Steve Hayward: Twitter’s… Very Own Village Idiot.

So Steve Hayward purports to see that Twitter was “censoring” right wing people, and providing bots to left leaning politicians, from this simple graph at right.

H I L A R I O U S.

The most likely explanation is that blues are losing followers, as we all decamp to Mastodon or Counter Social… and only cross post, or vanish from Twitterdom.

And, correlatively, red followers are leaving Truth Social and Gab and Parler, to return to follow MTG, and her ilk.

In sum, this in no manner indicates that Musk has brought “freedom” — or that old Twitter blunted it.

Just ask yourself: why are the larger, established advertisers leaving Twitter?

Because this arriving (red) MAGA wave… is by and large… suspects, not prospects (just ask Stewart Rhodes).

Out.

[U: KBJ’s Recorded Dissent] Despite Clear Evidence That A Mizzou Prosecutor Regularly Made Black Defendants “Death Eligible” While Sparing Whyte Ones… Supremes Let Another Black Man Be Executed Last Night.

Updated 12.01.2022 AM: Justice Brown-Jackson signed a very cogent dissent (joined by Justice Sotomayor) to the killing of Mr. Johnson. It is here, in full — and a bit now:

…[T]he [Mizzou] court’s determination that there was not “clear and convincing” evidence to support the motion to vacate in the absence of a hearing in which there would have been a chance to produce such evidence, as the statute requires, transgressed core procedural due process principles. See Gagnon v. Scarpelli, 411 U. S. 778, 786 (1973) (noting that the “‘minimum requirements of due process’” include an “‘opportunity to be heard in person and to present witnesses and documentary evidence’”). Indeed, it is unclear how the Missouri Supreme Court could have validly determined whether there was “clear and convincing evidence” of a constitutional error when the mandatory hearing at which evidence relevant to that determination would have been presented did not occur….

It is also noteworthy that Johnson’s prior and unsuccessful assertion of claims concerning selective prosecution and Batson v. Kentucky, 476 U. S. 79 (1986), did not preclude the invocation of §547.031 and Johnson’s corresponding federal due process claim, notwithstanding the Missouri Supreme Court’s contrary suggestion. See Order 11–12, 16, 19. If the required hearing had been held, someone might have pointed out that §547.031 itself “permits a prosecuting attorney to present all evidence relevant to such claims, regardless of whether the defendant is procedurally defaulted from raising such claims.” Id., at 8 (Breckenridge, J., dissenting). In any event, it appears that much of the evidence that could have been presented at the nonexistent hearing was new evidence relating to the trial prosecutor’s racially biased practices and racially insensitive remarks. And now that evidence will not be considered on the merits by any court, much less the one that was supposed to base its conclusions about the validity of Johnson’s conviction on all such evidence, per the statutory mandate. For all of these reasons, I would have granted the stay….

End update.

The Supremes’ radical racist whyte right wing is in full-on high dungeon, this Holiday Season. [Of course, Hinderaker rabidly supports the death penalty. But if one of the Oath Keepers were to receive it, he would be a pure… abolitionist.]

Both KBJ and Sotomayor would have spared this Black man in Missouri (one other justice had to recuse, due to prior involvements), given the weight of the evidence that this prosecutor selected people for death — based largely on the color of their skin. This whole notion violates the Eighth’s “no cruel and unusual” punishments — and obviously so, under prior Supremes’ decisions:

…[T]he selective prosecution claim proffers evidence that McCulloch treated African-Americans who killed white police officers differently from a white defendant who killed such an officer. And the difference was not just the fact that McCulloch sought death against all four African-Americans who had killed white police officers but not against the one white defendant who had done so.

It was also the fact that McCulloch gave the white defendant (Forster) the opportunity to present mitigating evidence to McCulloch in order to persuade him not to seek death — an opportunity he never afforded to any of the four similarly situated African-American defendants. These facts set out a claim for selective prosecution under United States v. Armstrong, 517 U.S. 456 (1996)….

In sum, more than a few whyte murderers live on in Missouri, while brown and black ones… are put to death, by prior official prosecutorial “targeting“. That is what a court-appointed commission found, in abundant on the record evidence. But the six still rushed ahead to kill this man.

Yes, he committed the murder — but he was entitled to be treated the same way a whyte murderer was (including a right to present mitigating evidence). That plainly did not happen. But he is dead already. So that discussion won’t ever be had.

Hinderaker Writes About “Eating Bugs” — To Avoid Mention Of Trump Pal Rhodes’ Conviction Of Felony Sedition: 01.06.21.

Not surprising.

This alone is a 20 year felony.

Buckle up, Tangerine… your time is… coming.

And soon.

Hinderaker is droning on, tonight, about how he believes (senility-laced) that “liberal progressives” want all humans to get used to eating bugs, to “save the planet”.

Or… something — I don’t really follow is thoughts, here. But it is all certainly to avoid mentioning that the Oath Keepers’ leader, founder and close pal of Roger Stone / Steve Bannon /and therefor, Tangerine… is gonna do 20 for sedition against the United States of America.

Sit down, Hinderaker.

Scott Seems… Obsessed: Gender Is In No Manner Relevant To The Alleged Theft.

But Scott Johnson makes his central focus in the story of a rather mundane petty theft allegation… the gender identity (or, more precisely, the fluidity thereof) of the alleged thief.

He includes several photos, to firmly fix his disapproving glare upon the supposed thief. But it seems at least plausible that this was a case of mistaken bag retrieval at an airport carousel.

In fact, one could be forgiven for wondering whether hard right TSA agents haven’t shaded the telling, so as to make it seem more nefarious.

In any event, I might ask why he (and John) did not run lots of photos of Anthony Weiner at his synagogue, or at Seders or bar mitzvahs… to firmly fix Weiner’s Judaism as a central part of the stories which led to his losing elections — and get disbarred. Why didn’t he run those “Jewishness” photos, along with those sex crimes allegations?

Never mind. We all know why. He’s a doddering old misogynist.

In the petty theft claim, he reports it as the Brinks Job mostly to shame the gender identity involved.

Charming.

Special Master Dearie Is Speedily Narrowing Any And All Grounds For Tangerine To Disagree, In Mar-A-Lago Secrets Case…

We all knew there was no “there, there” when he complained to sycophant USDC Judge Aileen Cannon in Florida’s Southern District.

And day by day, the record is making this definitively clear. Tonight, the Master, Raymond Dearie has called off a December 1 hearing, because so little remains unresolved. And all that has been resolved… has gone AGAINST Tangerine’s false claims.

The parties are down to just a small handful of disputed documents, none of which even remotely suggest governmental overreach, as Tangerine had improbably earlier claimed. No, he’s been caught red handed, with stolen Top Secret documents:

…Upon further review of the record, the Special Master has determined that there are no matters requiring counsel to travel to Brooklyn for an in-person conference. The conference previously scheduled for December 1, 2022, is therefore cancelled. Instead, the Special Master directs the parties to respond jointly to the following questions by 5:00 p.m. on December 1, 2022:

1. Do the parties dispute the categorization of the following records under the Presidential Records Act, 44 U.S.C. § 2201, et seq. (“PRA”)? In each case, the parties’ spreadsheet summarizing their respective categorizations and disputes reflects that the parties have a PRA dispute despite both sides categorizing the document as a “personal record.”

a. Bates no. 156 | e. Bates nos. 12246-48

b. Bates nos. 476-79 | f. Bates nos. 15167-68

c. Bates nos. 3971-77 | g. Bates nos. 17993-95

d. Bates nos. 4017-18 | h. Bates no. 17996

2. Do the parties dispute the PRA categorization of Bates no. 7017? The parties’ spreadsheet reflects differing categorizations but also lists the document as not being in dispute.

3. Does Plaintiff assert executive privilege with respect to Bates no. A-054 and A-055 (documents 15 and 16 of the Filter Materials)? Compare ECF 160-1 at 2 (letter from Plaintiff’s counsel noting that “there is no further matter to resolve” as to each) with ECF 187-1 at 4 (subsequent letter from government reporting that each document is disputed based on Plaintiff’s assertion of executive privilege).

Signed by Special Master Raymond J. Dearie on 11/28/2022….

Now you know. Onward, grinning — in a now very quiet house… with snow not too far off — and the cacti, shortly after that. Smile.

Retiring Merck Chairman Ken Frazier: “American Democracy Is In Danger”…

Mr. Frazier is absolutely spot on / 100% right, here — and it is the people who blindly follow Tangerine (and, of course Tangerine, Nick Fuentes, Stephen Miller, Roger Stone and Steve Bannon — among others) that most imperil this, our rather fragile experiment in liberty and law, now 240 some years on.

Here’s the Matt Herper item — but it is presently pay-walled at STAT+, so I won’t quote it at any length:

…[Mr. Frazier,] the former chief executive of Merck, has been the preeminent pharmaceutical CEO of his era. He is also likely the most prominent CEO to have spoken out against the former president, Donald Trump….

Do go read it all.

Onward, to make O’Hare airport drop-offs now — but the desert holidays are only about four weeks out!

It Has Been 13 Days Without A New Case Reported… But 42 Days Are A Minimum To Declare An Arrest Of Ebola.

There is encouraging news, this weekend of giving thanks in America — out of Uganda and out of Mubende District, particularly — as indicated at right (courtesy WHO for the base graphics, from which it was derived).

But there is still a long way to go. This time, we are at 77 dead — and have not yet turned the corner on new cases. Here’s the latest from WHO, on the ground there:

…The weekly number of confirmed cases reported has decreased for the third consecutive week (Figure 1) after the peak observed in the week 17-23 October. During the week commencing 7 November, five confirmed and one probable case was reported, including one confirmed case and one probable death from a newly affected district (Jinja), in the Eastern Region of Uganda, which is 80 km distant from Kampala. The most recent confirmed case was reported by the Uganda MoH on 14 November, from Kampala district….

Since the last [official report] published on 10 November, one newly affected district has been reported (Jinja), leading to a total of nine districts that have reported confirmed SVD cases.

The most affected district remains Mubende with 64 (45%) confirmed cases and 29 (53%) confirmed deaths, followed by Kassanda with 48 (34%) confirmed cases and 20 (36%) confirmed deaths. Two districts, Bunyangabu and Kagadi, have not reported cases for more than 42 days….

So, bit by bit… the forces of bioscience are gaining the upper hand.

Now you know. Be excellent to each other — and do be grateful, for all… that is. [It seems the potential case in the UK was a false alarm.]

In Which We Learn That Hinderaker Prefers To Announce False Absolutes — So He Can Ignore Hard, And Nuanced Line Drawing…

In a piece that purports to “help” Elon figure out how to moderate content, Hinderaker says he is a free speech absolutist. But in the next paragraph, he says… “just kidding”. [Along the way, he congratulates himself for drafting a purely Orwellian “statute” that Minnesota rightly completely… ignored. And the Supremes (via the Florida version) declared flatly unconstitutional on its face. We reviewed it all, here in the Spring of 2022.]

In any event, all of these sidecars of his… purport to take him (and Elon) off the hook — for the real hard work — the hard work of deciding, for example, what is actually entailed in the predicate offense of “conspiring to commit terrorist acts.” [So the DHS and FBI will have to do that, I guess — and hope not to kill people in the process. When just muting a idiot might save lives?! Wow.]

In truth, this is something the federal and state courts have struggled with, since 9/11 in great measure — so for 22 long years, and mostly on a retrospective, not prospective basis. These lines are exceedingly difficult to parse — especially in a fairly free-wheeling society of ordered liberty, like ours.

But John sweeps it all away, so he can take a pot-shot, at what (he imagines) “liberals” think. No shading; no gradation — just his “my way or the highway” views. Charming.

I will note that John expressly supported the whyte supremacist goons who were plotting to kidnap the sitting Governor of Michigan, about 25 months ago. He said that they were entrapped; that they were only expressing “dissent” against the “terror” of COVID-19 abatement measures. So we well-know… he cannot be trusted to draw these difficult lines.

Here is his nonsense “axiom”, in full:

…I don’t think the issue of content moderation on a social media platform is particularly hard to resolve. First of all, on reflection anyone — including more-or-less absolutists like Musk and me — will agree that some content moderation is necessary. Bots should be banned, child pornography should not be permitted, users should not be allowed to conspire to commit terrorist acts….

So — to sum up — John Hinderaker has no idea of how to do this, even in the US — and is way out of his depth for running a service that hosts German-, French- and British- citizens (as just three examples)… where the law is not so free-wheeling. [Consider here, the quite sensible German laws (given its not-so distant history) against praising Nazi ideals, or symbology, for example.]

My advice for Elon? Good luck, Elon — you’ll need it. You were stupid enough to fire 90% of what was working. Now you’ll have a cloudy, dying $44 billion snow globe on your mantle by Xmas, as advertisers depart, en masse.

Hilarious.

Hints To Tangerine Lawyers: Don’t Try To Lie To Jack Smith, On The Law…

So… In the Eleventh Circuit, after oral argument — Mr. Trusty tried to cite additional authority by letter, to effectively say that there is settled law for what Cannon did, in Miami. There isn’t.

Hers was a purely… flight off of any US federally-chartered map.

And Jack Smith just called Trusty out, for misrepresenting the facts in a prior New York Southern District case. So, Jack Smith, as Special Counsel, is these guys’ worst nightmare, thus:

“…Plaintiff asserts that In re Search Warrants Executed on April 28, 2021, No. 21-mc-425 (S.D.N.Y.), is an example of a case in which “a court has previously asserted equitable jurisdiction to enjoin the government from using seized materials in an investigation pending review by a special master.” 11/23/22 Trusty 28( j) Letter, at 1. That is incorrect.

As plaintiff recognizes, the court did not “enjoin the government,” id.; instead, the government itself volunteered that approach. Moreover, the records there were seized from an attorney’s office, the review was conducted on a rolling basis, and the case did not involve a separate civil proceeding invoking a district court’s anomalous jurisdiction. Cf. In the Matter of Search Warrants Executed on April 9, 2018, No. 18-mj-3161 (S.D.N.Y.) (involving similar circumstances).

None of those is true here….”

Yours truly,
JACK SMITH
Special Counsel

These Trumpians are dead in the water, and many of the lawyers representing him have put their own law licenses in jeopardy, in trying to please an inveterate liar.

And… I. Love. It.

Scott And John: We Think All GOP Election Losses… Are “UN-Fair”!

This is what is left of the GOP brand: declaring only elections that Republicans win are… fair.

And alleging fraud, whenever they lose.

Now it even goes to the structure of state decisions, on how to elect. Since Palin lost in Alaska, on a ranked choice vote — one plainly chosen by the people of Alaska, a few cycles ago… Scott claims it is not fair to GOP voters and views.

Quintessential whiners’ behavior:

These decrepit, addled, and embittered mediocre whyte boys are… so precious to behold.

Glad they are a dying breed — and brand.

Happy turkey day, one and all — here at above right are your gobblers!
