Hayward Doesn’t Understand Disbarment Proceedings: Not 6th Amendment “Trials”

As you may readily see, I’m still loving the Pacific Northwest scenery, but Steve Hayward yesterday claimed John Eastman cannot get a fair “trial” — in California.

The law license at issue in a bar proceeding is a privilege, not a property right.

Thus, bar proceedings require very forthcoming candor, and utmost honesty in fact, to be shown by bar members seeking to avoid disbarment for misconduct. These hearings are not criminal “confrontation clause” / full sixth amendment rights proceedings.

The bar “hearing officer” is allowed to question fact witnesses like Mr. Eastman.

He has no entitlement to practice law in California, so everything Steve says about it all… is deeply ill-informed garbage.
