[U] It Is My View That Uniformity Would Have Been Better, But Much Of The Benefit Has Already Been Achieved… On OSHA Vax Standard.

Without the Labor Department’s otherwise uniform rule, larger multi-state employers will now face a patchwork of regulations, some conflicting, state by state. [Tomorrow’s official withdrawal, here — as a PDF.] This should (in a rational world) be an issue larger GOP friendly employers should care about: they should have been careful what they wished for. Now they face a patchwork of conflicting state standards — greatly increasing their regulatory burden, with no discernible benefit. That used to be St. Ronnie’s complaint, about federal regulations. Now, since Texas and Florida are outliers, larger employers are left unsure of which laws to follow. Charming. Well done, Tangerine-heads. End update.

But so be it — employers are entitled to make reasonable rules about eligibility for a job, or even continued employment, for current long time employees. Most large employers in the North, especially, have already adopted what amounts to mandatory vaccination rules. Any state level challenges by employees (for example in Texas or Florida) should be met with the answer that no one has a “property right“, to work for a given employer. That is the mantra of the GOP, on all other (i.e., race discrimination) fronts, related to employment. The GOP sees it as a hard “at will” rule. So I expect that most southern employees who bring state level suits against a nationwide employer (like Amazon), for forcing vaccines… will not prevail — even in Florida and Texas. [In what amounts to a clearly-intentional bit of irony, of course Govs. Abbott and DeSantis and their cohorts will continue to blame President Biden for not stopping the pandemic they themselves are prolonging — in their states.] But we shall see.

As I’ve earlier reported — excepting only GE — I do not think any employer with over 80,000 employees in the US has decided to no longer require vaccinations, now that these employers have ALREADY adopted those workplace rules. Here’s the latest:

…The Biden administration is withdrawing its requirement that large employers mandate workers be vaccinated or regularly tested, the Labor Department said on Tuesday….

The Supreme Court’s decision, which was 6 to 3, with the liberal justices in dissent, said the Labor Department’s Occupational Safety and Health Administration, or OSHA, did not have the authority to require workers to be vaccinated for coronavirus or tested weekly, describing the agency’s approach as “a blunt instrument.” The mandate would have applied to some 80 million people if it had not been struck down.

The Labor Department’s decision to withdraw the rule means that the outstanding legal proceedings will be dropped. The case was headed back to the U.S. Court of Appeals for the Sixth Circuit in Cincinnati for further consideration….

There are certainly more important hills to die on, than this one, for Mr. Biden.

So, as is often the case — many lawyers will make lots of money, giving seminars on how larger and smaller employers even, may avoid being sued under one of these patchwork state level measures — specifically under Gov. Abbott’s, or Gov. DeSantis’s unscientific executive orders.

It is fascinating though that — in the main — the GOP showed open distain for workers’ health and safety and union-organizing rights for over a half-century, here… and it still does, except on this one MAGA issue. Silly, that. But whatever. Onward, grinning… frigid but clear here tonight.

Hey, Powerline Boys: Come Get Your Tenn. GOP (Moron) Colleagues Here…

Or, solid science suggests that… if something is seen by 20 per cent of a given population by an objective surveyor — it does certainly… exist.

So there is no sense in which this journalism was a false report. This report restates the Navy’s own analysis — recognizing that racism, at least aboard aircraft carriers, remains a real problem. But these GOP Tennesseans — at the state level, think the right answer is to attempt a prior restraint of the free press that reports on it. Not to address the actual root cause: racism, among the ranks.

What a pack of… goose-stepping, brown-shirted losers. Here it is in full:

…Dorothy Tucker, president of the National Association of Black Journalists (NABJ), expressed the organization’s support of Stafford and AP News. Rebecca Aguilar, president of the Society of Professional Journalists (SPJ), said the organization also stood with Stafford and called the piece “outstanding.”

“We cannot allow politicians to stop journalists from exposing the truth,” Augilar wrote. “We owe it to the public.”

The resolution, filed Jan. 22, calls on both houses of Tennessee’s legislature to ‘reprimand’ The Associated Press for the article for… attempting to “identify a problem that does not exist….”

Who are these under-educated idiots (cough — Kingsport!) in the Tennessee state house?

Geez — people of Tennessee — do better, at picking representatives that understand junior high level civics.

Out, grinning (in any event) — to film a favorite new public park sculpture, now frosted with white powder, overnight — six inches worth.

Just Go Read All Of This. Just Do.

Again, EmptyWheel has a great piece out this morning — carefully and thoroughly explaining in a very patiently rational way… why the calls by some on the left to use an independent counsel, since they believe US AG Merrick Garland is not directly moving quickly enough to get Tangerine on the January 6 lawlessness… are misguided.

Do read it all — but here’s the punchline:

“…If you believe that Trump’s actions played a central role in the insurrection — if you believe that the violent mob mobilized on January 6 was an important part of plans hatched at the Willard Hotel — then creating a separate investigation to investigate Trump does nothing but remove him from his liability in crimes already charged as sedition. That’s why calls to appoint a Special Counsel are so stupid. They treat Trump’s crimes as separate and distinct from those of the mob that he mobilized. There’s no reason, at this point, to do that (if Democrats were to lose in 2024, there might be)….”

Now you know. Onward.

Will Ivanka Cooperate With The January 6 Committee? I Think She Will…

Once again, EmptyWheel is the definitive source to follow, on all of this. At least if you want to know what is really going to happen, that is — not in the land of Q.

I expect she will come in and claim that she was “against the sedition” all along. But that won’t be… enough. She indeed will have to turn over all her records, to the National Archive, and that office in turn will have to allow the Committee access to them, as she has no real privilege claims, and was a member of the elite Executive Branch, in various capacities ever since 2017. In there will be her privatized deal to sell Chinese made voting machines, with chips in them (under her personal brand license) in various localities inside Georgia — among other things. Charming.

…[T]his letter has focused on the many other scathing details included in it:

▲ Proof that Trump knew he was making an illegal request of Mike Pence (and that Ivanka knew such pressure was wrong)

▲ Proof that multiple people attempted to get Trump to call off the violence (and that staffers repeatedly asked Ivanka to intercede to get him to do so)

▲ Proof that advisors including Kaleigh McEnany and Sean Hannity attempted to get Trump to disavow these efforts

In response to the letter, Ivanka issued a statement making it clear that [only as of] on January 6 [2021] she disavowed the violence caused by her father.

“Ivanka Trump just learned that the Jan. 6 Committee issued a public letter asking her to appear. As the Committee already knows, Ivanka did not speak at the January 6 rally. As she publicly stated that day at 3:15pm, “any security breach or disrespect to our law enforcement is unacceptable. The violence must stop immediately. Please be peaceful. . . .”

But that doesn’t account for another detail of the letter that has gotten far less attention than the eye-popping new details about Trump’s actions: Chairman Thompson reminded Ivanka (in a paragraph that seemingly addresses another topic) not just of the requirements of the Presidential Records Act, but also that she got formal notice of those requirements in 2017….

Should be entertaining. If she ever hopes to avoid going down with the Tangerine Conspiracy (and possibly end in a jail cell), now is the time to come clean. We shall see.

Hilarious Friday “Stupid Criminals” Dept.: Rudy’s “Kracken” Turns Around, And Swallows HIM, Whole!

The third party neutral / monitor engaged by the USDC in Manhattan — to review Rudy Giuliani’s seven devices — pursuant to the warrants issued last year, on the criminal insurrection investigations (while being mindful of attorney client privileges if any — and protecting against unduly broad “fishing expeditions”) has filed an updated status report overnight.

It strongly suggests that Rudy is in deep peril, as is Tangerine himself — since we may fairly assume Rudy had no filter, on those devices. None, whatsover.

Do go read Emptywheel for all of the implications, but here are the full findings from the status report, and an interesting bit:

…After consultation with the Government and Mr. Giuliani’s counsel, I next assigned for review the chats and messages on Mr. Giuliani’s remaining devices within the time frame December 1, 2018 to May 31, 2019. There were 3,204 such items. Mr. Giuliani’s counsel informed me that they do not assert privilege over any of these documents, and they were released to the Government’s investigative team on January 19, 2022….

Now you know… the gray steel wheels of justice it is said, turn very slowly — but they do grind… to very fine powder, in the end. Out now, smiling into the long shadows of the after-school Day 100 sunshine!

Gee Hinderaker: Math Is “Hard” — But 57.5 Is BIGGER Than 55.3.

Idiot.

The CDC has published multiples of risk reduction. So, a higher number (of risk reduction) is actually… wait for it… BETTER. More protective. [And it stands to reason, as a matter of pandemic bio-science, that a combination of vaccination, and prior COVID-19 exposure and recovery will be more protective that either one alone. That’s how one’s immune system “learns” to fight viral agents. Sheesh.]

Last night, Hinderaker wrote that the latest CDC study shows that getting exposure to COVID, while unvaccinated, is more protective than would be one’s chances, in the same population, after vaccination.

That is demonstrably untrue, even in the pull-quote he provided.

The guy’s cheese has slid off his… cracker. [Or, more likely… it is intentional disinformation, for his Q-addled readership, to distract — since Rudy is going down in flames, along with Baby T. See next post.]

Out.

One Year On… We Learn Of The Sacrifices People Of Color Make — In Just Speaking Their Minds…

Whether 100 days on — or a full-year on, or 42 years on, we were alerted by an erstwhile long time commenter to a sad story about the transcendent moment at right.

When a person of color makes any public statement, it is often at a price — to their privacy at a minimum, and it seems, in many cases, to their very safety. Here is that story:

…I was scared of failing my people, my poetry. But I was also terrified on a physical level. Covid was still raging, and my age group couldn’t get vaccinated yet. Just a few weeks before, domestic terrorists assaulted the U.S. Capitol, the very steps where I would recite.

I didn’t know then that I’d become famous, but I did know at the inauguration I was going to become highly visible — which is a very dangerous thing to be in America, especially if you’re Black and outspoken and have no Secret Service.

It didn’t help that I was getting DMs from friends telling me [to buy a bullet-proff vest and wear it]….

Like Anon., this saddens me. Just as it saddens me to this day that Dr. King had to endure much the same, over many years — and this cancerous hate ultimately took him from us.

But in the same breath, I am also terribly proud of her… and her courage. She is the embodiment of our… better days ahead, our undiscovered country… our… shared “out of many, one…” future. Onward, twice at 9:08 AM, smiling. ….

What Marsha Blackburn Hath Wrought — “Only X-stian Belief Adoptions”?! — But The Holston United Methodist Home Takes State And Federal Funding.

If a health care / adoptive services provider takes state and federal funding (as Holston United Methodist Home does), it may not discriminate on the basis of religion. Full stop — that’s about 75 years of black letter Supreme Court law. [See, for example, United States .v Windsor, 570 U.S. 744 (2013) — see also Church of Lukumi Babalu Aye, Inc. v. Hialeah (1993).] But that is precisely what Mr. Williams does, here.

This is what happens when GOP operatives insist we are a “christian first” nation. We are precisely… Swiss, on the matter. Marsha Blackburn is in no small measure responsible for driving this ahistorical, and unconstitutional perversion of American values. Here’s the bit:

…The couple said the agency initially told them that it would help them with their out-of-state placement, but later told them it can only serve Christian-belief families, the lawsuit alleges.

“I felt like I’d been punched in the gut,” Elizabeth Rutan-Ram said in a news release. “It was the first time I felt discriminated against because I am Jewish. It was very shocking. And it was very hurtful that the agency seemed to think that a child would be better off in state custody than with a loving family like us.”

The agency said in the lawsuit it has received public funding to provide foster care placement and training, among other services, for the state Department of Children’s Services….

The image at right really says it all. Who ARE these people? Did they ever take High School Civics? Damnation. Out.

I Gather Scott Johnson Believes There Is No “Federal Interest” Presented By A White Cop Choking A Black Man He Knew (With “Malice Aforethought”)… To Death, After Subduing Him.

Under an uninterrupted line of Supreme Court cases going back to Bivens in 1965 (a case my professor argued before the Supremes!), it is clear that actions by officers acting ostensibly “under color of law” squarely present federal questions, and allow the civil rights statutes, including the Anti-Klan Acts, and the Fourteenth Amendment — to be asserted as lawful objects of criminal inquiry, by the government in prosecutions.

But Scott either never learned any of this in law school, or more likely is intentionally ignoring it when he writes:

…Chauvin’s federal prosecution had little justification beyond politics. The government has identified no separate federal interest in the civil rights case against Chauvin. It didn’t even try. It was simply silent on this point….

I get it. Scott, John and Paul and Steve all believe that killings of people of color… don’t matter — especially when white cops do it.

The law — both in Minnesota, and at the federal level — is, and has been clear, since before these morons went to law school… that it does matter.

Welcome to the real world boys. Every day, the federal law machinery piles on charges — in the prosecutions of what could otherwise be state level, non-violent drug offenders, and judges in the South, especially… “stack” sentences on each (running one after the other, not concurrently), so that life without parole is the outcome. These old white coots look the other way when that happens, predominantly to accuseds of color — but cry like stuck pigs — when murdering white cops face the same process.

These cops will be convicted on federal hate crimes as well, now. And the sentences ought to be stacked — even though they won’t be. [We saw this effect, last week, here in Chicago, as Ex-Chicago-Police Officer Jason Van Dyke, who shot LaQuann McDonald 16 times, killing him… is already in a halfway house, having served over half of his jail sentence, for voluntary manslaughter.]

Thank goddesses these old white racists are dying off, one by one.
