In Which Tangerine Finds Out That FELONY Criminal Trial Schedules Are NOT SET/Delayed… For The “Convenience” Of Golfing [Faux] Billionaire Chuckleheads.

The able USDC trial judge in DC just ruled (in a three page PDF): Tangerine’s federal felonies trial, on the J6 charges, will take place on March 4, 2024.

Team Tangerine had wanted late 2026. That was never in the cards. He’s just another multi-felonies indictee, on the federal DC docket now.

And perhaps ironically, his own claims about (a trial — on his own conduct!) harming his campaign chances. . . militated very strongly AGAINST waiting. This way, he’s on a standard fast track — and if he’s to be believed(!), he will be cleared by early April 2024. Riiiiight.

. . .USDC Judge Chutkan just said the court’s calendar isn’t going to be beholden to Trump’s political and personal schedule. . . .

Chutkan, J.: “Mr. Trump, like any other person, will have to make the trial date work, like any other felony defendant. . . .”

As I’ve said many times before here, but especially so, now on the sixtieth anniversary of the March. . . “Go ahead, Tangerine — f-around. . . and. . . find out. . . .” See ya’ in DC on the morning of. . . March 4, man.

Sure Bill Otis — I’m Fine With Tangerine Running: “Run, Forrest… RUN!”

Yep. I’m fine with it.

Let him run… from jail, even.

You feckless, power-starved GOP-ers created, fed and worshipped the monster — when he was in power.

Now feel free to die by that very same… sword.

What is… hilarious, actually — is your collective level of self denial, from Jan. 2017 to this morning, in so, so many of the GOP-ers: it would always end just this way.

We, of clear(er) eyes… we always knew it.

But you feckless racists and misogynists… so desperately wanted to undo all Mr. Obama had done… you threw in, heart and soul and bank accounts, even… with the mobster.

And now, he and you are riding the lightening.

F L A W L E S S.

Yes, let him run.

Another Important Immuno-Oncology Combo Study Should Now Have Primary Results, Now: Merck + Eisai In Nonsquamous NSCLC.

The clinicaltrials.gov website indicates that Merck and Eisai should now know (as of August 21, 2023) the primary results from a study called LEAP-006, which is aimed at first line nonsquamous NSCLC — when also treated with old-line platinum chemotherapy. This might prove to be a form of redemption — from the moderate disappointment of the discontinuation of the same combo in other cancers, revealed last week.

This form of lung cancer is the second most common form of cancer, worldwide — but it is the most common cancer in the US, by a wide margin (due primarily to cigarette smoking). Over 238,000 people in the US will be diagnosed with it this year.

The terrible briden of this disease is almost hard to imagine, and survival rates/durations are… not great. Even a moderate improvement by this combo under study would be extremely significant for literally millions of cancer patients, worldwide.

…NSCLC is the most common type of lung cancer in the United States, accounting for 81% of all lung cancer diagnoses. In 2023, an estimated 238,340 adults (117,550 men and 120,790 women) in the United States will be diagnosed with lung cancer….

Now you know. This is a vastly burgeoning potential market for the two therapies. So we will wait and see, whether we learn more about the LEAP-006 top-line outcome this week. Fingers… crossed.

Sure. Whatever Helps You Sleep At Night, Bitsy. Yawn. Fabulists’ Edition.

Again we find that Elizabeth Stauffer… is… hallucinating, and on a Sunday morning, to boot.

She mistakes… trolling, in the Black community… for… support.

She doesn’t understand that not liking the prison industrial complex… is in no manner an omen of support, to garner Tangerine 2024 voters. [The naivete is… precious, though — to be sure.]

And… in the end, she posts about ten tiktoks and instagram memes that firmly establish Trump as a hard core felon, by association.

“Good shootin’ there, Tex!” [And it is likely all intended to distract from the MAGAt who published a manifesto, grabbed his swastika-festooned AR-15 yesterday, in Jacksonville and shot three black men dead — solely on the basis of the color of their skin. That IS Trump’s legacy, Bits.]

This would be a sad parody — except that she apparently actually believes her own non-sense.

2024 will be a GOP wipe out.

Out.

Partial Restoration Of Joy Silk Doctrine: Good News For Amazon Labor Union.

This is the August ’23 edition (slightly delayed) of our monthly check in, on labor matters that affect Amazon.

In it we hightlight a new NLRB decision that helps restore the so-called Joy Silk doctrine, in favor of more rapidly getting to the bargaining table, once a majority of workers have voted for a union. The endless delaying tactics used by recalcitrant management (like Amazon’s) are curtailed, here. Do read it all, but here is a bit, from a nice TruthOut / MSM summary:

…The National Labor Relations Board (NLRB) issued a new standard in Cemex Construction Materials Pacific, LLC that would force an employer to recognize and bargain with a union if a majority of workers had previously requested a union and the company had broken labor laws that would require setting aside the results of a subsequent election.

The decision represents a compromise version of the Joy Silk doctrine that’s been championed by the labor movement. Joy Silk specifies that, if a majority of workers have indicated their support for the union, employers are forced to recognize the union unless they have “good faith doubt” about the support. Cemex differs in that, if the union has majority support, an employer can still request a union election with a form known as an RM petition and is not required to recognize the union at that point….

“Today’s decision… will strengthen the Board’s ability to provide workers across the country with a timely and fair process for seeking union representation,” NLRB Chairman Lauren McFerran said in a statement. “The Cemex decision reaffirms that elections are not the only appropriate path for seeking union representation, while also ensuring that, when elections take place, they occur in a fair election environment….”

Now you know. Onward, into a sun-dappled bike riding Sunday by the lake. Smile.

In Which Bill Otis “Has A Sad” Because He Might Have To See — And Jostle With — Actual People Of Limited Means. YAWN.

These guys are all just so… pathetic. Somehow, Bill is working his way up to saying he will vote for Tangerine, again — if he’s the GOP nominee… because at least then he won’t have to look at poor people, on the streets of SF or Oakland or Chicago or Manhattan.

Uh-huh.

Aside from the ridiculous clutching of his pearls aspect of his latest burped nonsense… there is the notion that he will thereby guaranty the GOP loses in the general… to whomever the Democratic Party nominates. That’s a lock.

Although, as we’ve long predicted — a non-Trump 2024 GOP nominee will likely fare no better in the general, because Trump will break third party — and steal about a third of the GOP nominee’s otherwise predictable base votes.

So — in sum, Bill: you idiots gave yourself this sh!t show… entirely… willingly.

These are the consequences of your, and Paul’s fecklessness for six long years. And the fecklessness of John / Scott / Steve and Bitsy, too.

Cheers!

“Asked — And Answered” There, Bitsy. Asked, And… Answered…

So… Elizabeth Stauffer (like Hinderaker for two decades before her), on countless topics… this morning dredges up some old (2016) footage… ignoring that all of this has been long-ago thoroughly investigated, and cleared. Period.

She (but of course!) ignores that Tangerine tried a 2019 scheme of withholding Congressionally-mandated aid to Mr. Zelenskyy in the same area of the world, unless and until he agreed to run domestic US political spying/hacking sorties — on Trump opponents.

That’s what this is all about — trying to create a smoke-screen so that Trump doesn’t face a FIFTH or sixth indictment on felonies in federal courts in DC. That grand jury is still working, we are told.

Damn, Bitsy… try… harder. This effort was — like your last one — utterly… pathetic.

Out, grinning.

On to the National Mall, and a serious, working… 60th celebration, on Monday… next.

Moving Forward, 60 Years On… Still So Much… Undone.

Certainly the gains won ought to be celebrated and remembered.

Just as certainly, the influence of today’s MAGA GOP wing — on national and local politics — is a strikingly disturbing echo of the second rise of the Klan, in almost exactly the same role, from about 1905 to 1923.

In my life-time, this is the first time I’ve been genuinely concerned that equal, genderless rights under the law… might wink out of existence. From attempts to decrease female autonomy in certain states — over their own bodies… to escalated violence against humans for no reason other than their skin color… to broad daylight, openly violent attacks on LBGTQ+ humans… and the renewed rise of “sundown” towns, again… this is indeed… a perilous time.

Locally, one party super-majorities (as we’ve mentioned, in Sumner County, Tennessee, for example)… though claiming to be “Constitutional” Republicans — they are actually… fascists, trying to stamp out any opposition, to their ultra-repressive, one “religion” only, pre-Magna-Carta form of fiefdom rule.

So it is that over 10,000 are expected on the Mall, Monday.

I may just hop a flight and join them.

Time to reignite — and rise up. Rise up, to protect what so so many bled and died for.

Out.

The US Government Has Filed Its Closing Argument — About Eagle Pass, Texas — Against Gov. Abbott’s Lawlessness. [Update: Losing Texas Arguments Added.]

Not surprising. The Biden Administration is clearly right here.

Texas offers only distraction and bluster. Here’s the winner’s 13 page argument, and a bit:

. . .The United States is likely to succeed in establishing that the Rio Grande in the vicinity of Eagle Pass, Texas is a “navigable river” under Section 10. Four Acts of Congress (see Exhibits G-45 to G-48) recognized, and enacted provisions to protect, the “navigability” of the Rio Grande in connection with authorizing bridges and other projects involving foreign commerce (electric wiring and water connections) between Eagle Pass and Piedras Negras, Mexico. See Reply 3-4 (ECF 37); Surreply 3 (ECF 41) (Texas conceding that these statutes “concern obstructions ‘across’ the Rio Grande” at Eagle Pass). This alone establishes the government’s likelihood of success….

With respect to the larger segment of the Rio Grande over which the Corps’ Fort Worth District exercises RHA regulatory jurisdiction, the Court heard Mr. Shelnutt’s testimony about the District Engineer’s March 31, 1975 navigability determination and the study underlying that determination. G-34, G-35; Tr. 14-15. These documents establish that the District Engineer properly determined the Rio Grande is an RHA navigable water from river mile 275.5 — the boundary between the Fort Worth and Galveston Districts — to river mile 610.0, which is the boundary between the Fort Worth and Albuquerque Districts, about 135 miles upstream of Eagle Pass. G-34 at 1, 2; G-35 at 14-15, 18. Mr. Shelnutt testified that this 1975 determination is the Corps’ basis for including the Rio Grande on its 2011 list of Fort Worth District RHA navigable waters. Tr. 12-15; see also Compl. Att. 1. He testified that the 1975 determination remains in effect and that he relies on it in his day-to-day work as a regulatory project manager for the District….

Game. Set. Match. Now — will we see a ruling by Monday morning? Who knows? But the law is clear:Abbott loses; asylum seekers… win.

Now Fox And Bitsy Are Offering “Legal Opinions” — On Air From A Multi-Felon Convicted Capo, In The Old NYC Mob?!

Of course, the game here — for Bitsy, at least… is to put some purported “street cred” behind her libel and slander of the sitting President.

[Also, of course, if she wanted to genuinely engage on these topics in any adult, rational and principled manner, she might try to dance around this flawless takedown of the irony of GOP spin/posturing… on two cases. Two with nothing in common, other than they both involve politics — and felonies. But we well know she cannot win a fair fight. YAWN.]

Confidential Note, to Bits: citing the opinion of a felony-convicted former(?) mob boss for the proposition that any RICO indictment is a “slam-dunk“… is not exactly the best way to bolster whatever form of credibility you seek — for your wacky fever dreams.

But seriously, hun — you (and Faux) go right ahead. Make a bigger a$$ of yourself — I could. care. less.

And, I could NOT resist the meme at upper right, for Bitsy! [Thanks so much to the kind folks at blacktwitterthreads for putting the original together. It is… just delicious!] Cheers….

[Also, fun footnote: all the reporters use “alleged”, even post indictment. Ask your boy Tangerine. He knows… 4X.]
