Meanwhile — In Reality, US Universities Are Ending Legacy Admission Preferences…

John blathers on tonight, impotently, about a bunch of nonsense threats being made out of Texas. His belchings concern the perfectly lawful “wiggle room” Chief Justice Roberts, for the majority, spelled out in the Harvard and UNC cases, last month.

It drives mediocre, embittered doddering whyte guys like Hinderaker… crazy. I love it.

I also love that now at least three elite colleges — including Wesleyan — have ended “legacy” admission boosts, which because of 200 years of history, overwhelmingly and unfairly gave mediocre whyte kids an admission they hadn’t… earned on merit.

So smoke that, you Nineteenth Century moron, Hinderaker.

In The Sea Of Cortez — Come April of 2024…

I will likely be on a catamaran, awaiting the same visions I saw in the Shawnee National Forest about two hours from Nashville, in the Summer of 2017 — a total eclipse over North America.

But this time, it will run from Southwest to Northeast, ending over Maine. And it will be April, so rain or even snow might be a visibility problem over continental land-masses. So I think being mobile on the warm water will be the best viewing / videoing strategy. And who doesn’t love the idea of Tulum, for a week — before or after? Or… both! From NASA, then:

…NASA has awarded funding for three science teams to conduct citizen science investigations as a total solar eclipse sweeps across North America on April 8, 2024. In these experiments, volunteers will help study the Sun and its ethereal outer atmosphere, called the corona, which is revealed when the Moon completely covers the Sun’s bright disk.

“During next year’s total eclipse, hundreds of volunteers will capture images of the Sun and its corona to help answer real science question about our star and how it affects us,” said program scientist and eclipse lead at NASA Headquarters, Kelly Korreck.

“These three projects will build upon citizen scientific efforts from the 2017 solar eclipse and allow a multitude of ways to participate in the eclipse during the Heliophysics Big Year,” said NASA Heliophysics citizen science lead, Elizabeth MacDonald. “Volunteers make this important research possible, and we look forward to seeing what they help reveal. . . .”

Experiences are what enrich our lives, in last measure, through memories — not material things, per se… and why not a sublime experience, indeed, infused with solar science experimentation… in those crystal blue glassy warm waters? Why… not? Grin — out, as it will be more than a century before it occurs again over the heart of America.

Just As Bitsy Retreads Stupid Lies, We Will Cite Emerging TRUTHS, About The Trump J6 Multi-Count Indictment…

Ole’ Bitsy is doing her level best (pathetic though that effort undoubtedly would appear, to any sentient being) to say “I am NOT crazy! — they are crazy!!!” while retracing a slew of already fully debunked piles of dung.

Charming.

Meanwhile, outside the MAGA reality distortion bubble (in which she resides, at least on paper — not clear if she even believes any of it) — we read fine analysis of EW, based on what is known about the coming J6 indictment of Tangerine, on multiple felony counts. Do go read it all — but here is a bit:

…[P]otential implications of this. When January 6 defendants have argued that Trump authorized them to attack the Capitol, DOJ has always responded that the President has no role in the vote certification. So if DOJ were to include January 6 in such a charge, it would be an area — one of the most clear cut areas in the Constitution — where the President literally has no authority, and so easy to show that Trump was exceeding his authority.

Additionally, as noted above, the standard for corrupt purpose on obstruction is not yet settled. The DC Circuit might yet require “corrupt purpose” to be shown via some “otherwise illegal activity.” If that happens, DOJ may want to have several other crimes charged that will prove that prong of the offense, of which 242 could be one.

In other words, the thinking may be, in part, that it’s clear the President has no authority in the Electoral vote certification. Trump tried to deprive Biden voters of their franchise with his efforts on January 6. And that is one of a number of other crimes he committed in his efforts to obstruct the vote certification….

As I say… this has all become a bit like shooting GOP idiot-fish, in a barrel now.

Gossip Initially (And Mistakenly) Attributed To Ebola Or Marburg’s — Five Recent Deaths In Algeria Were Heat Related / Dehydration…

It is rather disconcerting from a “process” standpoint that, even for only 24 or so hours, some members of the public (likely due to hospital workers’ gossiping) thought that Ebola might be the cause of five in-hospital deaths. That would be how unfounded panics get started.

Fortunately, quick testing revealed that they were heat-exposure related, and the government got pressers out immediately — to avoid a wider panic.

Do go read it all, but here is that story — from a local news outlet:

…The statement came after reports of five deaths in Tizi Ouzou from the viruses. The hospital in question denied this and said five people died from hyperthermia due to an ongoing heatwave….

“Due to the continued circulation of false information related to the presence of Ebola and Marburg virus cases in Algeria, it must be clarified that, to date, no case of these diseases has been identified or registered,” the health ministry said in a statement published to its social media….

It is a truly odd moment in history, when the GOOD news is that they died of heat exhaustion — i.e., not directly contagious, in the way a viral load might be. Wow. Onward.

Status Update, On That Specious Monroe, Louisiana “Injunction” Against The Biden Administration — Now Stayed By 5th Cir. — USDC Trial Judge Doughty Again Told: “Stand Down”

Tonight, the Biden Administration has — in the most polite of possible terms, told USDC Judge Doghty he needs to obey well-settled black letter federal law (stretching back over a half-century), and… “take a seat“.

Via an order he entered right before the Fifth Circuit stayed his ruling, he still imagines that he can require the complaint to be formally answered (by various federal agencies), and that he may order more discovery to be taken, of even more federal agencies… even though his appellate panel has effectively told him (ordered him, actually) to sit still.

Terrence A. Doughty would be a pure fool not to accept the Defendant’s position here. But if he wishes to be told (again!) that he cannot apparently even read the law properly. . . he may press on, alone. Here’s that bit:

…If an appellate court concludes that any or all of the [States: Louisiana and Missouri] Plaintiffs lack Article III standing, then there would be no justification for any discovery pertaining to the allegations raised by those Plaintiffs: “[W]ithout proper jurisdiction, a court cannot proceed at all.” See Steel Co. v. Citizens for a Better Env’t, 523 U.S. 83, 84 (1998). For this reason, courts in the Fifth Circuit regularly stay discovery in analogous situations where the threshold question of Article III standing remains outstanding. See, e.g., Johnson v. Ashmore, No. 3:15-CV-2475-K (BF), 2016 WL 8453918, at *1 (N.D. Tex. Jan. 22, 2016) (“The Court finds that a stay of discovery is proper until… preliminary questions” about the court’s subject matter jurisdiction “are decided.”)….

Under these circumstances, requiring Defendants to answer each of the 584 paragraphs in Plaintiffs’ 165-page Complaint would impose a significant burden on Defendants for no apparent litigation purpose. The Court should waive Defendants’ obligation to answer….

Now you know — out, grinning.

As A Public Service — We Help Scott Johnson, Here — By “Truther-ing” Trump’s Presser…

Obviously, the headline is that Tangerine is a plainly target in the J6 insurrection, and the ensuing aftermath: all the rioting and mayhem. It is highly likely he will be indicted. Again (3X).

Why? Because he plainly encouraged and incited it, while the evidence shows… he knew (of his own admissions) that he had in fact lost the 2020 election, fair and square. Members of his own family have so testified to the grand jury, we are reliably informed.

So — we may now confidentially tell Scott to sit down — and shut up — and let real federal law enforcement do its job.

There was a time… when the GOP at least claimed… to be about law and order.

Now it is only about graft and corruption and criminal enterprise management for wanna-be billionaires.

Charming.

Hinderaker Thinks Hollywood… Is Inexplicably-Coterminous With… Disney?!

Well… once again, John Hinderaker is very proudly displaying… how little he knows — and how (falsely, I might add) everything centers around race, in almost every story he tells.

More precisely, his stories center on would-be whyte grievance bleatings.

This night, he feels the SAG-AFTRA strike is no big deal, because in his mind… it only crimps… Disney. And in his view, if a live action Snow White (with a diverse cast) never gets made… well, it will all have been well-worth it.

I won’t bother to dissect in detail the onion layers of… feckless cluelessness offered there. You can see it for yourself.

In short, there is nothing in any news cycle (in John’s warped mind)… that isn’t, at bottom… yet another purported whyte grievance to voice.

Damn John — it must be exhausting to be so full of bitter hatred — while being so… wrong, about essentially everything, in… 21st Century American life.

Out.

Bill Otis Gets This Much Right: The GOP Has Already Lost 2024. No Doubt.

Bill’s latest, while attempting to explain why Tangerine is crushing DeSantis in the early polls, even those run by people who would prefer DeSantis on the ticket… admits what many sensible middle of the road, and left leaning folks already see: the GOP is done. Stick a fork in it for 2024 national races, to a near certainty.

With its own core divided so egregiously, the GOP cannot field a winner in the general. There is, in short, no one to eclipse Trump — and the world knows Trump will lose in the general, no matter whom the Democrats nominate. In context, and in specifics, here’s how Bill sees this:

…Trump is piling up felony charges, some merely products of political grandstanding (the Alvin Bragg show, in particular), but some more serious than that (Jack Smith’s federal indictment for misappropriating classified documents and obstruction of justice). More legal trouble is likely on the way, both from the Atlanta prosecutor and, more worrisome for Trump, further charges from Smith relating to Trump’s egging on the January 6 riot. And Trump continues acidly to trash good men and strong conservatives he appointed, in particular Jeff Sessions and Bill Barr….

Bill pens this not because he is a man of principles — but because he is a pragmatist.

If the GOP is to survive into 2024, it will have to eliminate Trump — and avoid his coming third party run.

The GOP is already ankle-deep — in a muddy field. And, I don’t think the GOP has the shoes for it. They have no ideas — as to how this could ever work out to eliminate Trump, unless of course they feed him entirely-too-much (but… enough) KFC and McDs between now and then… I guess.

Game over.

Scott Sez: We Should Be Outraged, At A 1987 Clip Of Mr. Biden — About His Law School Record… But He Was Silent About That Access Hollywood Trump Video Of 2010?!?

Well, this is nothing — if not preciously… ironic.

Scott Johnson and the Powerliners are all a-lather, over a clip from 1987 (nearly 36 years ago!) in which Mr. Biden gets into a heated exchange over his law school credentials (with a reporter). About his law school… bona fides. [There is no dispute (and never has been one) that he was a licensed member of the bar. Or that he graduated, and passed his state’s bar exam.]

And yet — for six five long years, the joker named Johnson held his considerably waggy tongue, about an undisputed video tape, on which Johnson’s candidate, and then president — bragged about “grabbing her by the p#ssy” — and all but admitted to forcible rape. Since then, he’s been found liable in a civil court in NYC, for forcible sexual assault, and libel of the victim of his assault — and is now facing new libel and slander charges, about it: with $5 million already paid, and more coming.

He is also a defendant, under two felony indictments (that total over 70 separate counts), for stealing top secret documents, and campaign finance frauds.

But yeh — a 40 year old tape of an argument about law school credentials… that’s Scott’s headline.

As I say…

Update: The Briefing Schedule, In The Sixth Circuit, For That Crazy “Law” Against Trans Care In Tennessee… Is Filed.

We told you we’d keep a close tab on this one, on principle. And we will.

We can also report that the Sixth has put it on… a very short fuse. The patients’ / plaintiffs’ / Vandy brief is due a week from tomorrow. Here’s that Friday night scheduling order:

…BRIEFING LETTER SENT setting briefing schedule pursuant to the court’s 07/08/2023 order: appellant brief and amici briefs supporting the appellants due 07/24/2023; appellee brief and amici briefs supporting the appellees due 08/10/2023; reply briefs due 08/17/2023….

Now you know. And if you are living in a county that allows you register to vote in Tennessee, be sure to do so.

And be sure to write and call your legislators about what a deeply hateful, and unconstitutional “law” this March 2023 Tenn. Code Ann. § 68-33-101, et seq., is.

The idea that the local legislators (some with only high school educations) know more about the medical condition — and proper treatments around the exceedingly rare condition known as gender dysphoria… than the doctors at Vanderbilt Medical Center in downtown Nashville… is preposterous on its face (aside from the invasions § 68-33-101(b) lawlessly contemplates). Onward.
