Qatar Is… More The GOP’s Jam — Like CPAC, In Hungary Over The Summer, Right, John?!

John Hinderaker’s nightly Powerline columns: where irony apparently goes… to die.

John clicks his tongue at the EU Parliamentarian who has been caught taking bribes (for among other things, crypto- policies AND World Cup landing locations).

It is mostly hard right/libertarians pushing crypto- cons here in the USA, and it is mostly GOP dignitaries looking the other way as nearly enslaved African and Chinese migrant workers died in the heat by the hundreds, to give Qatar a stadium and facilities that would be deemed world class — all in record time.

So… John: please explain how and why she is not more like you, and your PPP loans, never repaid… than unlike… you.

Ironic, that.

Or… perhaps… moronic, that.

CZ’s Role In Whatever This Ongoing “Compliance Nightmare” Is — Or Was — Now In DoJ’s Crosshairs.

This is from Reuters’ original reporting, but is being republished far and wide, now… so I feel safe in the knowledge that all I am doing is re-stating what other MSM outlets allege is provable.

To be sure, there are several desks inside the DoJ that must sign off before a more-formal criminal inquiry gathers steam, and there is no way to know whether that has happened, or will happen. Nor is it known (in what would be potential “bank run” scenarios) whether it will lead to US felony indictments of individual officers and agents. [In addition, it might be hard to get long arm jurisdiction over CZ — as he mostly stays outside the US for much this reason.]

In any event, here is the latest, do go read it all — sheesh:

…Reuters has investigated Binance’s financial crime compliance over the course of 2022. The reporting showed that Binance kept weak anti-money laundering controls, processed over $10 billion in payments for criminals and companies seeking to evade U.S. sanctions, and plotted to evade regulators in the United States and elsewhere….

Binance has disputed the articles, calling the illicit-fund calculations inaccurate and the descriptions of its compliance controls “outdated.” The exchange has said it is “driving higher industry standards” and seeking to “further improve our ability to detect illegal crypto activity on our platform.”

Launched by Zhao in Shanghai in 2017, Binance now dominates the crypto industry. The exchange processed trades worth around $1.6 trillion in October, about half of the entire crypto market’s trading volume. That sum dwarfed its former challenger FTX, which handled $230 billion in trades that month, according to data site CryptoCompare….

And as I post this one, Mr. John T. Ray III, the “clean up” CEO at bankrupt FTX (in Chapter 11), has offered a preview of his sworn testimony to the US House Committee, for tomorrow. It is devastating, as BillyTheKid correctly notes. SBF and his close circle are… headed to jail behind this.

Yup Mr. Musk — It IS A “Crime Scene”. A Tangerine-Stained Crime Scene, To Be Certain.

Scott Johnson yammers on, again this morning about Musk’s “nothing burger”.

But as I’ve said — the boys are right insofar as Musk says Twitter is now a crime scene.

His words, not mine.

And again, it is EmptyWheel.net, proving day by day — that the crime… was a violent, murderous Trump-led insurrection on January 6, 2021.

Damn, moron. Get a clue.

Monday Morning Fun: Courtesy Anon. — Banksy Nearly Whacked In Ukraine By A “Babushka”?!

And in a slightly more serious vein, Banksy has called for people to feel free to steal clothes and other items from Guess (particularly the outlet on Regents Street, in London), as it was using his artwork without permission, or compensation — in ad campaigns. He has won the UK right to both trademark and copyright his work — anonymously, so Guess ought to seek permission, and pay royalties.

But back to the babushka — she apparently owns one of the buildings in Kyiv, Ukraine, where he was painting a mural, and so. . . chased him off angrily with a broom, as he was finishing the work. Here’s that whimsical story.

…Legacy of War Foundation lent Banksy one of its ambulances to work from when he painted multiple murals in and around the Ukrainian capital of Kyiv last month, he stated Friday for the release of a limited-edition print to benefit the group.

The vehicle “turned out to be extremely useful when an angry babushka found me painting on her building and called the Police,” he wrote on the charity’s website. “I feel the least I should do is raise enough money to replace the number plates on the ambulance I hotted up.”

In an Instagram post, Banksy shared an image of the rat-themed print. Sales will help Legacy of War Foundation as it supports civilians affected by Russia’s invasion, which began in February….

Now you know — and thanks, Anon.! Hadn’t seen any of this, prior to your note… smile. Onward.

FTX’s Creditors Remain Under Wraps, For Now — But NYT, WSJ And Others Are Right: Pretty Soon, Their Names (At Least) Should Be Disclosed.

This is a delicate situation, that I will grant you. There are several crypto- market players who’ve already been toppled by the amounts that it is clear they cannot recover from Alameda/FTX; and many of the larger creditors are unlikely to ever see more than a dime on the dollar. So it is easy to imagine “bank runs” on firms that are at least surviving for now, if the capital market arbitragers were to learn that the exposures to FTX render them insolvent, as well. So for the moment, until a better sense of whether more may be available to pay them is disclosed. . . perhaps they should remain. . . masked, in Delaware.

We already have seen the dollar figures. They reach in to the middle hundreds of millions, in some cases, and in total are well over $4 billion now. So the public does have a sense of the size of the problem SBF created, for all of crypto-. And with perhaps ~$7 billion in FTX/Alameda customer funds missing, in the aggregate. . . this is all quite dire.

But it is also true… that in America, the presumption is that courts function best in the bright light of day. And that is precisely what some able lawyers for major media (NYT and WSJ and Bloomberg among them) now argue: the First Amendment, and the free press clause, in particular… dictates that the names need to be made public — so that the public may be confident that all names are being provided equal, and not greater protection, under the law. The bankruptcy laws.

I think they will prevail, though it may be a few months yet before they do. At some point, it will become clear how much each (or what a small percentage each) will get, and then it should all be shown to the public. But what about between now and then?

Me? I’d propose an unusual solution: there is no reason not to shuffle the names several times, like a Vegas casino’s four deck shoe. . . from the list that has the figures already disclosed. . . and then simply publish the names. No figures. There will be no way to know whether a given name is owed a few hundred thousand dollars — or a few hundred million. But that would help all market participants have polite (but firm) discussions with the parties involved… and at least try to protect themselves. Or begin to get into a defensive posture, to do so.

But now — we will have to wait and see… whether the federal courts see it the way the media lawyers see it:

…The bankruptcy filing is of significant and legitimate public concern given FTX’s leading role in cryptocurrency, the scale of potential mismanagement and wrongdoing, the reputational and financial impact of its collapse on the cryptocurrency field, the scale of creditors’ losses, and the related, collateral financial impact on third parties and markets….

Records in these proceedings indicate that potentially more than a million creditors will be affected. D.I. 45 ¶7 (“the Debtors have hundreds of thousands if not over one million creditors and other parties-in-interest”). The Media Intervenors and other news organizations have been closely reporting on these proceedings and issues.

Debtors have been accused of lack of transparency in their business. That mindset appears to have carried over to this bankruptcy, as they have taken the extraordinary step of seeking to keep under seal their list of creditors….

Indeed. The time is coming, but why not release a random-order list of just the names? No amounts — no addresses. Just corporate names. That is a sensible middle ground. And it will allow collateral partners of these creditors the ability to at least try to limit the carnage. Do it.

Again On Sunday Night, Hinderaker Is Desperate NOT ToTalk About The Nothing Burger Of Musk’s Self-Released Tweet Threads On “Shadow-Bannings”…

About a half a week ago, John Powerline was claiming this was the “smoking gun”. And about eight days ago, Scott Johnson was crowing that it all would bury Biden — and the DNC… even suggesting it proved the QAnon nuts were right about Hunter’s “laptop”. It does… not one of those things. Not even close. In fact, what’s been adduced thus far does the opposite: it implicates Tangerine more directly — in sedition (as most sober observers now agree).

So, suddenly, and in a 90 degree pivot, the boys are saying… “well, there’s too much volume here to sort through… so for now we will just say… Musk must be right — it smells bad.”

Quite a soft-pedal. That’s because if this all shows anything, it shows that Tangerine — as Individual No. 1 — created all the fires that led to the January 6 ran-sacking of the Capitol. It proves he was the “Inciter in Chief” — without a doubt. But Musk’s hand-picked “small j” journalists won’t do anything even as simple as lay these tweets out, in a time line — one that intersperses know public evidence about 1/6/21… into the context of the tweets. But EW has — in exceedingly helpful fashion, over the last few days.

To understand just how UN-important Musk’s insinuations about his own curated disclosures actually are, one only need read EmptyWheel — top to bottom. She’s got him (and Tangerine!) dead to rights: Musk is indeed “presiding over a crime scene“, as he so memorably puts it — just not the one he imagines:

…One distinct possibility that Matty apparently didn’t even consider is that, in the wake of the coup attempt, Roth had meetings with law enforcement, including the FBI, that were qualitatively different from those that went before because… well, because Twitter had become a crime scene! Consider the possibility, for example, that FBI would need to know how Trump’s tweets were disseminated, including among already arrested violent attackers. It was evident from very early in the investigation, for example, that Trump’s December 19 Tweet led directly to people planning, among militia members and totally random people on the Internet, to arm themselves and travel to DC. Or consider the report in the podcast, Finding Q, that only after January 6 did the FBI investigate certain aspects of QAnon that probably could have been investigated earlier: Twitter data on that particular conspiracy would likely be of interest in such an investigation. Consider the known details about how convicted seditionists used Trump’s tweets in the wake of the failed coup attempt in discussions of planning a far more violent follow-up attack.

Matty, for one, simply doesn’t consider whether Elmo’s observation explains all of this: that Twitter had become a crime scene, that the FBI would treat it differently as Twitter became a key piece of evidence in investigations of over 1,200 people.

None of this shows the “collusion” with the Deep State that Matty is looking for. Thus far, it shows the opposite….

Precisely.

Damn, she’s good.

And damn — Hinderaker is… senile, or dissembling.

Powerline Has Now Written 25 “Articles” On Hunter Biden’s Artworks. YAWN…

And, no surprise — that would be 25 MORE than it ever wrote on the fact that while working in the White House, Ivanka Trump — as a highly-trusted member of the Tangerine Administration… brokered a deal for herself, that allowed her to sell Chinese voting machines, under her personal trademarks, to the Russian government for a 2019 Moscow set of local elections.

There were reports that the Georgia Election Commission, then controlled by MAGA GOP, signed up to buy a few thousand of these Chinese/Russian online voting machines.

Yet Powerline offered… zero coverage. For four long years, not a peep. Damn.

Hunter is in no one’s Administration — he’s never held any elected office, nor been hired to work for a nationally elected Democratic official at any level. He holds no role.

He sells his art in galleries in DC. And, his art cannot spy… for foreign frenemies, and be used to jimmy election results. Full stop.

Hinderaker: Shilling Again, For Moscow / Putin’s Agit-Prop, In Ukraine…

John tonight clutches his pearls — and worries that the US / NATO may “sleepwalk” into what turns into a nuclear conflict with Putin, over Ukraine — or at least that somehow (inexplicably), Mr. Zelenskyy will find a way to use a nuke against Russia / Putin.

Riiiiiiiight.

I think (once again!) Hinderaker is being paid (or, receiving “donations” at his 501(c)(3)) by Russian oligarchs or state actors (but I repeat myself)… to sow dissent in the US, and spread dis-information.

What a loser.

What a sad little man.

Settlement Discussions Continue In Multi-Billion Dollar Merck v. Merck Lanham Act Case…

This one may well be nearing the finish line, over a decade on (or… a century, depending on how you count, from the end of World War I).

Of course there are lots of other companion cases like it, pending in courtrooms dotting the globe… but perhaps, just perhaps — here at near Christmas 2022 — this will be a truly global settlement. We can only hope — and specifically, this was filed overnight, on a Friday night in Newark:

…December 9, 2022

Dear Judge Hammer:

We, along with Sidley Austin, represent Plaintiffs Merck & Co., Inc. and Merck Sharp & Dohme Corp. in this matter. With the consent of Blank Rome LLP and Debevoise & Plimpton LLP, counsel for Defendant Merck KGaA, Darmstadt, Germany, we are writing with an update as requested by the Court’s Text Order of December 1, 2022 (D.E. 209).

The parties are continuing their discussions and therefore respectfully request a short extension to Monday, December 12, to provide a further update to Your Honor.

We appreciate the Court’s attention to this matter. . . .

/s/ [for] McCarter & English….

Getting excited for the return of my kiddos… out into the steel and glass canyons, and the half-light reflected there, from the emerging winter’s gloaming… to see “The Menu” — smiling. Ever, smiling.

Hinderaker: Repudiating The Policies Of Citizens United, AGAIN.

For 12 years John loved it.

Corporations are people — with the right to “speak” in political campaigns and debates, by spending money — airing commercials (or falling silent)… nearly without any limit. Any Super-PAC could obscure and bundle these corporate identities. That’s what the Supremes decided in 2010.

And ever since, Hinderaker praised it (because until at least 2019, the companies mostly supported GOP ideas and candidates).

But the odious excesses of Tangerine flipped it: now companies back nearly as many Democratic ideas and candidates, as GOP ones.

So — of course! — John yammers that it is “all censorship” of GOP views.

He can’t now accept that he and his fellow Federalists gave Twitter these rights, 12 years ago.

[And created the Tangerine, which generated the corporate backlash….]

Hilarious.

What a feckless, embittered, decrepit old moron. Again.
