Kooky Stauffer Files — Episode 387.

On a clear Sunday morning, here — old Bitsy applauds vandalism, by intolerant, ill-educated teenagers, in public high schools.

Charming.

Lake Oswego, Oregon is a fine town, but like many medium sized American towns, two or three knuck-headed families raise kids there.

These are those.

End of story, and all things that in no manner affect Stauffer’s life or liberty — all the way on the other side of the nation — out in rural Maine.

Preposterous take, in her column.

Out.

Hinderaker Likely Can’t Quote The Bhagavad Gita By Heart..

So… John cluck clucks tonight about people who don’t know the Bible by heart.

I don’t really give a rip, either way — but why does he sneer, if he can’t quote the Quran or Bhagavad Gita, by heart? He’s fallen into the trivial abyss, of news of the… inane.

[And, to be clear, he pretends Christ’s social gospel at Matthew 25:31-46… doesn’t exist.]

He’s just a embittered, impotent old coot, folks.

Out.

Hinderaker Prefers Indicted Criminal & Rapist Over A “Democratic” Candidate…

Tonight, John just claimed “all the Democrats can do… is talk about” Tangerine.

Well — maybe a lil’, there — Hinder-man.

But we can ALSO talk about DeSantis being manifestly unfit.

So — yeh, you keep telling me that most in America WON’T prefer a gentle grandfather figure, over either (i) a serial sexual predator and three decades long serial business and charity cheat…?

Or… over (ii) a guy who just drove one of his state’s largest employers and taxpayers.. to start an exodus — over his hateful Luddite legislation and rhetoric? A guy who only got into Yale on a “Varsity Blues” baseball scam for legacy referrals?!

Sure sure. Cool story bro.

This May Literally Be… The Face — Of The Mother, Of Us All

It would now seem that a fairly small group of humans, living in a remote area between present-day South Africa and Namibia… still carry the largest portion of diverse DNA, on the planet. In fact, it is so diverse, the Nama may be the only remaining group of humans with direct and close genetic marker ties… to all living humans.

Literally, to all of us. Here’s the bit:

…[The study collected] genomes from 44 modern Nama individuals from southern Africa, an Indigenous population known to carry exceptional levels of genetic diversity compared to other modern groups….

The study model suggests the earliest population split among early humans that is detectable in contemporary populations occurred 120,000 to 135,000 years ago, after two or more weakly genetically differentiated… populations had been mixing for hundreds of thousands of years. After the population split, people still migrated between the stem populations, creating a weakly structured stem. This offers a better explanation of genetic variation among individual humans and human groups than do previous models, the authors suggest….

So, back five million years — our “mom” was Lucy, but our most modern form is probably directly linked — at about 135,000 years ago, onward… to peoples very much akin to what we call the present day Nama, on the borders of South Africa and Namibia.

We all — all humans — for a goodly portion of the last 100,000 or so years… closely resembled them, even in appearances, in all likelihood. [All of which calls into question. . . the wisdom of mistreating our mothers, as they attempt to come across our southern border. We’ve only observed the concept of “borders”, for a blink of an eye, compared to Nama timeframes.]

Indeed, consider here, how much more closely the Northern England’s “Cheddar Man” — dated at “only” about 9,000 years ago (see image at link)… resembles the Nama, than he does… the decidedly pale Brits, of today. For almost all of our time here on Earth, we have been… brown peoples. Out, smiling….

Meanwhile — Hinderaker Can Only Manage To Cover [British] Gossip Page Material…

Old Johnnie won’t touch the radioactive DeSantis stories tonight.

Nor will he try to explain why the programs he championed under Trump — he now falls silent on, when proposed by Mr. Biden.

So instead, he simply whines about what a couple no longer considered in line for the British throne do — or don’t do — when in the Big Apple.

Y A W N.

I guess… Powerline has become same as Candace Owens — but with a much smaller audience: gossip pages for the frothy right ideologues.

Hilarious.

The Amended Complaint In East Bay III (Now Technically East Bay IV, I Suppose)… Was Filed Tonight In Oakland. Ooof.

The fact that we are back to this is… deeply disappointing. Doubly so, since the Democratic candidates promised this would be a “new day” — repudiating Trump’s lawless actions. And that was true for a while. But now, that the time has come to sunset the Title 42 strictures, as we end our COVID emergencies… the administration has taken a deeply mal-informed approach, overall… itself not terribly unlike the measures under Trump that were enjoined in this very same court, in front of this very same USDC Judge, not four years ago.

If we are to lead the world, we must again be “the shining beacon of light, on the hill”. That is, we must scrupulously honor human rights, as set out in our long in force treaty obligations and agreed UN protocols. We must. Here’s the newly amended 57 page complaint tonight — seeking a new injunction:

…[The Biden-proposed rule] is convoluted, but its operation is straightforward: It applies to all non-Mexican asylum seekers at the southern land border and adjacent coastal borders. Id. at 15-16, 326, 438. It requires the automatic denial of an applicant’s asylum claim unless the person satisfies one of three conditions: presenting at a port of entry after securing one of a tightly-restricted number of appointments through a complicated mobile application called CBP One; applying for and being denied asylum in a transit country; or obtaining advance permission to travel to the United States through an approved parole program. Id. at 14, 25-26, 438-49. The Rule contains extremely narrow exceptions to this asylum bar for things like acute medical emergencies. Id. at 15, 439. Like the previous asylum bans, the Rule would bar vulnerable people from asylum for reasons wholly unrelated to the strength or urgency of their need for protection under our laws….

[The proposed rules are] unlawful in numerous ways. The Ninth Circuit has already held that the Rule’s main requirements are illegal. The government cannot force asylum seekers to enter at ports. E. Bay Sanctuary Covenant (“EBSC”) v. Biden, 993 F.3d 640, 658 (9th Cir. 2021) (invalidating prior entry ban). And the government cannot force asylum seekers to apply for asylum in transit countries. EBSC v. Garland, 994 F.3d 962, 982 (9th Cir. 2020) (invalidating the prior transit ban). The Rule revives these illegal requirements by forcing asylum seekers to choose between them, even though neither is consistent with the asylum statute….

In practice, the Rule will function just like the enjoined entry ban, because the Rule’s other requirements are virtually impossible for most asylum seekers to meet. While the prior transit rule was in effect, more than 98% of asylum seekers were unable to satisfy its conditions because of danger and overwhelmed or nonexistent asylum systems in transit countries….

As a result, the Rule will effectively require nearly all covered asylum seekers to enter at a port of entry. Indeed, that’s exactly how the government itself has described the Rule: “[I]ndividuals who unlawfully cross the U.S. southwest border will be presumed ineligible for asylum under new regulations….”

Like its predecessors, this new ban is both inconsistent with Congress’s statutory directive, and arbitrary and capricious, in numerous ways. Among other reasons, it bars asylum based on manner of entry and transit through a third country, which this Court and the Ninth Circuit have already held to be irrelevant, arbitrary bases on which to bar asylum. EBSC v. Trump, 349 F. Supp. 3d 838, 857-59 (N.D. Cal. 2018); EBSC v. Biden, 993 F.3d at 671-72; EBSC v. Barr, 385 F. Supp. 3d 922, 945-46 (N.D. Cal. 2019); EBSC v. Garland, 994 F.3d at 980….

These very same conditions were held unlawful by Judges Tigar, Gee and Sibraw — just over four years ago. Nothing has changed in Congress to sanitize those violations of law. We will keep you posted. Out — Dammit.

“Nice Goin’, Ronnie!” Disney Scraps A Planned $1B Campus In Orlando, Due To DeSantis. Ouch

The Mouse will move… elsewhere.

This is what happens when a “legacy admission” Yale guy (baseball greased his acceptance) — one with hard right loony ideas… gets elected governor. [His Harvard law admission was also “greased” I am informed.]

In any event, this is what anti-business “government by goose-stepping brown-shirts” will bring to Florida.

Departing jobs, departing tax bases, and departing tourists — ending good will.

Yeh — Ronnie should be worried about any chance in a national election now — he’s as toxic as Tangerine on Wall Street. The Chairman of BlackRock met one on one with him, and in uncharacteristic fashion — publicly announced he would not donate a penny to the coming ’24 DeSantis campaign.

Ouch. That’ll leave a mark.

Tangent: “Loons On Ice!” — ‘23 Crypto/Bitcoin- Confab Attendance, In Miami: One-Half Of ‘22 Levels…

The Bitcoin / crypto- Ice Age howls on, despite what the puffers (cough! CoinDesk), and “Lunatics on Ice!” depicted at right might say.

Object lesson?

Most people will no longer pay fiat money, in any larger amount — to hear more of the Bitcoin maximalist poppycock. This is simply… a badly-run casino. [Look at that truly unhinged (with only one excellent exception!) speaker roster, via the currently featured line-up, at the confab’s web-site! Damn!]

No surprise there, if you’ve been a regular reader… here. Do take a hard pass, on that nonsense. The “Big Short” guy won’t be able to single handedly save the whole dang meeting.

Heh.

Onward.

Supremes’ Power Alley: Today Amgen Learned That Patents (To Be Valid) Must Teach A Method That Skilled Scientists May Readily Follow, In A New Drug/Therapy Setting…

“Gamesmanship” — of federal IP law is an old and pernicious tradecraft — in life science and pharma patent warfare. This concerns one narrow battlefront, in that war. But it is still good news, for consumers.

Today, the Supremes effectively put a lid on very broad patent claims, at least as to those that would claim patent license payments for millions of antibodies that might be useful in unknown therapies, simply by teaching one method to treat levels of serum cholesterol in the blood.

This is good news, for patients. It should mean that drug prices will require less mark-up, for paying dozens of patent licenses — each widely-far afield, from the original patent — as granted. Here is the full opinion, just decided this morning, and a bit:

Several years ago, petitioners (Amgen) obtained two patents. Together, these patents claim a monopoly over all antibodies that (1) bind to specific amino acids on a naturally occurring protein known as PCSK9, and (2) block PCSK9 from impairing the body’s mechanism for removing LDL cholesterol from the bloodstream. Soon after receiving these patents, Amgen sued respondents (Sanofi) for infringement. In response, Sanofi argued that the patents were invalid under §112 of the Patent Act.

That provision requires a patent applicant to describe its invention “in such full, clear, concise, and exact terms as to enable any person skilled in the art…. to make and use the [invention].” 35 U. S. C. §112(a)….

…Sanofi contended that Amgen’s patents failed to meet this standard because they sought to claim for Amgen’s exclusive use potentially millions more antibodies than the company had taught scientists to make. In the end, both the district court and Federal Circuit sided with Sanofi. [Today we join them.]…

Now you know. Fascinating, and it was a unanimous liberal-conservative coalition that so held. Onward, to the Preakness… and the Solo Cup… smile.
