Most Of What Hinderaker Writes In Defense Of Tangerine… Merits No Serious Reply. It Is THAT Transparently Stupid.

And tonight’s installment is certainly no exception.

But because this is a long term pattern-style defense of crime, always offered by Hinderaker — only when committed by GOP party leaders — I feel constrained to mention the level of lying at work in John’s. He claims no one was harmed by Trump’s NY frauds — over $250 million worth.

Well — first off, the banks would have charged Trump higher interest rates, to compensate for the risk he fraudulently foisted off on them, had they known. Thus, in fact, the rest of the bank’s honest borrowers (like us!) effectively subsidized Tangerine’s real estate borrowings, due solely to his lies. We paid the honest rate — he got the liars’ discount. That’s… actionable bank fraud.

Second, and perhaps more important — the taxpayers of New York — all of them — paid incrementally more, and saw larger deficits run up — because Trump lied (and UNDER-valued his holdings for real estate tax purposes), at the same time he OVER-valued them, for the purpose of getting ever higher loan balances advanced against them.

Finally — this whole defense that the value of real estate is anything Trump wants it to be… is the same BS Hinderaker floated when Cheney was torturing people: if a powerful person wants to do it, the law ought not apply to him.

John called those… “process” crimes — by which he means the process of lying about felony matters is a mere triviality — when someone important has need/want to do it.

Sit down, clown. You are presumptively disqualified, from adult conversations, about the law and policy surrounding all financial matters, henceforth.

[U] Before Too Long, The Name Spat Will Be On Trial In Federal Court, In New Jersey… So, Why Would An Entire Pre-Trial Order Remain… Sealed?

As many here well-know — we’ve covered this Lanham Act federal litigation for around 12 to 14 years, now. It has been percolating in courts around the globe since a Facebook flap became the flash-point, back then — but the two companies have been separated since the Treaty of Versailles in 1919.

As the New Jersey federal district court draws closer to holding a trial on the merits, though (since the parties have not yet settled, despite paying perhaps $75 million each in legal fees over the last decade) — we have become aware that a fundamental First Amendment right of “we the people” (and the press), is being abridged in that courtroom.

The parties have proposed a pre-trial order, to narrow the issues at trial — as to which party will win the right to use the name “Merck” in the US.

Inexplicably, despite being filed over a week ago now, no redacted version (redacted for trade secrets, only) has been filed on the public docket.

We the people are entitled to observe the workings of our courts — for their fairness and integrity.

This is another of those times, when large commercial interests would prefer not to air their dirty laundry — but that is not what Amendment One says. Except for trade secrets, and the dollar figures in settlement, if mentioned, this pre-trial order is a public document.

Please do make at least a redacted version available, Judge Hammer — or I will appear and file for one at least redacted version to be compelled, under the Supremes’ precedents from the Nixon era — specifically… Nixon v. Warner Communications 435 US 589, 597 (1978).

Updated — by mid-afternoon on Monday, the able Magistrate Judge entered the following text only order. Perhaps he is going to mark up a paper copy for redactions(?). And then order filed a redacted copy? We shall see:

…TEXT ORDER: Per the Court’s April 27, 2023 order, the parties are to submit two (2) courtesy hard copies of the Proposed Final Pretrial Order to the Undersigned’s Chambers.

Accordingly, the parties shall submit the copies not later than October 6, 2023. So Ordered by Magistrate Judge Michael A. Hammer on 10/2/23….

[If not, I am fairly certain Davis, Wright and Tremaine would join me, were I to ask. Smile — that fine NYC firm is right now securing public access to essentially all the Tangeine fraud materials — as well as TV coverage of the same… at that state trial in Manhattan.]

As I wander off, here is but one of hundreds of now ancient backgrounders on this topic — of mine. Enjoy, on a sunny, warm Fall Monday here.

Starting Tomorrow, In Manhattan — FINALLY! — This Silly Parade Balloon Will Begin To Be… Deflated.

To be sure, this moment is only… about two decades overdue.

But I’ll take the win — wherever, and however… it comes.

Better late than never.

My undying gratitude goes out to the New York Attorney General, and all her staff counsels.

And to literally every diligent investigator who has helped bring us to this moment. Thank you.

You have done your nation a vast service — in preserving the rule of law, over vain, corrupt and petty men.

Kudos — no matter how it ends — the moment is what matters.

And to be clear, here — I am confident they’ve got their man. Well-done, all.

This is a moment for celebration, of your patriotism — sometimes a dangerous and unpleasant task… but we the people, we thank you for it.

Onward — with the exceedingly qualified Laphonza Butler to take Sen. Feinstein’s unexpired term, out of California… I’d say things are starting to look… up!

Mirendgoff… Quoted A 2% Figure Yesterday. It Is Actually… 46%…

I really don’t care — do you?

Paul’s point was that the Fortune 100 companies are under-hiring whytes — the claim was only two per cent of all recent new hires.

On its face, no serious academic would say that figure passes the straight face test.

But for people like Paul, Bitsy, John and Steve… they WANT to believe that whytes are being treated badly.

Geez.

Please — use your forebrain next time, Paul.

Stupid?! Of Course! But Legal Differences Abound…

Yes of course, John — it was a dumb move.

And hard to fathom. But…

A man doing the nation’s business, while in a place he’s authorized / required to be — mistakenly setting off an alarm while trying to LEAVE a federal building…

Is in no manner the same as lawless thugs breaking and entering, threatening to hang Mike Pence… injuring dozens of law enforcement officers, and committing at least one felony murder.

It’s not even in the same Zip Code, Hinderaker. Take a seat. The differences at law are… overwhelming.

It was just felony stupid.

Huh, like… you, day in and day out.

Out.

NASA Super Computer Simulation Models How Saturn’s Iconic Rings Came Into Being…

Here’s the latest, on the above — from the Ames Research Center team:

…On a clear night, with a decent amateur telescope, Saturn and its series of remarkable rings can be seen from Earth’s surface. But how did those rings come to be? And what can they tell us about Saturn and its moons, one of the potential locations NASA hopes to search for life? A new series of supercomputer simulations has offered an answer to the mystery of the rings’ origins – one that involves a massive collision, back when dinosaurs still roamed the Earth.

According to new research by NASA and its partners, Saturn’s rings could have evolved from the debris of two icy moons that collided and shattered a few hundred million years ago. Debris that didn’t end up in the rings could also have contributed to the formation of some of Saturn’s present-day moons.

“There’s so much we still don’t know about the Saturn system, including its moons that host environments that might be suitable for life,” said Jacob Kegerreis, a research scientist at NASA’s Ames Research Center in California’s Silicon Valley. “So, it’s exciting to use big simulations like these to explore in detail how they could have evolved….”

Now you know. Enjoy — space / interplanetary science is endlessly… fascinating!

Pop Quiz For Bill Otis: Please Explain LaQuan McDonald Or Ahmaud Arbery…

Tonight Bill Otis contradicts all the Powerline blog boys by directly saying that Derek Chauvin committed murder in kneeling on George Floyd’s neck — long after he was unconscious — and, for over seven minutes… in total.

That is truth — and some justice.

But he makes that small point — it is clear — primarily so he may ramble onward, and complain about a retired whyte cop killed senselessly in New York. The two cases are in no manner related. But he offers it to say that more whyte cops are killed by brown and black people — than the other way ’round.

Dumbest form of what about-ism, on Earth, that.

But if he wants to play that game, and claim that race was not a factor in Mr. Floyd’s murder — let us ask him to defend the murder of LaQuan McDonald (16 shots) in Chicago, or the hunting, and lynching of Ahmaud Arbery, in Georgia.

We will… wait. In fact, if he answers cogently as to the two that are the tip of this iceberg — we will promptly offer at least 30 more, including a young woman killed by police in her own home, in bed — in the middle of the night (they attacked the wrong black person’s apartment). The same happened to a young black man asleep on his girlfriend’s couch. There are literally dozens beyond these.

But only stony silence… will ensue — over at Ringside.

Damn him.

Well — What Hinderaker (Trivially, I Might Add!) Misses… About Sen. Feinstein… Is That The Nation’s Electorate Has… Shifted, Leftward.

John complains that the Wa Po this morning styles her, in death here — as a centrist.

What Hinderaker has ignored… is that with the Dobbs decision, from the hard right side of the Supremes… his “team” succeeded only in shifting the younger half of all voters… leftward.

The nation’s electorate has moved, since 2022 — with its feet… toward progress. Toward the right of a woman to control her own uterus.

So — it is true, Sen. Feinstein’s votes all landed where he says — and all the legislation she passed and sponsored… improved the lives of Americans born with limited means. True.

But John hasn’t the ability to see that the GOP will win no more national elections, until it accepts that all of the 19th Century sensibilities it looks for in America… the ones it adores, for primarily only property owning whyte ppl… all that has ended — well over a century ago, now.

Congrats John — between Tangerine’s lingering stain, and your much personally lauded Dobbs decision… you boys bought this barren, pock-marked farmland. Good luck, getting anything useful to grow out, of it.

This Sixth Cir. Opinion Ignores Controlling Supreme Court Precedent On The Meaning of The Term “On The Basis of Sex”. On To The Supremes.

That cramped, craven Tennessee “law” — the one that purports to deny medical care to only one sub-class of genders — as a purely legislative creature, and in addition, invidiously invade the physician patient relationship… will ultimately fall.

And the Sixth Cir. has ignored Justice Gorsuch’s latest controlling opinion (6-3) on the matter, in the process of coming to a contrary conclusion. So some time next summer, the Supremes will strike the law and this errant opinion.

For now, we will quote the dissent — that understands the actual black letter federal law very well:

…[W]hen a fundamental right or freedom from discrimination is involved, experimentation has no place. “The very purpose of” our constitutional system “was to withdraw certain subjects from the vicissitudes of political controversy, to place them beyond the reach of majorities and officials and to establish them as legal principles to be applied by the courts.” W. Va. St. Bd. of Ed. v. Barnette, 319 U.S. 624, 638 (1943). Our “fundamental rights may not be submitted to vote; they depend on the outcome of no elections.” Id. Similarly, “[n]o plebiscite can legalize an unjust discrimination.” Lucas v. Forty-Fourth Gen. Assemb., 377 U.S. 713, 736 n.29 (1964) (citation omitted).

Tennessee’s and Kentucky’s laws tell minors and their parents that the minors cannot undergo medical care because of the accidents of their births and their failure to conform to how society believes boys and girls should look and live. The laws further deprive the parents — those whom we otherwise recognize as best suited to further their minor children’s interests — of their right to make medical decisions affecting their children in conjunction with their children and medical practitioners. For these reasons, I dissent….

Now you know. Onward, just the same. These conservatives think simple state “laws” may step over the top of the Fourteenth Amendment’s guarantees to all the people. They may not.

Smiling into a CU v. USC weekend, midday tomorrow. Go Buffs!
