So — At Something Called “American Greatness”, Hinderaker Repeats A Claim That Durham Was Duped By “Deep Staters” At FBI?!

Well… I do find it… all rather charmingit is so preposterous as to be… sorta’ cute.

From the alleged fact that a few government agents had a “secure workspace” at a law firm (spun up, to be a nefarious deep state operation!?), John infers that the whole of the Durham investigation was a hoodwinking (by a complicit with HRC FBI). But this is in fact, a very common occurrence, in my considerable experience — as when, for just two examples, the FDA (in an NDA/clinical trial review, or plant inspection setting), or the HSR offices of the Antitrust Div. of the FTC or DoJ… (when working to pre-clear a merger, in under 20 days)…

Loony John Hinderaker would try to spin this as a vast FBI conspiracy — one concocted to “trick” Durham (a wise old lawyer, he) into bringing impotent charges (and thus losing!) against Mr. Sussmann.

What?! C’mon, man…

The notion that Durham (someone the GOP told Tangerine was a fine trial lawyer!) couldn’t see that his only hoped-for card, was a single-piece of double hearsay — offered, in truth, we all now know — simply to smear HRC (but if he were truly worth anything, he well-knew it would never sustain a false statement charge — so he would have never brought the case).

This all fails the “straight face” test, for any real… lawyer. Damn.

No, John just makes up a fantabulous story here — but it is very common for even targets of indicted companies to create “clean-rooms” available to government agents, on premises, so that very sensitive competitive or trade secret IP documents need never leave a physical building controlled by a retained law firm, for the defense.

This happens all the time in public company investigations, and in pre-merger reviews, and in FDA visits — at least where the involved companies are sure they did nothing wrong (just as the HRC campaign was sure it had nothing to hide, John!), and the involved actors want to help the government quickly answer all questions with immediate access to ALL the original documents.

Jeebus Hinderaker — you apparently never really practiced high stakes public company law, at all — did you?
