John Tells Us Regularly Of [What He Calls] The “Hateful Left”… Let’s Just Listen A Bit, To Some Gentle Humor, About The 46th President — From The 44th…

Most recently, Hinderaker said anew, that the left is hateful. Then he offered a yawn inducing video to suggest that ripping off the Village People’s legendarily pro-LGBTQ+ and thus historic “YMCA” (without permission, and without BMI royalty payments!) shows… (wait for it!)… that the Trump GOP is “happy…” and “exuberant“.

Let’s just… compare and contrast, shall we? Yes, let’s (again!):

A Paltry Additional $15 Million, For Current DRC Ebola Flare-Up — From The Trump Controlled (For Now) USAID Government Fund

This mean-spirited slow- and low- walk, of international humanitarian health care crisis aid will last only so long as Trump does. Go. . . vote, to restore America’s status as an emergency health care relief beacon — to the planet.

In any event, here is the US government press release:

…[T]he United States, through the U.S. Agency for International Development (USAID), announced more than $15 million in additional humanitarian assistance to help end the outbreak of Ebola in Équateur Province in the Democratic Republic of Congo (DRC)…. With this new funding, USAID is providing lifesaving assistance for the people affected by the DRC’s 11th outbreak of Ebola, including disease surveillance, the transportation of patients, training on the prevention and control of infections in health facilities, the promotion of safe and dignified burials, and community-engagement programs to ensure everyone has access to accurate information about how to prevent and treat the disease….

This is truly a matter of life and death, even though the current flare up is at this point rather… moderate, by comparison to the last three outbreaks. Even so, as of September 3, 47 people in the DRC have died already.

A Slight Modification To Portland Order Preventing Trump Goons From Interfering With Press/Lawyers At Protests…

Not momentous by any stretch, but in a weekend order — primarily to confirm… what is indisputably well-settled, existing First Amendment law, and to clarify the record, since this specific case in now on appeal (by Trump, on his loss) to the Ninth Circuit — and thus reduce the number of issues to brief… both sides have agreed that the able USDC Judge Simon’s injunction will not be read to mean that the press and/or lawyers may block police, or interfere with their work, in Portland.

The press and legal observers, however, obviously may remain on the street, even after an order to disperse — to observe what the DHS goons do. That remains clear, so long as they stay out of the dead ahead path — on which the police are then marching. [In related news, we personally participated, as part of the volunteer ACLU Legal Observers’ team — and saw this same dynamic work very peacefully — in Kenosha, on two separate days, last week]:

…We have added the language “No Journalist or Legal Observer protected under this Order may impede, block, or physically prevent the lawful activities of the Police.” The preliminary injunction otherwise remains unchanged….

Trump should be prepared to see a lot of this — free speech demonstrating / free press documenting, on his campaign trail in the next 55 or so days. Onward, out into a blustery, rainy gray city of big shoulders morning, grinning.

Well. The Able USDC Judge Sullivan Is Working This Weekend, In DC… Re Flynn.

This makes me smile… he’s a public servant in the highest sense of that term.

He knows the clock is ticking on whether justice will be done here — and the DC Circuit urged him to act with all deliberate speed. So he is doing just that. Thank you, Judge Sullivan:

…MINUTE ORDER as to MICHAEL T. FLYNN.

It is hereby ORDERED that by September 10, 2020, the Government shall deliver to Chambers three printed courtesy copies of [198] the Government’s motion to dismiss and [227] the Government’s response to Court-appointed amicus curiae. The Court-appointed amicus curiae shall deliver to Chambers three printed courtesy copies of [225] amicus brief. Mr. Flynn shall deliver to Chambers three printed courtesy copies of [228] Mr. Flynn’s brief in opposition to amicus, [231] Mr. Flynn’s supplement, and [237] Mr. Flynn’s second supplement.

The parties may deliver their courtesy copies via overnight mail or by hand delivery to the Courthouse loading dock located at the corner of 3rd and C Streets, N.W.

The courtesy copies must include the headers added by the Case Management/Electronic Case Files (CM/ECF) System and be submitted in binders, three-hole punched, with single-sided pages. All exhibits shall be tabbed and indexed for ease of reference. The parties shall deliver to Chambers three courtesy copies of any future filing, including exhibits, in connection with [198] the Government’s motion to dismiss….

Signed by Judge Emmet G. Sullivan on 9/6/2020….

Onward, grinning ear to ear here, now… feeling better about my guy No. 5… he is at peace. Now thirty five years after he tried to save his own next big brother, and lost the battle in the headlights that awful Labor weekend night… he has rejoined him… and they are laughing, out there, on the glistening pavement of stars, about so many long ago crazy high-jinx… Even as it was seven ago, next weekend, that their next elder one went inside, never to return to free air. Out.

Much Like Trump Here, Boris Johnson Has Failed On HIS Central Promise: UK Brexit…

Once again (on a quiet holiday Sunday night, with no courts-, or market- activity tomorrow in the US) it is time to take another quick peek at what was to be the greatest of all debacles — in nearly a half-century (or so the Chicken Littles said, back in 2016) — in London.

The truth is — as we’ve said, since that very first day, in June of 2016 — the more things change… the more they stay… [much] the same. Here’s a bit of the early Monday coverage, in the UK:

…If London and Brussels don’t reach a deal by October, the U.K. will be ready to accept this and “move on,” Prime Minister Boris Johnson is set to say Monday.

The two sides aim to agree a deal on trade and future relations by the time of an October 15 meeting of EU leaders so that the agreement can be ready by the time the Brexit transition period expires at the end of the year….

“We will then have a trading arrangement with the EU like. . . Australia’s,” Johnson added….

Condor predicts the “deadline” Boris mentions will be… extended (again). Just like Trump (on his moronic “paid for by Mexico” wall), Mr. Johnson is, as ever, mostly hot air. Onward, grinning….

Let Us Reflect — On Trump’s Affirmative Damage, To The US-Led Effort To Find A Vaccine… With His Idiotic And Self-Contradictory “Buy American” Orders

I am old enough to remember when John actually still practiced law, and he would openly decry any additional effort by the federal government to regulate the private life sciences industry. But Clinton was at 1600 Penn., back then — and Mr. Hinderaker regularly decried it all, when Mr. Obama was the head of the Executive Branch — with Hinderaker being especially vocal, about the ACA of 2010. In fact, he regularly quoted PhRMA statements, to support the idea that we ought to just let life science companies do what they do best, given the already vast web of federal regulation that promotes… human safety.

Now, it may be said that when Trump takes a clearly-craven, anti-free market approach — with 19th Century protectionist nonsense… he is usually just largely… marginal. Ineffectual. And most of it is just theater for his low education base, anyway (think of the Trump “bath-tub navy” boaters, here).

But when — as he did last month — he uses these antiquated “philosophical” underpinnings, try to dictate the pace of medical innovation — Trump is literally endangering human lives in America, for political theater.

And where is… John? Despite decades of opposing what he saw as excessively paternalistic Democratic Presidential moves in these areas… Hinderaker is as “silent as the grave“, on all of this Trumpian lunacy. [Maybe he just doesn’t have a client at the moment, paying him to take a reasonable position. But one might at least hope… he would stand up for human “rights to life“, here — if that is indeed his governing religious view.] Nope — silence.

From just one month ago — on how PhRMA sees Trumpism as ruining America’s lead in pharmaceuticals- and vaccines- development:

…“At a time when our nation’s priority should be to beat COVID-19, President Trump today signed yet another executive order that creates even more barriers to ongoing biopharmaceutical manufacturing and innovation. Companies are working around the clock to research and develop treatments and a vaccine for COVID-19. At the same time, they are working to ensure they have the capacity to manufacture the treatments and vaccines once approved so that every patient that needs them has access to them. These efforts are all hands on deck for the biopharmaceutical industry but each executive order issued by the administration adds another roadblock, making it harder to fight this pandemic.

“The administration is forcing biopharmaceutical companies to shift their critical attention and resources away from COVID-19 work to focus on making substantial changes to their business models necessary to comply with this and other recent executive orders. Increasing U.S. manufacturing of medicines is a laudable goal, but it cannot happen overnight and should not come at the expense of medical innovation or Americans’ access to the medicines they need.

“The recent executive orders also contradict and undermine each other, creating chaos in an industry that is on the frontlines of fighting COVID-19. With today’s ‘Buy American’ executive order, the administration effectively is taking the unprecedented step of mandating manufacturing of medicines in the United States. Yet at the same time, through the ‘most favored nation’ executive order, the administration is creating a huge disincentive to invest in U.S. biopharmaceutical research and manufacturing. Together, the result is less investment in U.S. innovation and the potential for major long-term supply chain disruptions — the opposite of what America needs right now. None of these executive orders will help patients access or afford their medicines.

“The ‘Buy American’ executive order could disrupt the global pharmaceutical supply chain, jeopardizing our ability to respond to the current crisis and potentially leading to major long-term supply chain disruptions, including shortages. Rather than government mandates, we should look for policies that enable more domestic manufacturing without putting the stability of pharmaceutical supply chains at risk….”

Well-put. But it seems… that Tangerine-colored Mussolini cat, has John’s usually sharp… tongue.

Out.

[U] While We Await A Statement, Likely From PhRMA, Denouncing Political Interference In FDA (Human Safety) Vaccine Approval Processes…

Preciously, and fortunately for my writing this Sunday morning — this morning, John foolishly chooses to laud the “boaters for Trump” on the many lakes that dot Minnesota. Perfect. See below.

The import of the masthead I’ve set above is that Trumpers… aren’t very bright. Not even bright enough to save their own lives — in a bathtub….

In truth, as to FDA vaccine approvals, there has never been need — in the past 100 years, certainly — for scientists to speak out against a then-sitting president, one who is attempting to push his thumb down (for a supposed-re-election advantage) — on the scales of good clinical trial practices, in the process for an eventually-FDA approved COVID-19 vaccine.

It is. . . astonishing. More, when the statement is released.

But I suppose (less-seriously), the best metaphor for this above (and below) Trumpian attempt — is the now three weekends’ running self-sinkings — in his would-be supporters’ “bath-tub navy“… [or as they refer to themselves in central Illinois, “white trash boaters, who vote“] as most of these supporters aren’t even smart enough to understand the scientific principle of wave- (or in this case, wake-) amplification — in an enclosed body of water. I am genuinely glad no one was injured, but seriously — if this is his base… it explains… so, so much. Onward, grinning.

[U: John Says He Is A “White Trash Boater”, Too?!] John And I Agree On This One Bit: Trump Won’t Stay Past 01.21.21 — But For Differing Reasons…

UPDATED Sunday morning — John wrote on boaters for Trump on the many lakes that dot Minnesota. So I’ve amplified my side note, from below — into an entirely new (science infused) posting — about these self-described “white-trash” boaters. At least that’s what they are calling themselves along the waterways that surround Peoria, Illinois. Charming. [End update.]

John tries vainly to make some small modicum of hay, out of the occasional chatter one hears about Trump refusing to leave 1600 Penn., after he loses in November. While I do think he will behave even in an even more erratic fashion from November 4, 2020 to January 2021 — I know he won’t over-stay.

Why? Because I know the Department of Defense, the Joint Chiefs, the armed forces, and federal troops, and even the local DC police will be only too happy to come in, at 12:02 pm on that cold January day in 2021, and leave him, and his scattered crap… in the street, on what is now called Black Lives Matter Plaza. [At this point, his own Secret Service detail is likely so sick of him and his denigrating of our troops, they’d almost certainly do it — free of charge, too.]

John’s version is that he leaves gracefully. I am pretty certain nothing the man has ever done could be called graceful — but he will be told that he can leave quietly, or he can leave… in cuffs.

It is, as ever — his nightmare to create. And we know he loves… the drama.

As I close tonight — I can’t help but grin, and grin widely, at how the Boaters for Trump “Bath-Tub Navy” sunk goodly portions of… its own fleet, on nearly three successive weekends.

It seems these are (like all Trump supporters) quite possibly the dumbest water-people alive, as they can’t even be called… boaters (let alone midshipmen) — since they seem unable to grasp the idea of a… wake.

Again, for the third time today alone, thanks for the gift, you Trump/Hinderaker white boys. It was a nice nightcap, for Saturday night, when I looked at the news — from that lake in Texas.

It is hard to imagine a more poetic self own, for (On-Water) Team Trump.

Out.
