheered that too. Sheesh.]

No surprise (on my part), about any of this feckless sophistry, though — Hinderaker, and these same Federalist goofs, were the ones who brought forth the “reasoning” of Citizens United twelve years ago.

There, these jokers convinced a court of last resort that corporations have almost unfettered First Amendment free speech rights, in the form of money contributions to political campaigns.

Now consider that these same chuckleheads today demonize… some of these SAME corporations, for exercising their own free speech, association and non-association rights… by deciding to exclude speech (and speakers) that hurt their market/brand. [To be clear, private actors — not states or governments.]

When this reaches the Supremes, this will all be made clear — these two, Citizens United and NetChoice (in its Fifth Circuit version) CANNOT be compatible.

I know which one the Supremes will choose. It will be the Citizens United right to accept money from companies, if one is a politician. It will NOT be to force social media platforms to carry hate speech and lawless incitements. Hilariously, the Fifth Circuit inverts the holding of an old Pennsylvania Supreme Court case, trying to make the word “self-publish” mean… must be printed for free in The New York Times, thus:

…For example, in 1788, Chief Justice McKean of the Supreme Court of Pennsylvania explained that “[t]he true liberty of the press is amply secured by permitting every man to publish his opinions; but it is due to the peace and dignity of society to enquire into the motives of such publications, and to distinguish between those which are meant for use and reformation, and with an eye solely to the public good, and those which are intended merely to delude and defame.” Respublica v. Oswald, 1 U.S. (1 Dall.) 319, 325 (Pa. 1788)….

That case only allows someone (any private actor, in today’s language) to write their own blog. [To publish their own handbills, in the language of that day, and hand them out — on street corners, peaceably.] To SELF-publish. It does NOT in any fashion require that the TV networks, the Wa Po, or even Hartford Courant (or Twitter or TikTok) carry it.

Imagine the hue and cry, even five years ago, if someone had told the GOP that Texas state government was going to dictate the viewpoints a private company MUST express.

Damn.

But you keep self-publishing that Powerline blog, John — it is a very good joke. Wholly-ironic, in fact. Twitter need not give you their public square. Period.

Cheers, Johnnie!

Hinderaker… Thinks DENYING People A Federal Law-Guaranteed Hearing Right… Is “Honest and Courageous”?!

I will let that hateful, and unconstitutional… and criminal… conduct speak for itself.

Res ipsa, DeSantis. Res ipsa.

As we said last night, a law enforcement officer (here, the CHIEF law enforcement officer in Florida — a Harvard lawyer, to boot!) who intentionally misleads vulnerable, unrepresented people, charged with serious crimes, to drop them thousands of miles from a required hearing date and time, without a penny to get back, under cover of night… commits a felony.

See the green text of last night’s letter right here.

Damn, John.

You are… embittered, evil and sad… as well as… a coward.
