Hinderaker And Johnson… Ignore That Sitting Governors Violated US Law In Lying To Asylum Seekers, And Effectively Ending Their Hearings.

Some plain English, clearly articulated black letter federal law, at 8 USC § 1103, et seq., guarantees all asylum seekers at a border a hearing on whether they have a “credible fear” of persecution, if “refouled” [a fancy statutory word for being sent back to either Mexico (as the last non-US country from which they gained entrance to the US), or the country from whence they originated]. This has been true for over three decades now. [Yes, the GOP knows it is going down in flames, with Trumpism — so it resorts to… lawlessness.]

But both John Hinderaker and now Scott Johnson think that “stunts” by sitting governors of the MAGA-GOP persuasion should be more important than complying with fundamental rights long granted, in federal criminal procedure.

These hearings are federally-mandated criminal rights of people accused by the US of being present unlawfully.

One would think these two moron “governators“… would want to have those hearings conducted quickly so as to refoul as many as possible, and as soon as possible.

But that would be… to assume too much — these GOP thugs never respect the rule of law when they are on the wrong side of it.

So, these supposed chief law enforcement officers of their respective states… have admitted to paying fraudsters thousands per person, to lie to people who barely speak English, and then drop them penniless in cities thousands of miles from any border — in the middle of the night.

This then is a STATE acting to deprive asylum seekers of the right to a credible fear hearing. As such, these people are now… LAWFULLY present in the United States, and cannot be refouled, absent a restart of the “credible fear” evaluations.

Charming.

Finally, there are vast natural resource benefits (by accident of geography) accorded to states that sit along the southern border, in terms of oil riches, fishing abundance, coal, and natural gas… and lots of sunshine, to grow oranges and such. That these states also shoulder the burden of crossings… is just the way it is. An accident of nearly tropical geography. And so, with privileges of abundance in these states, on so many other dimensions… comes various responsibilities, to use them wisely, and accept the cost of where they sit, on the map.

Here’s a not entirely tongue in cheek idea: perhaps the governors of Colorado, Nebraska, Kansas and Iowa should pack up a few hundred tons of slaughterhouse waste and effluvia… in tankers, and drive down to The Villages, in Florida or in front of Abbott’s private home/mansion in Texas… and spray the offal… all over his lawn.

Afterall, we know both DeSantis and Abbott eat pork sausage and steaks.

Or… maybe NYC should load up a long pearly strand of garbage barges… and tugboat them down the Atlantic coastline — to the beautiful Florida beaches… and dump them there, about thirty feet offshore — to let the stench waft in with the rising tides. The tourists will… love that.

Let them share in THAT burden, right John? Scott…?

This a-holian notion, from Scott and John, that the law doesn’t apply when a governor openly violates the rights of humans… must end.

Otherwise, the comparisons to the end of Weimar Germany… are mostly apt, as to Florida and Texas. [And lest I be misinterpreted, over all of this is my assertion of the wild inhumanity, the intentional cruelty — of GOP’s using largely dis-enfranchised humans… as political props. So Trumpian… of them. Of course, these people are caught in a system, one these governors are exploiting. They are in no manner analogous to slaughterhouse waste or garbage barge contents… but at least my “stunts” would not treat them like… chattels.]
