We Ought To Be More Mindful Of Our Obligations… To Our No. 1 Trading Partner (Where We Import The Most, By Dollar Volume): Mexico…

As of the end of 2023, the US has made Mexico (by dollar volume). . . its number one import trading partner.

As of year end, this means China has been moved down a peg, to number two. [In truth we still import lots of Chinese minerals for EV batteries, and APIs, the “raw materials” for drugs — as well as silicon chips, storage devices and circuits, obviously.]

But instead of live blogging the Supremes this morning (we are confident that Tangerine will lose the Colorado case), I thought I’d note the irony of Texas’s unlawful cruelty to people arriving — seeking asylum — at our southern border, all while Texans enjoy the vast benefit of having less expensive farm goods, finely-woven cotton cloth clothing, and textiles in their homes, all sourced out of or through… Mexico. The tractor/heavy duty truck parts in Catepillar machinery rolling around in East Texas… they too almost all are built in Mexico, by highly-skilled, but lower wage-earning… Mexican workers.

And that’s before we talk about all the labor people without documents do, inside Texas — while paying US taxes, in full — to keep Texas restaurants open, parks clean, trees trimmed and gardens looking lovely. [And any Texan with eyes, and a heart well knows this: the state would close up, were it not for all the undocumented people helping them, and even caring for their children, in their homes… day by day.]

Mr. Biden realizes we need to treat our No. 1 trading partner with more respect. Tangerine never did. And despite his bluster, he regularly sucked up to the autocratic Xi.

The times… they are… a’ changin’… grin. Be excellent to one another.

Anything… To Avoid Mentioning Trump’s Legal Perils, Eh Hinderaker?

John wrote about some small time local DC defamation court case… all to ignore the graveyards he whistles past, daily now.

Two of those monsters are front and center, starting tomorrow: the Supremes will hear argument on the Colorado DQ appeal, and Justice Engoron in NY may drop an up to $450 million fraud finding in Trump’s lap tomorrow or Friday. And ban his businesses in NY. For life.

Out.

Forty Years Ago This Noontime… A “Human Satellite!” Bruce McCandless II Took NASA’s First “Free-Range” Space-Walk / EVA…

The sense of wonder, as I watched it in the law firm conference room on TV (while drafting public company M&A documents, old school, on paper!), was… palpable.

These were indeed… heady days.

…Bruce McCandless II was born June 8, 1937, in Boston, Massachusetts. His father was Rear Admiral Bruce McCandless, who won the Congressional Medal of Honor for his heroism during the Naval Battle of Guadalcanal. Bruce received a Bachelor of Science degree from the United States Naval Academy in 1958, a Master of Science degree in Electrical Engineering from Stanford University in 1965, and a Masters degree in Business Administration from the University of Houston at Clear Lake in 1987….

Bruce McCandless II was second in his class of 899 at Annapolis. He became a naval aviator in March of 1960 and was stationed in Key West, Florida, for weapons system and carrier landing training in the F-6A Skyray. His next duty was with Fighter Squadron 102 (VF-102) from December 1960 to February 1964, flying the Skyray and the F-4B Phantom II. During this period he served aboard the aircraft carriers the USS Forrestal and the USS Enterprise, including the latter’s participation in the Cuban Blockade in October and November 1962….

McCandless was one of nineteen astronauts selected by NASA in April 1966….

Mission Specialist Bruce McCandless first entered space on STS-41B Challenger, launched from Kennedy Space Center (KSC), Florida on February 3, 1984. During the flight, the deployment of two Hughes 376-series communications satellites, and rendezvous sensors and computer programs were flight tested for the first time. STS-41B was the first checkout of the Manned Maneuvering Unit (MMU), and the Manipulator Foot Restraint. McCandless made the first untethered, free flight with each of the two MMU’s carried on board and alternated with Mission Specialist Robert L. Stewart in the activities constituting two spectacular extravehicular activities. As he floated free of the Shuttle, McCandless became the first “human satellite….”

Captain McCandless currently makes his home in Conifer, Colorado….

Now you know — and he lives… just a stone’s throw away, from my mom’s home… to this day. Smile.

As Tangerine Now Faces A Perhaps $250-$450 Million Fraud Judgment — In NY State Court, The Able Justice Engoron Ask For Input… By 5 PM EST Today.

The adage he invokes is “false in one, false as to all….”

This is just an endless series of rats… gnawing at one another, as they try to leap off the burning tangerine hued ship, now sinking, in NY Harbor. It would almost be comical, if the GOP wasn’t lining up behind him to try to send him back to the White House (instead of the Big House!) in 2024. Here’s the latest, in his dumb show:

As you are undoubtedly aware, in an article in the February 1, 2024 on-line edition of the New York Times, headlined “Trump’s Former Finance Chief in Negotiations to Plead Guilty to Perjury,” William K. Rashbaum, Jonah E. Bromwich, and Ben Protess write that defendant Alan Weisselberg “is negotiating a deal with Manhattan prosecutors that would require him to plead guilty to perjury.”

What’s more, he “would have to admit that he lied on the witness stand” in the case pending before me (and during a pre-trial interview plaintiff conducted).

As the presiding magistrate, the trier of fact, and the judge of credibility, I of course want to know whether Mr. Weisselberg is now changing his tune, and whether he is admitting he lied under oath in my courtroom at this trial. Although the Times article focuses on the size of the Trump Tower Penthouse, his testimony on other topics could also be called into question. I also may use this as a basis to invoke falsus in uno.

As the article notes “perjury — particularly in a high-profile trial — undermines the broader ends of justice and cannot be ignored.”

I do not want to ignore anything in a case of this magnitude. By Wednesday at 5pm, please submit, as officers of the court, a letter to me detailing anything you know about this that would not violate any of your professional ethics or obligations. I would also appreciate knowing how you think I should address this matter, if at all, including the timing of the final decision.

Likely Science “Book-Find Of The Century”: Vesalius’ Own Notes, For A Third Printing Of The Radical 1555 Bible On Anatomy…

The price it just fetched, at auction, is largely incidental — as I am put in mind of the fine documentary “The Price Of Everything…” [we mentioned it here before].

No, I’d say… what matters, is that he was nearly put to death, for having challenged the ancient Greeks texts — on matters of anatomical science, of the day. In the early 1500s, doctors were still taught anatomy from BCE Greek and Roman texts.

He largely introduced, and codified, the notion of skeptical examination, in the physical anatomy of any body. And he went on to hide his hand-written latin margin notes — for a forthcoming third edition (while being persecuted for his science), an edition that was never set to print — in his own personal copy of the second edition of his masterpiece.

Here’s the entralling story of the re-discovery, in full — and a bit:

…In 2007, a retired Canadian doctor paid €13,200 (US$14,256) for a well-used second edition of Andreas Vesalius’ De humani corporis fabrica (1555) — one of the most influential books in history. Only 150 copies are known. The book had been in the hands of collectors for more than four centuries and had extensive latin annotations by an unknown hand.

Book collectors tend to shun books with annotations as they are often seen as desecrations of the finished work, particularly so with important works, but even more so when a book is as large, beautiful and of such immense historical gravitas as De humani corporis fabrica….

When Andreas Vesalius (1514–1564) first published his radical De humani corporis fabrica (On the Structure of the Human Body), the ancient texts of Aristotle and Galen were still judged authoritative in the medical schools of Europe. By performing his own dissections, Vesalius discovered errors in the ancient authors’ teachings. The De humani corporis fabrica, which drew attention to these flaws, initially threatened the academic medical establishment but ultimately won Vesalius admiration and a post as court physician to Charles V, to whom he dedicated the volume….

This is indeed, a wonderful time to be alive — as now, most of the persecution of scientists, for scientific ideas, seems to be only in small, local pockets — chiefly relegated to the Bible Belt in the US. [The above volume is now going to be displayed (shared with the world!) in the main library of Vesalius’ alma mater, KU Leuven, the oldest university in the Low Countries, nearly six centuries later.] Onward.

The 57 Pager In The DC Circuit Is Signed By A GW Bush Appointee… Tangerine Is A Loser. Again.

Trump is DOA. The only question now is whether his felonies trial in DC will have reached a conclusion before the end of the GOP convention this summer. The panel ruled unanimously — including a GW Bush appointee, that Trump is NOT immune.

No surprise. [The panel was very… polite — it labeled what he did as attempting to “overstay” his time as president. We all know it was a far more sinister event, than just not leaving a dying 2-4 am rager at a college frat house….] In any event, here’s the center of the donut (in Tangerine’s arguments — as observed by the DC Circuit):

We note at the outset that our analysis is specific to the case before us, in which a former President has been indicted on federal criminal charges arising from his alleged conspiracy to overturn federal election results and unlawfully overstay his Presidential term.

We consider the policy concerns at issue in this case in two respects. First, we assess possible intrusions on the authority and functions of the Executive Branch and the countervailing interests to be served as those concerns apply to former President Trump’s claim that former Presidents are categorically immune from federal prosecution. We conclude that the interest in criminal accountability, held by both the public and the Executive Branch, outweighs the potential risks of chilling Presidential action and permitting vexatious litigation. Second, we examine the additional interests raised by the nature of
the charges in the Indictment: The Executive Branch’s interest in upholding Presidential elections and vesting power in a new President under the Constitution and the voters’ interest in democratically selecting their President.

We find these interests compel the conclusion that former President Trump is not immune from prosecution under the Indictment….

Who Knew?! Thunderstorms Make “Terrestrial” Gamma Ray Bursts — And Are Thus Earth’s Most Powerful Particle Accelerators!

It seems both gamma rays, and very rarely, antimatter — are produced in terrestrial lightning storms like those hovering over Southern California this morning.

NASA offers Fermi data that confirms the phenomenon. [This NASA press release is written in a way — with graphics! — to make it both useful, and engaging for middle school students.] Here’s the latest:

…A flash of lightning. A roll of thunder. These are normal stormy sights and sounds. But sometimes, up above the clouds, stranger things happen. Our Fermi Gamma-ray Space Telescope has spotted bursts of gamma rays – some of the highest-energy forms of light in the universe – coming from thunderstorms. Gamma rays are usually found coming from objects with crazy extreme physics like neutron stars and black holes. So why is Fermi seeing them come from thunderstorms?

Scientists suspect that lightning reconfigures the cloud’s electrical field. In some cases, this allows electrons to rush toward the upper part of the storm at nearly the speed of light. That makes thunderstorms the most powerful natural particle accelerators on Earth! When those electrons run into air molecules, they emit a terrestrial gamma-ray flash, which means that thunderstorms are creating some of the highest energy forms of light in the universe. But that’s not all – thunderstorms can also produce antimatter! Yep, you read that correctly! Sometimes, a gamma ray will run into an atom and produce an electron and a positron, which is an electron’s antimatter opposite….

Great middle school geo-science stuff, that!

And — no surprise…. The DC Circuit has told Tangerine he has no absolute immunity (upholding USDC Judge Tanya Chutkan’s solid ruling — in 57 pages of a PDF). Very shortly the Supremes will say… the same. Onward, grinning.

Merck To Buy Fish Farm Animal Health Biz, For $1.3 Billion In Cash — Formerly A Bayer Unit, Now Elanco Owned.

Again, Rahway does need to spend some of that pembrolizumab $25 billion a year somewhere, to reduce tax liabilities around the globe, and begin to prepare for 2035 or so, when it comes off patent (taking into account likely extensions). And it has a very decent veterinary, or animal health business already — so adding farmed fish drug lines… makes sense.

But perhaps most of all, this $1.3 billion cash amount is immaterial to the company. [That’s an enviable strategic advantage — being able to hit singles (and feel good about it!), rather than forever swinging for the fences.] And so… this is all good news:

…Merck agreed to buy Elanco Animal Health Inc.’s unit that makes farmed fish health products for $1.3 billion.

The purchase price represents about 7.4 times the estimated revenue of the aqua business, Elanco said Monday in a statement. Elanco shares rose 5.8% in trading before US markets opened, while Merck’s were little changed….
